    Angry Lost.. an talking in circles

    In DEC my family made the huge mistake of moving into the place im living now I am just soooo mad I cant take it. I really don't know how to start I live in a 2 story house that has been made into 2 apartments upper and lower im unfortunately lower! My neighbors stomp and fight and yell. It is a large family consisting of 2 adult sisters ages 20-27 ish and the 12 kids who live in a 2 bedroom apartment with all tile floors. They have random men coming all hours of the night. not that long ago we were hanging out watching TV my walls start to rumble and then it got really Smokey outside I went outside and my neighbors are right outside smoking weed! I was so mad I watched out the window because I was on the phone with the cops and this random guy is peeing on our shared fence well by time the cops even came around my neighbors were inside. so on my lease it says 0 tolerance for neighbor complaints so I call Ms.Buffy the property manger and she says you will need to have one of them arrested before I can do anything because its hearsay I was like what. so thats just the beginning the apartment with no vents none in the bathroom and not one over my gas stove I have contacted code enforcement via e mail and they are saying that they will most likely shut this building down until they fix it but with gas and costs of food we are worried because if we are kicked out by code enforcement and our slumlord does not give our deposit back my family will be living in cars I don't know what 2 do I am not sure if I am owed my deposit by law if the property is closed by code enforcement sorry for rambling on and on I just dont have anyone to really talk to

    If your building is shut down because of code then yes they have to give your deposit back. Now that being said if they are slumlords then I don't think the will hand it over to you. So you might have to take them to court. The city has nothing to do with deposits.
    I don't have a vent over my stove or the apt. I rent I have never been told we need a vent over our stove. And my apartment does get inspected.

    Read the fine print and see if there is some way you can break the lease without losing your money, also familiarize yourself with the rules and laws on renting in your area and see if you can break the lease and start looking for another place to live.

    Also if you have never owned a home before there are gov. programs to help you own one in some areas and with the market the way it is you might get a great deal. Tell what state you are in someone might be able to reccomend something.

    Vents over the stove and in the bathroom are conveniences not necessities. They were more than likely not required when the building was constructed - the building does not have to meet the current building codes it only has to meet the codes for when it was constructed or if it had a major renovation. As for the neighbors from hell - well get the local police number on speed dial. I do agree that you really should look into what is required of landlords and tenants. Good luck.

    They don't have to meet the current building standards. If they did then all the old buildings would have to be torn down and rebuilt. They do have to meet some standards but not the current building standards. I have dealt with Section 8 as a landlord and we rented several older (over 50 year old) homes and they didn't meet the current building codes and were rented all the time with no problems. There are standards they must meet but a house not having for instance "hurricane clips" on the roofing area are not required for Section 8 but are required for new construction.

    Yeah that.
    And there are occupancy laws also, so you should check those if that many people are living there.

    There is a guy in the next building from me that sits out on the steps in the evenings and smokes a blunt. Every time you walk by there it smells so good, lol!

    Yes this is right. My house is 89 years old. When we had our fire in the upstairs apt. the city said we had to raise the kitchen ceiling 3 inches. But because it was ok before the code was in place before the fire we didn't have to change it.

    They do have their own requirements. And most of them are very good such as the lead paint. I can't imagine anyone wanting to live in a place that has lead paint. But the requirements of outlets is too funny to me - heck my house would never pass inspection - I don't even have one at all in the bathroom and only 2 in each bedroom.

    Section 8 goes by quality when inspecting not code...BUT, if you live in a city that requires rental housing to be registered with the city then they are also subject to code laws too. I had lived in one house that section 8 passed inspection and then 3 months later when the city came to do their inspection that they do every 3 years they shut the house down (condemned it) for not meeting code. They red tagged it and made me leave right then, it took 4 months to be able to get all my belongings out.

    It's major stressful having to live under those conditions. I don't know anything about codes and stuff, I bought my house 20 years ago, but, we have two rental houses on our street, and, when people rent it, they rent by the dozen... I think that's the only way they can make the rent.

    They are so disrespectful it's unreal... I mean, it makes you wonder who raised these morons ! My parents taught me to respect others, I treat people exactly as I expect to be treated... but, these morons don't understand that.

    Any dummy that burns doobies outside in public deserves to be busted... that's just a flat out dumb move. *duh* My neighbors burn them every few days out on their back deck... not thinking anyone knows (that's why I don't care... they are not 'trying' to be jerks), but, if they thought about it, it's only a privacy fence between us, not a wall...lol, I'm 15 feet from you, and yes, the wind blows our direction.... another *duh*, and, I can hear you saying "they can't smell it can they ? No, they can't smell it"... yet another *duh*

    If it's someone respectful who smokes dope, I could care less... but, when it's dirt bag @ssholes, who pee on your fence too, just daring you to do something, well, that makes them fair game.

    I wish you some peace, I really do... it's a damn shame having to live that way.
