i've banked with BOA for years and never had any problems except when I overdrew my account. of course, that was MY fault, can't blame them. they did give me the fee's back as a one time courtesy. i can't believe they would sign him up for it without his asking for it. i hope they don't start messing up, i am drama and problem free for the moment and want to stay that way.

I did speak to the fraud dept at BOA & they were the ones who told me I had to pursue this matter on my own. They don't consider it fruad if you knew the person since I might have "given" them my cards to use. Yea...right...credit cards were in a zipped-up day planner on my desk.
I did call local attorneys who want $500 up front. Wish I had one of those money trees growning in my bcak yard. Unfortunately all I grow are weeds
I was advised to call the police & file charges which I still may do. Thing is if I get him arrested I am never going to see any money. He keeps promising me but I did call him last night & tolf him July 1st is when I will be expecting the first payment. He pays in either cash, MO, or cashiers check.
I am going to try to contact the state's Atty General about BOA practices.
In my entire life I have never had a overdraft or a late payment until that jerk stole my idenity.

You need to file charges against him ASAP. The State Attorney's office can't do anything to BOA - they did nothing wrong - your "friend" did and he needs to be prosecuted. You will never get a penny from him until you press charges and make his restitution to you a part of his probation. Been there done that and that is the only way you are going to see any money. What you are probably not aware of is that a Mastercard or Visa are transferable cards and anyone can use your card. However, American Express is Non-Transferable and it can only be used by the card holder - in theory that is. So unless you want to continue to be a victim to him you need to press charges NOW.

I don't think BOA will do anything until you file charges against your 'friend'. Once that is done, I don't think they can still hold you liable for the charges (I'm really not sure, you would need to get legal counsel on this). Call around & see if there is some sort of legal aid, where you can get free/reduced fee representation.

She won't need legal aid. It is called the States Attorney's Office and they will prosecute him for the charges on her behalf. The bank will have to give up the files and info regarding the case. The most important thing she needs to insist on is that his release from probation/parole is contingent upon payment of restitution to her. Unfortunately not sure the bank/credit card company will let her off the hook for the charges.

Thanks, would the atty gen's office also take care of BOA?
My mom banks with them & I really don't like them (I'm joint on her acct), they made a mistake on her account & I had to go in & fight with them for over 2 hours for them to reverse the charges - even after I proved it was their error. Unfortunately my mom refuses to change banks.

BOA gives credit cards to illegals. I won't use them because of that. Their "Keep the change" program isn't that great either unless you consistently charge less than $5. Otherwise you are better off using a Discover card or some other credit card that pays you a percentage back. If I buy groceries totalling $70.35 with a Discover card I get 2% cash back for a total of $1.41 with the keep the change program you only get $0.65. I can also take tta $1.41 and apply it to my bill or I can cash it in on various gift certs, some of which double the credit so I could feasibly get a gift cert for $2.82 for someplace while you still only get 65 cents with BOA.
