Is it legal??
DHR placed my neice in foster care permanently without notifying all her family....I have been trying to get her here with me and now they already have her placed in foster care....They didn't give me or anyone here in Alabama a chance to get her...she lives in Tenn. and she has a grandmother and 2 aunts and 2 uncles here in Bama....I can't get anyone in Tenn to give me any answers and I am thinking of getting a lawyer....I don't want her in foster care....Anybody know if this is right and what should I do?

I think they usually try to look within the family to see if anyone is willing and capable of taking the child before they place them in a foster home. Maybe when they asked your nieces parents if there were any family members who might be able to take her they didn't give the names of the relatives that live in Alabama. I'm sorry I really don't have any advice other than to just contact child services in Tennesse and see what can be done.

you DO have rights!!
contact your state's dept. of social services and explain the situation to them. they will help you go through the process of getting the child placed with you. you will have to apply for guardianship/temporary custody and subject yourself to home visits,interview's,etc. ask them to exppidite the process so the child's best interest's are served better.(ie:being with family instead of strangers!)

Thanx to you both....I thought I had a right to take her in my home....Let me also say that her Mom is my sister and her Dad is in jail and Mom is facing prison too and that is why she is not with them....I have contacted DHR here in my town and they said they could not tell me anything as that is confidential information....I do have the name of her caseworker now and her phone # and I will be giving her a call 1st thing Tuesday morning....

I hope everything works out for you. You do have rights, it is just more difficult to exercise those rights over a state line. I went through this iwth ohio and kentucky-so a lawyer is your best bet!

i hope every thing works out for you.. i would call d.s.s right away and let them know who you are and that you are willing to get a lawyer... and that you want her to come and live with you... they will do a back ground check on you and your family..they will call your kids school.. if you have kids.. dr.. and such..they probaly won't place her and your home right away so tell them you want to beable to see her no matter what if it is supervised...see if you can have phone contact with her.. good luck!!! and they would want to do a home inspection..
and call the d.s.s where you are at and see what info.. they can give you.. since they would be the one doing the home steady..
