I'm so sick of the sue happy people. I bet if his butt got saved by this man he wouldn't be nearly as pathetic about the situation. Its just money, lives come first. I hope it gets thrown out of court and the boat owner has to pay all the court costs.

And they wonder why people stand by and watch things happen. Save someones life and get sued. Its crazy. People are afraid to make a move to help and with all the money hungry people its no wonder.

I do not agree that they guy deserved his boat be stolen or borrowed because he left the keys in it. If a person leaves their window open then they deserve to get robbed or raped? I dont agree.
However, these were extreme circumstances and as such the borrower did no wrong and had no ill intentions. Life always comes before property and limb (s). The boat was different than the "borrowed" tvs, clothing, furniture,guns, etc. "Borrowing food and supplies was ok in my book as well.
Maybe the man would fair better as a crime victim than as aplaintiff in a lwa suit. It is such a sad situation.

I am happy that man. Helped to save lives. He is a hero not a theif! He only borrowed it to save lives. People can be so freaking gready at times.

I am curious to see how this turns out. What I'd like to know is why he didn't just return it when he was finished with it? There are some exceptions to laws in cases of natural disaster but he still could have returned it.

after delivering 15 people to dry ground on Claiborne Avenue near the Orleans-Jefferson parish line, Morice said he parked the boat there and
left it for other rescuers to use.

He DID go back and let them know-probably as quick as he could with the situtation down there
Sometime in September or October, Morice returned to the home on State Street Drive and spoke to Lyons' wife, he said, explaining why he had taken their boat. He later e-mailed the Lyons a picture of him using the boat to rescue people.
If he was underinsured that's his own damn fault.

I'm not sure of how many, if any, of the past posts on this subject came from people directly effected by Hurricane Katrina. I actually live in Mississippi and the storm itself was tragic to say the least. However, for a fellow American that suffered loss himself to sue another over something so frivouls as a BOAT?? Unfortunately, a year later, we see and hear stuff like this every night on the news. We hear of people claiming 6 or 7 different addresses that were destroyed just to get more FEMA money illegally. The storm was bad enough but people like this are just pouring salt into an open wound. My fiancé and I opened up our home, which only sustained minimal damage, to two separate families. People needed to come together at a time like this and if that met borrowing your boat to save people then so be it. I knew people that were siphoning gas out of their personal vehicles to give to rescue workers just so they could get back out there to help. Then the same night you hear of someone who put a gun to a gas haulers head just because they had to wait in line a few hours to fuel up their vehicles.
What is the world coming to? Suing over a boat when there were people dying all around us??
Sorry for rambling, just something I am passionate about.

I have some experience in what happens when the flood waters come. We were flooded out of our home from the aftermath of hurricane Floyd back in 1999. At one time, there was 4-6 feet of water standing inside of my house. It took us over a week to get into my neighborhood and even then we had to take a boat and drive it up to my front door. We lost everything that we owned, but what we went through was not even close to what those people in New Orleans have suffered. In those times, you feel like you are living in third world country and you do what you have to do to survive, the hell with what others think is politically correct.
If the boat owner was really that concerned about his boat, first and foremost he would not have left the keys in it and secondly he would have moved it out of harms way before the storm hit. To go back now and sue the man who saved all of those lives is ridiculous. The boat owner regrets that he didn't carry adequate coverage on the boat to cover his entire loss. That is why he is looking for someone to sue for the $12,000.

What a jerk!!! My god, people needed to be saved and this man is only concerned about his stupied boat..He had to sue of all things??? OMG...
It's so clear that the owner of the boat does not care why the boat was used
in savings lives....I hope the judge gives the boat owner NOTHING!!!!!!!
And teach the jerk that life is much more important and shame on him!!!!!
The boat is gone and GOOD!!!!!!
I am so glad that the guy who saved lives is a hero!!! And leave this guy ALONE....

It just soooo rubbed me the wrong way. I mean, so what if the police used it? Is the jerk going to sue NOPD too? I was so disgusted, I sent his lawyer E. Ronald Mills an email telling him he should be ashamed of himself.

The boatowner does have grounds to sue. In tort law, you can use another's property without permission if there is a catastrophic situation. But the borrower is obligated to take care of what he borrowed as the situation allows.The example given in my text book is if there is a blizzard and you break into a barn for shelter, that's allowable. But if you light a fire and burn down the barn, you are liable for the damages. While the man does have grounds to sue, it doesn't mean that he will win his case.
