Supreme Court seeks White House views on hiring illegals
    By Michael Doyle, Mcclatchy Newspapers
    1 hr 56 mins ago

WASHINGTON — The Obama administration will enter the politically tricky immigration arena, courtesy of the Supreme Court .

On Monday, the court asked the administration for its views in a challenge to an Arizona law that punishes companies for hiring illegal aliens. Other states with large immigrant populations will watch the next steps closely, because their own laws and ballot measures could be on the line.

"This case involves a question of exceptional national importance: whether state legislatures and municipal governments may override Congress' judgment concerning United States immigration policy," attorney Carter Phillips wrote in a legal brief.

Phillips noted that "in the first three months of 2009 alone, over 1,000 immigration-related bills and resolutions were introduced, in all 50 states" and "at least 150 of these bills related specifically to employment." He called the result "a cacophony."

A famed Supreme Court litigator, Phillips represents the U.S. Chamber of Commerce . The business group is challenging the Arizona law as part of a coalition of corporate, labor and immigrant groups that range from the American Civil Liberties Union to the Arizona Farm Bureau Federation .

The challenged law, written in 2006, allows private complaints to be filed against employers. Those found to have "knowingly or intentionally" hired illegal immigrants could have their Arizona state business licenses suspended or revoked.

The law "reflects rising frustration with the United States Congress' failure to

enact comprehensive immigration reform," the 9th U.S. Circuit Court of Appeals said in a ruling that upheld the law.

In a closed-door conference Friday whose outcome was released Monday, the justices agreed to ask Obama's solicitor general, Elena Kagan , to submit a brief outlining the administration's views. The justices will review this brief before they decide whether to take up the case.

For the Obama administration, the legal challenge now dubbed Chamber of Commerce v. Candelaria poses some potentially thorny questions.

During last year's presidential campaign, then-candidate Barack Obama declared that the proliferation of state immigration laws "underscores the need for comprehensive immigration reform so local communities do not continue to take matters into their own hands.''

The Arizona governor who signed the state law was Janet Napolitano , who now serves the Obama administration as the secretary of the Department of Homeland Security .

Congress first imposed penalties for hiring illegal immigrants under the 1986 Immigration Reform and Control Act. The federal law explicitly pre-empts state action, save for regulations that cover business "licensing."

Twenty-one years later, the Arizona legislature approved the Legal Arizona Workers Act. The law also requires Arizona employers to participate in an electronic employee-verification program called E-Verify. In other states, E-Verify participation is strictly voluntary.

The law hasn't yet been enforced. The so-called "facial challenge" that the Supreme Court is considering asserts that there's no way the state law can be enforced without violating federal law.

Arizona officials had hoped to avoid the court challenge.

"Although no one disputes the general importance of immigration policy, that does not mean every dispute about a state or local measure regarding illegal immigrants merits this court's review," Arizona Solicitor General Mary R. O'Grady said in a legal brief.

If the government cares about this country and the citizens of this country, they would not worry about losing votes and do what is correct. Anyone who is here illegally and/or working illegally, are breaking the laws and should not be rewarded for abusing the system and abusing the people whose taxes pay for the illegals to have what some citizens can not afford. If these elected and appointed people do not have the intestinal fortitude to do what is in the best interests on the citizens of this country, then they should step aside for a person who will.

That is the problem Boopster, they don't care. Not the democrats, not the republicans. None of them care. All they care about is winning elections and the power that comes with being elected.

Americans pay for everything and then we have to pay for what the illegal aliens get for free. Makes me sick and the stupid politicians say "it costs too much to deport all of them".........Crap. Look what it cost to let them stay here and get free medical, education and welfare. I will stop here before I offend some of the "do-gooders" here like I have before on this issue on this thread.... I can only say, call your Senators/Congressman/woman and voice your opinions LOUDLY to them. I do it every day.

Heck, the politicians don't want to deport illegals because half the time they are employing them as house cleaners, gardeners, etc. Sheriff Arpaio even busted the city of Mesa for having a night janitorial crew of illegals cleaning city offices.

Yes, it would cost moeny to deport them. Here's an easy way to pay for it: deport the illegals. Now there are plenty of jobs for cleaning crews, gardeners, farm hands, construction workers, etc. Healthy people on welfare now have jobs available. They can work in those jobs and get off welfare. The savings in welfare payments will more than make up for the cost of deporting the illegals. That doesn't even include the medical savings costs or costs to the schools who have to print everything in Spanish and English and teach the illegal kids how to speak English.

I do call my Congressman and also my two Senators (and sometimes as many as 20 of them from other states) about illegal aliens and I also tell them that I am TOTALLY against amnesty. We all know that the politicians will eventually grant them amnesty but I refuse to go down without letting them know how I feel. You can obtain a list of Congressmen and Senators with their phone numbers by doing a search. Spend about 20 minutes a day calling and voicing your opinion....I send them emails almost daily, most of the time you just put the Senators last name @senate.gov. ie, webb@senate.gov or warner@senate.gov. THE politicians need to hear every day how us AMERICANS feel about all the issues that they are trying to force on us, from amnesty to healthcare, etc.

There is a way to fund the deportations and it's rather simple. Have the illegals reach into their own pockets and pay for their own deportation! There is over $20 billion sent just to Mexico each year and you can't help wondering how much is sent to other countries. I have been in the bank watching people pull out wads of cash for money orders and they have to wait to have a teller who speaks their language. It's obvious they don't come to this country rolling in dough, therefore they have to be working somewhere to make this money they send home. Thru the years I have read stories regarding illegal immigrants such as the diner cashier who can only send $600 a month home to her family since she has to pay for her studio apartment, food etc......and lately the atlanta couple who won't go home since the wife gets free medical care which is better than what they can get at home. The clinic that has been treating the wife has to close due to the economy and financial losses and even offered to help send them home but the illegals responded with going back to his home country is "not an option" . Now they will have to go to the emergency room for all their medical needs which come to a higher cost to the tax payers. Mr. Politician, please tell me how they have been able to live in this country illegally for so many years...also how much have they paid in taxes?

Since today is election day in many towns, cities and counties, remember to vote. Also do as catesp mentions and call and write your elected officials. Maybe one day, these taxpayer servants will do their jobs or be embarrassed at the polls!

Millions worldwide would like to switch countries: study
Tue Nov 3, 2:00 pm ET

WASHINGTON (AFP) – Some 700 million people worldwide, or more than all the adults of North and South America combined, think the grass is greener on the other side of the fence and want to permanently move to another country, a poll showed Tuesday.

Residents of sub-Saharan African countries were the most likely to want to move abroad permanently, the polls conducted in 135 countries between 2007 and this year by Gallup showed.

On average, 38 percent of the adult population in sub-Saharan Africa, or around 165 million people, said they would up stakes and head for another country if they had the chance.

The most popular destination was the United States, where nearly a quarter of the 700 million -- around 165 million people -- said they would like to settle.

In joint second were Britain, Canada and France, each being named as the preferred destination of around 45 million people.

Thirty-five million said they would go to Spain, 30 million to Saudi Arabia, and 25 million each to Australia or Germany.

The least likely to want to emigrate were Asians -- only one in 10 Asian adults said they would move to another country.

Nearly 260,000 people aged 15 years and older were surveyed, either by phone or face-to-face, for the poll, which has a margin of error of around five percent.

Two items of interest here : WTH would happen if 170 million people suddenly decieded that it would be a good idea to immigrate - legally or not - to the USA ?

and ... if the MSM is always telling us how the US is always on the World's hit list, then why is it so many want to move here ??
