    Unhappy Widow denied Social Security

    My friend whose husband just passed away has been told she cannot collect survivor benefits for her until at least 60. She has 2 children under 18 and has lost her job. Any suggestions?

    Was her husband in the service ? If so, she can collect his service pension, if she has no other income. It doesn't matter what she owns or anything.

    I only know this because my Dad was in WW2, and when he passed away in 1996, it would be a year before my Mom would be old enough for SS, so, she was able to collect his service pension until her SS kicked in.

    Other than that, I don't know. Is she able to work ?

    Social Security survivors benefits can be paid to:
    A widow or widower -- full benefits at full retirement age, or reduced benefits as early as age 60
    A disabled widow or widower -- as early as age 50
    A widow or widower at any age if he or she takes care of the deceased's child who is under age 16 or disabled, and receiving Social Security benefits
    Unmarried children under 18, or up to age 19 if they are attending high school full time. Under certain circumstances, benefits can be paid to stepchildren, grandchildren, or adopted children.
    Children at any age who were disabled before age 22 and remain disabled.

    That's what i thought, but this woman at the social security office said no you do not get anything and we may be able to get something for the kids!?

    You would think she could at least get it on the kids if not herself thats what I always thought.

    No he wasn't in the service and she has lost her job due to downsizing.

    Did her husband pay into SS? If so, then there most likely will be benefits for her children.

    she needs to get a lawyer to help her. There are lots of lawyers that do this for free. Check the phone book.

    She does not need an attorney - the SS office is correct on the survivor benefits. However, the children under age 18 are eligible and she needs to file for them NOW don't wait - it will take a few months to get their first check but it will be from the time she filed until the check was cut.

    As for survivor benefits they changed that back when good old Ronald Reagan got in there and screwed with SS for dependents. Trust me I was one of those going to college on SS benefits and my brother couldn't get any funds for college because of the change in the laws due to Reagan.

    My sister in law collected for her children, but not herself, as her husband was very young when he passed - definately under retirement age for benefits. However, her children were only 14, 14, 12, and 6. She still collects for her two younger ones but the twins are now over 21 and not in scholl, so ineligible.

    Even if he would have been in the service, you must pay into survivors benefits upon retirement or they cannot collect his pension after his death - I know this as a fact becasue that is one of the allotments coming out of my husband's retirement account. It's lilke insurance.
