Now that Democratic N.Y. Gov. Andrew Cuomo has piled on more ineffective gun control measures upon existing, ineffective gun control laws, http://twitchy.com/2013/01/15/new-yo...ions-into-law/ New Yorkers are coming up with alternative methods of self defense. #SelfDefenseInNY is trending nationwide in the U.S. We don’t know whether to laugh or cry, but we’re sure glad we don’t live in New York.

Matt Drudge hits Gov. Cuomo for mental health checks in gun law: ‘The patients are truly running the asylum!’

Posted at 8:57 am on January 16, 2013

Matt Drudge is fired up over the mental health measures pushed by Gov. Cuomo and New York lawmakers. ”The patients are truly running the asylum!” he tweeted.

This morning on The Drudge Report, the headline “mENTAL hEALTH cHECKS” links to an NBC article on New York’s sweeping new gun control law.

One of the most controversial elements of the bill is the requirement on providers of mental health services.

“People who are mentally ill should not have access to guns, that’s common sense,” Cuomo said, according to Reuters. “That’s probably the hallmark of this bill, coming up with a system that allows for mental-health screens.”

New York’s new law was passed in response to the Sandy Hook Elementary School massacre. “You can overpower the extremists with intelligence and with reason,” said Cuomo.

But since the shooter didn’t buy or own any guns, how exactly would “mental-health screens” have helped? Where’s the “intelligence and reason” in that? Perhaps the oddly incurious media should ask the patients running the asylum.

Conspiracy Theorists have noted that all of the "mass murder shooters" in the last years have been under mental health care and pscycotherputic (sp ) treatment. You know the ones that spend five seconds telling you about their product and another 55 telling you about the dangers and adverse side effects.... "Manchurian Candidate" ??

THIS Gun Is Banned but THIS One Isn’t?

    Posted on January 16, 2013

Mass killers still have access to plenty of firepower under New York’s new assault-weapon ban.

These two Benelli MR1 rifles have equal killing power — yet the one at the top is illegal to buy because of its “military” grip while the other is perfectly fine under the gun law signed by Gov. Cuomo last night.

The law also bans magazines holding more than seven rounds, yet has no provision limiting the number of clips someone can buy.

So a Newtown- or Aurora-style mass-killer can simply bring dozens of legal-capacity clips, which could be swapped out in just a second or two during a shooting spree.

“A 30-round magazine is no more dangerous than two 15-round magazines, or more dangerous than three 10-round magazines, or more dangerous than six 5-round magazines,” said Jerold E. Levine, a Manhattan lawyer and gun-rights advocate.

“It takes only two seconds to change the magazine in a semiautomatic gun,” he said.

REPUBLICAN INSIDER: Obama Livid Over Gun Rights Backlash
(“Like a spoiled brat he can’t believe he had to scrap the original speech for today’s version.”)
by Ulsterman on January 16, 2013

Like me you were probably watching the president’s gun control speech today. Was told this morning the presentation today was a revised version that was completed just last night after a bunch of back and forth between the White House and Senate leaders. Guessing that would be Harry Reid mostly. Last week the president was ready to go all in on the executive order scenario. Confiscation was going to be in play. Then the backlash came and it forced Obama to back off. He didn’t want to but after Reid said it was a no go, and the NRA was preparing to go to war with the White House, the president was given a revised script and that is what we heard this morning. You could tell too. Obama stumbled over the words more than usual. He didn’t have the time to prep the script like he normally does. Probably fuming he was forced to read the new version also.

This time WE WON and OBAMA LOST.

If people want to know how to go at the administration, this is how you do it. Be informed, and make your voices heard. This is an example of how the new media I have been telling you about can work against the globalists. It can be a huge weapon against them. And a big thank you to the NRA. It took on Obama and didn’t back off. A big part of the plan coming from the White House was to cripple the NRA and make it a liability for 2014 and beyond. That didn’t work and it will be a liability, but one that is going to hurt Democrats, not conservatives. Big time backfire for the Obama White House. I was told it “rocked them on their heels”. They fundamentally don’t understand the American people and they didn’t see this backlash coming. They have the media, and the glossy presentations, but they don’t really understand the American people and this debate was a pure example of that being played out. I love it!

Congrats to the state governments that were willing to voice opposition too. They did that and took on a lot of risk. Heard a list is being made and federal dollars might be taken away from them. Those state leaders knew that could happen but took on the administration anyways. That’s real leadership and courage being put on display for all of us and voters living in those states need to let those leaders know it is appreciated. You know how I feel about how important the 10th Amendment is, and today was also a big victory for the 10th Amendment against the Obama White House.

“In fact, the piling on by the political left, and their cohorts in the media, to use the massacre of little children to advance a pre-existing political agenda that would not have saved those children, disgusts me, personally. The second amendment to the Constitution is a basic right of free people and cannot be nor will it be abridged by the executive power of this or any other president.”

Now from here it’s clear Obama wants to try and use the issue as leverage for the 2014 midterms. They are hoping they can salvage something out of what became a fiasco for them. I just don’t sense enough Democrats willing to play along on this one though. Apparently the NRA and some other groups were lining up primary challengers to Democrats who went along with the president’s gun control plans and letting those Democrats know it was coming. That scared the heck out of them. Barack Obama is entering his lame duck phase, and the Democrats know it. After 2014 he becomes a museum piece. The president knows that too and it’s really ticking him off. We have to rub that in his face 24/7 while also building the conservative base back up into the kind of powerful entity it should be.

When people get involved, and make some noise, they still have the power. Use the new media, contact the lawmakers both state and federal, and talk to the people around you. That is power. That is what makes America so great and that is what happened today.

The president had his little moment, and was pretending it meant something, but he said nothing. That 21 (23) point plan or whatever it was, was hollow. It was a gutted version of what he was hoping to do as recently as a few days ago. Instead, he had to roll over and made a weak threat to Congress but that threat starts in the Senate and they already told him to shut up. Obama backed off. He lost this time, and it was all because of the American people. His media will try to spin it as something different, and if he gets another chance, the president will be right back to pushing for confiscation, but for now, we won this particular fight.

This victory is a lot bigger than you’ll hear in the regular media. It’s a lot bigger than anyone who stood their ground will ever know about. The Obama White House was trying to go very big on this gun control thing, and couldn’t pull it off. And Barack Obama is livid about it. Like a spoiled brat he can’t believe he had to scrap the original speech for today’s version.

Today was a great day for the good guys. Of course, there’s always another fight just around the corner, so we have to be ready. Let your readers know they did a great job on this. Each of them were a part of forcing the president to back off. Let’s do it again!

The reason there is another fight around the corner is because of the strategy of this administration. They have so many things going on, not a single person can keep up with it all. Their idea is to come at us from so many fronts that eventually one will get through, and they’ll use it like a leverage. Where are the Benghazi survivors? Was Hillary’s concussion the result of a plane crash in Iran like Russian papers report? Did we forget about the debt ceiling hypocrisy? If no one wants Obamacare, how come the ones who can do something only get themselves out of it? And, there’s so much more.

    ...

Just heard one of the news pundits say Obamas 23 point plan was all show and no go. And he was laughing about how he is attaching some of it to Obamacare saying that was a sign of being desperate. So it looks like even the mainstream media is backing up the RI version on this one. At least this guy was.

    ..

    Lock and load, folks.

If you haven’t joined NRA, join today. I did.

In the past month 250,000 people have joined NRA.

Also, go gun shopping as soon as gun stores restock their shelves.

If you don’t use the gun, you can eventually leave it to your grandkids…. or sell it.

Better safe than sorry with those filthy scheming Marxists trying to seize control of the USA.

If seeing “the other Hussein” onstage today using children as props doesn’t scare you, nothing will.

    That’s page 1 of the Stalin/Hitler/Lenin/Mao playbook.

    ..

Sorry RI not buyin’ it. The threat of outright confiscation by the federal government was just smoke and mirrors. Americans would never allow it and the globalists know it. The confiscation will sneak in over time through the mental health, background check and national gun registration systems. And then there’s the threat of the U.N. Small Arms Treaty.

    ..

I also think certain states will do their part to strip residents of their weapons. Cuomo just signed his own gun control in the “dark of night” outlawing 10 round magazines. New Yorkers were honest citizens one day and the next criminals.

    ..

Gov. Rick Perry released the following statement regarding President Obama’s executive actions:

“The Vice President’s committee was appointed in response to the tragedy at Newtown, but very few of his recommendations have anything to do with what happened there.

“Guns require a finger to pull the trigger. The sad young man who did that in Newtown was clearly haunted by demons and no gun law could have saved the children in Sandy Hook Elementary from his terror.

“There is evil prowling in the world – it shows up in our movies, video games and online fascinations, and finds its way into vulnerable hearts and minds. As a free people, let us choose what kind of people we will be. Laws, the only redoubt of secularism, will not suffice. Let us all return to our places of worship and pray for help. Above all, let us pray for our children.

    ..

Watch them come back with a vengance! Another massacre to rouse up more outrage and then, their second biggie: Immigation.

There is no NRA to oppose them there.

So, from this “victory” what we need to learn is that the American People like their Constitutional Rights and understand them to be inalienable.

If the GOP could do something rather then return in their tranches to rest on their unmerited laurels, it would be to push behind Rubio to pursue the Constitutionality of the “Executives Actions” of today. (What’s that anyway???)

Contrary to the common Washington belief, the American People have a pretty good understanding of their Constitution, even if it is only at the gutt level.

This is were the battle should be fought to resonate with them.

The next preemptive move should be to attack on all front the Immigration Executive Orders of August.

This could also be a battle fought at the State Level.

The best argument against gun control is American history.
Not at the nation’s founding. In the nation’s capitol on it’s bicentennial.

    JHo

Since my rights and yours precede and trump the left’s chronic mendacity, I’m not one to argue with leftists about my right to defend myself, regardless of the nature of the threat against me.

But when I do meet the left on its terms I use Jeffrey Scott Shapiro, criminal prosecutor for the District of Columbia from 2007-09.
    http://online.wsj.com/article/SB1000...mod=hp_opinion

In the wake of the horrific elementary-school shootings in Newtown, Conn., last month, many Americans, desperate to do something in response, have decided that much stricter gun control is the answer. Democrats have proposed reinstating the 1994 Assault Weapons Ban, and Sen. Dianne Feinstein has proposed legislation that would even restrict the use of some semiautomatic handguns.

    [...]

The D.C. gun ban, enacted in 1976, prohibited anyone other than law-enforcement officers from carrying a firearm in the city. Residents were even barred from keeping guns in their homes for self-defense.

    [...]

The gun ban had an unintended effect: It emboldened criminals because they knew that law-abiding District residents were unarmed and powerless to defend themselves. Violent crime increased after the law was enacted, with homicides rising to 369 in 1988, from 188 in 1976 when the ban started. By 1993, annual homicides had reached 454.

The Washington, D.C., Metropolitan Police Department also waged a war on firearms by creating a special Gun Recovery Unit in 1995. The campaign meant that officers were obliged to spend time searching otherwise law-abiding citizens. That same year, the department launched a crackdown called Operation Cease Fire to rid the District of illegal firearms. But after four months, officers had confiscated only 282 guns out of the many thousands in the city.

Civil liberties were endangered. Legislative changes empowered judges to hold gun suspects in pretrial detention without bond for up to 100 days, and efforts were made to enact curfews and seize automobiles found to contain firearms. In 1997, Police Chief Charles Ramsey disbanded the unit so that he could assign more uniformed officers to patrol the streets instead, but the police periodically tried other gun crackdowns over the next decade—with little effect.

In 2007, a panel for the U.S. Court of Appeals for the D.C. Circuit ruled that the city’s gun ban was unconstitutional. Senior Judge Laurence H. Silberman wrote in the majority opinion that “the black market for handguns in the District is so strong that handguns are readily available (probably at little premium) to criminals. It is asserted, therefore that the D.C. gun control laws irrationally prevent only law abiding citizens from owning handguns.”

The ruling was affirmed the following year by the Supreme Court in District of Columbia v. Heller. Justice Antonin Scalia’s majority opinion said that citizens were guaranteed a right to keep firearms that were in common use in their homes for self-defense, but that the government could pass reasonable regulations concerning firearms and ammunition.

Heller created a panic among gun-control advocates because it condoned the ownership of semiautomatic handguns, which are among the most common firearms in use but also the target of many restriction efforts. Supporters of the District gun ban maintained that because a semiautomatic handgun could potentially be converted into a machine gun—a class of firearms not expressly protected by Heller—they were in fact machine guns and therefore not protected by the Second Amendment. In response, Congress threatened to pass a law that specified the legality of semiautomatic handguns in the District. To avoid the embarrassment of being dictated to by Congress, the D.C. Council passed emergency legislation in September 2008 amending the gun ban to allow ownership of semiautomatic handguns for home defense.

Since the gun ban was struck down, murders in the District have steadily gone down, from 186 in 2008 to 88 in 2012, the lowest number since the law was enacted in 1976. The decline resulted from a variety of factors, but losing the gun ban certainly did not produce the rise in murders that many might have expected.

The urge to drastically restrict firearms after mass murders like those at Sandy Hook Elementary School last month and in Aurora, Colo., in July, is understandable. In effect, many people would like to apply the District’s legal philosophy on firearms to the entire nation. Based on what happened in Washington, I think that would be a mistake. Any sense of safety and security would be a false one.
Learn from history or be doomed to repeat it. But do not do so at the expense of my rights, property, or liberty because those rights, property, and liberty shall never be yours to take. You have nothing but history to warn you.

    Heed it.

NYTimes Buries Own Poll Findings Showing Support for Armed Guards in School, Blaming Hollywood
    By Clay Waters | January 18, 2013

The latest New York Times/CBS News poll, focused on gun control, showed gains for stricter gun laws and (coincidentally?) made the front page of the national edition, in a report by Michael Cooper and Dalia Sussman, under a wishful headline: "Massacre Sways Public In Way Others Did Not." http://www.nytimes.com/2013/01/18/us...ef=todayspaper

But they buried findings in the same poll that show 74 percent of Americans support conservative ideas of stationing armed guards in public places like schools and blaming Hollywood's culture of violence.

The massacre of children at an elementary school in Newtown, Conn., appears to be profoundly swaying Americans’ views on guns, galvanizing the broadest support for stricter gun laws in about a decade, according to a New York Times/CBS News poll.

As President Obama tries to persuade a reluctant Congress to pass new gun laws, the poll found that a majority of Americans -- 54 percent -- think gun control laws should be tightened, up markedly from a CBS News poll last April that found that only 39 percent backed stricter laws.

The rise in support for stricter gun laws stretched across political lines, including an 18-point increase among Republicans. A majority of independents now back stricter gun laws.

Whether the Newtown shooting -- in which 20 first graders and 6 adults were killed -- will have a long-term effect on public opinion of gun laws is hard to assess just a month after the rampage. But unlike the smaller increases in support for gun control immediately after other mass shootings, including after the 2011 shooting in Tucson that severely wounded Representative Gabrielle Giffords, the latest polling results suggest a deeper, and possibly more resonating, shift.

In terms of specific gun proposals being considered, the poll found even wider support, including among gun owners.
Yet the paper buried more conservative-friendly findings in the last two paragraphs, including the idea, raised by media-maligned NRA president Wayne LaPierre, of more armed guards in schools.

Despite the higher support for stricter gun laws, many Americans do not think the changes would be very effective at deterring violence. While most Americans, 53 percent, said stricter gun laws would help prevent gun violence, about a quarter said they would help a lot.

Other steps were seen as being potentially more effective. About three-quarters of those surveyed said that having more police officers or armed security guards would help prevent mass shootings in public places. And more than 8 in 10 said better mental health screening and treatment would help prevent gun violence.

Violence in popular culture is seen by a large majority of Americans, 75 percent, as contributing to gun violence in the United States, including about 4 in 10 who say it contributes a lot
    .
Those findings didn't make the Times's graphic, which focused on favorable responses to the questions on gun restrictions.

    • A nationwide ban on semiautomatic weapons?

    • A ban on the sale of high capacity magazines?

    • A national database of gun sales?

Survey Says : New gun laws won't stop violence
By KEVIN ROBILLARD | 1/16/13 6:10 PM EST

Americans don’t think a new wave of gun laws will prevent future mass shootings, according to a poll released Wednesday.

Only 39 percent of Americans think the new laws would stop gun violence, according to the poll from CNN and TIME http://swampland.time.com/2013/01/16...d=sl-main-lead compared to 61 percent who think it will continue. In December 1993, as then-President Bill Clinton was preparing a crime bill with gun control elements, 49 percent thought new laws would stop violence.

The poll also found 55 percent of Americans favored stricter gun laws, including 56 percent who support an assault weapon ban and 56 percent who think existing gun laws make it too easy to buy a gun. Forty percent think the law makes it just difficult enough.

But the poll also shows significant support for positions advocated by the National Rifle Association. Forty-eight percent said they generally agree with the NRA, and 42 percent said they generally disagree. Fifty-four percent also favored a proposal, backed by the NRA, to put armed guards in every school in the country. Forty-seven percent said armed guards would do more than gun laws to reduce violence in schools. Forty percent said the opposite.

The poll of 814 adults was conducted on Jan. 14 and Jan. 15. The margin of error is plus or minus 3.5 percentage points.
