Who do you file a complaint with against Ebay?
Over a month ago, I won a purse on Ebay, I sent a postal money order to the seller, Since they provided no contact info, I made it payable to their business name. I didn't hear from them and I emailed them. First they said that they did not receive the money order, then they complained that I made it payable to their business name, then they filed a complaint against me with Ebay for nonpayment of the item. They admitted that they had the money order, they won't send it back, and after their "investigaion," Ebay says the seller did no wrong and says I need to work it out with the seller or I will get an unpaid buyer strike against me. I have the emails from the seller where they state that they do have the money order and did send these to Ebay. Ebay is still favoring the seller. I'm going to have the money order traced to see if it was cashed, I filed a complaint with the post office and with Internet Fraud. Is there anything else that I can do?

OK, this happened to me. This is what you have to do:
Do you have the MO Number?
If so, yes, they can trace it after 60 days. Make sure you file and Item not recieved. You MUST send these items (in the future) with delivery confirmation to make SURE they recieved it. I did this with my MO and thank god I did.
Once you open a dispute, you can file to get your money back. It will cost you $25 (This will take you several months). File with your local police dept. Keep copies of EVERYTHING! Print up all the emails.
File with:
IFCC
EBAY
Local Police
Contact other members. (Does this group also accept paypal or just MO's).
Good luck! It is a long haul, but I am getting my money back from ebay.

Have you requested the seller's contact info and called them on the phone? It seems to me that all it would take is a phone call asking them why they filed a NPB alert on you when they have received your money order. All they would need to do is close the NPB alert stating that you have paid.

Scroll down the page until you see "contact info" and fill that out. Ebay will email you the seller's name, address and phone number.

I contacted the seller and they are stating that since the mo was made out to the business name instead of them personally, I didn't pay. Ebay knows that they have the mo because I sent them all the emails from the seller which state that they have the mo. And the seller is refusing to send the mo back.

If that was the name/address they gave you in the invoice, how can they really fault you for making it out to the business name? They should return the MO and wait for you to resend payment. The only bad thing about money orders is it will cost you (money AND lots of time/effort) to get your money back. But I would tell them that there is no way you'll resend payment until they send the original back. Why do they even need to hold onto it if they can't cash it?

If it was a postal money order, print out the emails with full or advanced headers from them admitting to the fact that they got it and now refuse to send you your item, and are refusing to send the money order back to you and file postal fraud charges.

I dont understand that if you made the money order out to their business name, why cant they cash it? That doesn't make sense. I've been dealing w/ ebay for about 2 years now and had 1 dispute, and thank god it was in my favor. Definitely keep on their cases, especially the fraud dept. and keep those emails. Good luck!!

A bank shouldn't cash a check made out to a business even if the business owner is cashing it. They will suggest depositing it and then withdrawing the money...so it isn't THAT big of a deal. The only way you can cash a check with a business name on it is if it is a DBA account.
So, they are either using a "business" name they haven't even registered, and so can't get it cashed; don't want to take that five second extra step of withdrawing it; or don't want it on their business files for some reason (taxes?).
