Anyone In Debt Again After Bankruptcy?
My Aunt Filed Ch 13 I Think About 2yrs Ago And Is On Disability Soc/ssi And Has Run Up A 3,000 Credit Card Bill
I Have No Experience With This Sort Of Thing She Is Worried They Will Garnish Her Check Etc..does Anyone Know The Rules Here?

No one can garnish your Disability/SSI check.
What she has done is a prime example of what most people do when they file bankruptcy. Instead of changing their spending habits, they continue along the same way and end up in the same place if not worse than when they first filed.
You need to get her to cut that card up and if there is anything that has been charged that can be returned then do so.

I believe the only thing they can take out of anyone's ssi/disability check is child support and back owed taxes. Depending on how far behind on payments she is to that cc, she could try calling them and try setting up some sort of payment arrangement with them.

Don't want to offend you but I don't fault the credit card company. They may send out these offers but no one is making anyone sign up for them and even if you do a card, no one is telling you to run up a $3K debt that you know that you will never be able to pay.

why is she worried about them garnishing her checks? is she planning on not paying them back? i think it's wrong to make a huge debt and then refuse to pay it back. the credit card company will make a settlement with her if she is willing to work with them, they will wave most or all the interest and fees if she is willing to pay back the origional dept. maybe she can sell all the stuff she bought to help her give them the money that she owes them.
i thought if you file bankruptcy you can't get credit for 7 years or something?

You can get credit the same day you file, you just end up paying a higher interest for it.

How are they preying on the elderly? It seems she is preying on the cc companies. She owes this.

I don't know why everyone is so quick to judge this lady. Maybe she used the cc to buy medications with (medicaid does not cover all prescriptions) or she used it to repair her vehicle, buy necessities like toilet paper and toothpaste, clothing, medical equipment, etc. Yes, she does owe the money but that doesn't mean she went out on some shopping spree right after she filed bankruptcy and said screw the bill. We all have unexpected expenses pop up when we least expect them and we do what we have to do to survive. JMHO.

to me it doesn't really matter what a person buys, if they knowingly go out and charge things they can't possibly pay back it's wrong. just like it would be wrong to steal a loaf of bread if you were starving, it's still stealing.
