    Re: Isn't This Racism ??

Today, Imus attempted to apologize to Al Sharpton on the latter's own radio show, but Sharpton didn't let him off the hook ...

Sharpton has called white store owners in Harlem "white interlopers," has called for boycotts of Asian-American businesses that serve black areas because the owners are not black. There is a lot more like that about Sharpton that will come up on a websearch. Who the hell is Sharpton to tell anyone that they are a bigot? Why does he think that he has any moral authority? Has the sulfur in his hair relaxer penetrated his brain?

A race-baiting con man like Al Sharpton is the LAST person who should be setting himself up as the judge, jury and executioner about racism.

When Sharpton jumps all over the Rap artists like 50 Cent,Snoop and others, who insult women every single day, then he can criticize Imus.

Until then he is a hypocrite!

Prosecutors drop charges in Duke case
By AARON BEARD, Associated Press Writer

RALEIGH, N.C. - Prosecutors dropped all charges Wednesday against the three Duke lacrosse players accused of sexually assaulting a stripper at a party, saying the athletes were innocent victims of a "tragic rush to accuse" by an overreaching district attorney. "There were many points in the case where caution would have served justice better than bravado," North Carolina Attorney General Roy Cooper said in a damning assessment of Durham County District Mike Nifong's handling of the sensational case.

Cooper, who took over the case in January after Nifong was charged with ethics violations that could get him disbarred, said his own investigation "led us to the conclusion that no attack occurred."

"I think a lot of people owe a lot of apologies to a lot of people," Cooper said. "I think those people ought to consider doing that."

Reade Seligmann, Collin Finnerty and David Evans were indicted last spring on charges of rape, kidnapping and sexual offense after the woman told police she was assaulted in the bathroom at an off-campus house during a team party where she had been hired to perform.

The allegations at first outraged the city, a faded tobacco capital with a long history of tension between its large working-class black population and Duke, an elite private school where most of the students, including the three lacrosse players, are white. The woman is black and attended nearby North Carolina Central University.

But that anger largely shifted to Nifong as his evidence against the three fell apart and questions surfaced about the accuser.

The attorney general said Wednesday that the eyewitness identification procedures were unreliable, no DNA supported the woman's story, no other witness corroborated it, and the woman contradicted herself. "Based on the significant inconsistencies between the evidence and the various accounts given by the accusing witness, we believe these three individuals are innocent of these charges," Cooper said.

He said the charges resulted from a "tragic rush to accuse and a failure to verify serious allegations."

However, Cooper said no charges will be brought against the accuser, saying she "may actually believe" the many different versions of the stories she has told. "We believe it is in the best interest of justice not to bring charges," he said.

Cooper called for the passage of a state law that would allow the North Carolina Supreme Court to remove a prosecutor "who needs to step away from a case where justice demands."

"This case shows the enormous consequences of overreaching by a prosecutor," he said.

Nifong, who was meeting with his attorney Wednesday in Winston-Salem, has been charged by the state bar with ethics violations connected to his handling of the case and could face disbarment. "Since he recused himself in January and turned the case over to the attorney general's office, he has had no involvement in the investigation," said David Freedman, Nifong's lawyer, speaking before the announcement. "At the time he turned the case over — and now — he has had complete confidence in the attorney general's office to make the appropriate decision."

The 28-year-old woman initially said she was gang-raped and beaten by three white men at the March 13, 2006, party thrown by Duke's highly ranked lacrosse team.

The three players insisted the accusations were "fantastic lies." Another dancer who had been with the woman also questioned if she had been raped, called the allegations "a crock" and said the woman seemed drunk when she tried to drive her home that night. Seligmann also produced ATM receipts, cell phone records and other evidence suggesting he was somewhere else at the time.

In the end, it appeared the case was based only on the testimony of the accuser, whom defense attorneys said had told wildly different versions of the alleged assault.

Nifong's recusal in January put the players' fate in the hands of the North Carolina attorney general, who promised "a fresh and thorough review of the facts."

The North Carolina State Bar charged Nifong with making misleading and inflammatory comments about the athletes under suspicion. It later added more serious offenses of withholding evidence from defense attorneys and lying to the court and bar investigators. He stands trial on those charges in June.

Nifong had accused the team of refusing to cooperate, calling them "a bunch of hooligans," and promised DNA evidence would finger the guilty.

His case started to erode when no DNA evidence tied any player to the accuser.

Defense attorneys also attacked a key photo lineup that used only pictures of lacrosse players, and they noted the accuser had claimed a decade earlier that she had been gang-raped but it never led to an arrest. A series of tests Nifong ordered from a private lab found genetic material from several men on the accuser's underwear and body, but none from any member of the Duke lacrosse team, they said.

Duke temporarily suspended Seligmann, 21, of Essex Fells, N.J., and Finnerty, 20, of Garden City, N.Y., in the wake of their arrest. Both were invited to return to campus but neither accepted.

Evans, 24, of Bethesda, Md., graduated the day before he was indicted.

John Danowski, the former coach at Hofstra who took over the Duke program last summer, has also said that both are welcome to continue playing lacrosse with the Blue Devils. On Wednesday, he moved the team's afternoon practice back so his players could attend a planned defense news conference with their former teammates.

    Duke lacrosse timeline
    By The Associated Press
    2 hours, 46 minutes ago

A chronology of events in the Duke lacrosse case:

March 13, 2006 — Duke University lacrosse players throw a party at an off-campus house, hiring two strippers.

March 14 — One of the dancers tells Durham, N.C., police she was forced into a bathroom by three men and beaten, raped and sodomized.

March 23 — Forty-six of 47 team members comply with judge's order to provide DNA. The sole black member is not tested, because the accuser said her attackers were white.

March 28 — Duke suspends lacrosse team from play.

March 29 — District Attorney Mike Nifong calls members of the team "a bunch of hooligans."

April 4 — The accuser identifies her attackers in a photo lineup.

April 5 — Lacrosse coach Mike Pressler resigns. Duke President Richard Brodhead cancels the rest of the season.

April 10 — Defense attorneys announce DNA tests fail to connect any of the players to the accuser.

April 17 — Grand jury indicts Reade Seligmann and Collin Finnerty on rape and other charges.

April 25 — Granville County authorities confirm the accuser told police 10 years ago she was raped by three men when she was 14. None of the men was charged.

May 15 — Grand jury indicts team co-captain David Evans on rape charges. He calls the allegations "fantastic lies."

June 5 — Duke president says team can resume play in 2007 under close monitoring.

Nov. 7 — Nifong wins election to continue as district attorney.

Dec. 15 — Director of a DNA lab testifies that, in an agreement with Nifong, he omitted from a report that genetic material from several men — none of them team members — was found in accuser's underwear and body.

Dec. 22 — Nifong drops the rape charges, saying the woman is no longer certain whether she was penetrated. The players still face charges of kidnapping and sexual offense.

Dec. 28 — North Carolina bar files ethics charges against Nifong, accusing him of making misleading and inflammatory comments to the media about the athletes. (He is also later accused of withholding evidence and lying to the court.)

Jan. 3, 2007 — Duke invites Seligmann and Finnerty to return to school. (They have not returned.) The accuser gives birth. Both sides later say she was not impregnated at the party.

Jan. 12 — Nifong asks to withdraw from case because of ethics charges.

Jan. 13 — North Carolina Attorney General Roy Cooper takes over the case.

A.G.'s statement dropping Duke rape case
    By The Associated Press
    2 hours, 5 minutes ago

Statement from North Carolina Attorney General Roy Cooper on the Duke University lacrosse rape case.

    Good afternoon, everyone.

On Jan. 13 of this year, I accepted the request of the Durham district attorney to take over three Durham cases. At the time, I promised a fresh and thorough review of the facts and a decision on the best way to proceed. I also said that we would have our eyes wide open to the evidence, but that we would have blinders on for all other distractions. We've done all of these things.

During the past 12 weeks, our lawyers and investigators have reviewed the remaining allegations of sexual assault and kidnapping that resulted from a party on March 13, 2006, in Durham, N.C.

We have carefully reviewed the evidence collected by the Durham County prosecutor's office and the Durham Police Department. We have also conducted our own interviews and evidence gathering. Our attorneys and SBI (State Bureau of Investigation) agents have interviewed numerous people who were at the party, DNA and other experts, the Durham County district attorney, Durham police officers, defense attorneys and the accusing witness on several occasions. We have reviewed statements given over the past year, photographs, records and other evidence.

The result of our review and investigation shows clearly that there is insufficient evidence to proceed on any of the charges. Today we are filing notices of dismissal for all charges against Reade Seligmann, Collin Finnerty and David Evans.

The result is that these cases are over, and no more criminal proceedings will occur.

We believe that these cases were the result of a tragic rush to accuse and a failure to verify serious allegations. Based on the significant inconsistencies between the evidence and the various accounts given by the accusing witness, we believe these three individuals are innocent of these charges.

We approached this case with the understanding that rape and sexual assault victims often have some inconsistencies in their accounts of a traumatic event. However, in this case, the inconsistencies were so significant and so contrary to the evidence that we have no credible evidence that an attack occurred in that house that night.

The prosecuting witness in this case responded to questions and offered information. She did want to move forward with the prosecution.

However, the contradictions in her many versions of what occurred and the conflicts between what she said occurred and other evidence, like photographs and phone records, could not be rectified.

    Our investigation shows that:

The eyewitness identification procedures were faulty and unreliable.

No DNA confirms the accuser's story.

No other witness confirms her story.

    Other evidence contradicts her story.

    She contradicts herself.

Next week, we'll be providing a written summary of the important factual findings and some of the specific contradictions that have led us to the conclusion that no attack occurred.

In this case, with the weight of the state behind him, the Durham district attorney pushed forward unchecked. There were many points in the case where caution would have served justice better than bravado. And in the rush to condemn, a community and a state lost the ability to see clearly. Regardless of the reasons this case was pushed forward, the result was wrong. Today, we need to learn from this and keep it from happening again to anybody.

Now, we have good district attorneys in North Carolina who are both tough and fair. And we need these forceful, independent prosecutors to put criminals away and protect the public. But we also need checks and balances to protect the innocent. This case shows the enormous consequences of overreaching by a prosecutor. What has been learned here is that the internal checks on a criminal charge — sworn statements, reasonable grounds, proper suspect photo lineups, accurate and fair discovery — all are critically important.

Therefore, I propose a law that the North Carolina Supreme Court have the authority to remove a case from a prosecutor in limited circumstances. This would give the courts a new tool to deal with a prosecutor who needs to step away from a case where justice demands.

I want to thank everyone in the North Carolina Department of Justice. I want to thank our investigators, our SBI agents and especially attorneys Jim Coman and Mary Winstead for their hard work in this matter.

DURHAM, N.C. — The local prosecutor who charged three Duke lacrosse players with raping a stripper apologized Thursday, acknowledging the decision of state prosecutors to dismiss all charges against them was correct.

"To the extent that I made judgments that ultimately proved to be incorrect, I apologize to the three students that were wrongly accused," Durham County District Attorney Mike Nifong said in a statement.

If you have time, you need to read this report to fully understand the extent to which these boys were railroaded by Nifong and his people. Truly frightning that even in this age of DNA, three innocent people (including an entire Lacrosse team who lost out on a season) could be placed on trumped up charges based soley upon the vocal "outrage" of the black community. If the accused had been three black males and the victim a black female nothing would have been said or done by the Jesse Sharptons, nor would they have been charged. The evidence was flimsy at best, fabricated at worst.
