My head hurts just dealing with this crap. I don't think there were other witnesses, my daughter said it was just her and my son and the teacher but the teacher said she had witnesses but when I asked her who they were, all she said was "I'm not going to do this", so who knows if there really was. I know she's not going to admit to doing it, but I am going to do everything I have to to make sure that this is dealt with.
I get more angry the longer I think about this. I would inform the principal if she didnt like you calling the superintendent, she dam*ed well wont like who you're gonna call next. Then contact the School Board....if that doesn't bring results I would contact the State Dept. of Education. This is BS...EVERY child deserves an education, and to feel safe while obtaining one. I would also tell them (principal, teacher,& others you talk to) that if another incident happens with this teacher you WILL file a police report.(or file one now) Sounds like this teacher should not be working with children...in any capacity.

Then I tried the principal but she was out of the office so I left a very long message and asked her to call me back...I just got a phone call from her a few minutes ago and she said that she doesn't think the teacher would've done that - "that's against school policy" but she'd look into it and let me know what the teacher had to say. Like a teacher has never gone against school policy before? (Now, let me say, I know a lot of teachers who are great teachers! I know that not everyone is like this one teacher and I'm not trying to say anything negative about any other teacher.)
This isn't the only issue we've had with this school. Kids have kicked my son and left horrible bruises on him and everytime I've complained about it, I get told that boys are boys and they rough house. Yes, I'm aware of that but there's a point when it gets past rough housing. The school nurse (omg, I hate even calling her a nurse) is a moron. She doesn't listen to anything and doesn't seem to understand English at all. She's actually called my son's doctors and asked them if I'm causing his medical problems (let me assure you, I am not and none of what my son has can be caused by me or anyone else...osteoporosis, liver disease, migraines, sleep apnea, eosinophilic colitis just to name some).
I'm just so pissed off at this school and am so tired of dealing with them. He can't go to another school because of where we live (there are 6 other elementary schools here) and we are planning on moving this summer - hopefully within a different school's boundaries.
Okay, I'm done ranting now, sorry it's so long.
File a police report, press charges. Forget "talking" to the teacher or the principal. This women could have broken your childs hips or even his spine. OMG I am so so mad for you, I can't imagine someone hurting a child.
P.S The school doesnt file a police report, YOU DO, that is assult

Jenefer if you needs tips on what to do I have them I went thru 4 years of this with my DD and her school and I ended up going to the press and blowing the whole thing wide open. There are places in the school system that can help you and they have to provide you with the info it is their legal duty. Also you can take this as high as the court system. Doucument EVERYTHING save all emails write down all phone conversations who you talked to everything. I have much more you need to talk I ma here.

there are simply some teachers that should NOT be........there is one my daughter has at the moment that is about to cause me to lose my patience....Libby has to have a quiet place when she is working yet she puts her in this group that talks and gets in trouble everyday. I have asked her to just move Libby by herself is thats what it takes but still nothing. I can't wait for this school year to be over

Can you change his teacher? I know school is almost over with but it may help for him to have a different teacher.
I would also call police, seems like no one in the school wants to help. Call police and maybe the press. Let everyone know what is going on.

Okay, well I went in today to meet with the teacher and principal. The teacher admitted she made that rude comment about me to my daughter and that she was wrong in doing it. Then she said that she was really frustrated and having a bad day - not with anything concerning my son but with other things - and that she took it out on my son and daughter but that she didn't shove my son and would never, ever, ever do that. And according to the principal, another teacher said that she didnt' see it happen so that must mean it didn't.
I'm going to take the next step and file a report, not that it will do any good since the "witness" said she didn't see it, but I still think it needs filed.

At least it would be documented if something else comes up. Also, document everyone you talk to, the names, dates and responses etc.

Yeah I've been doing that. When I went in for the meeting, the principal asked if it was okay if she took notes and I said yeah, that's okay because I'm recording it.
