Gotta a question for you guys!!! (Kinda legal)
OK!! As most of you know I am no longer in LPN classes due to flunking one to many tests. Well I have a question fir you. I was handed a letter the other day when I went to pick up my transcripts. It stated I owed the school $2,366 and had to pay it immediately. Well anyway, they say I owe them that because they had to send back my stafford loan. They are charging me for being there for the whole course, which this session started in August and ends in March, Which I will not be there anymore, so my question is,.........Is this legal for them to do this?? I know in my handbook it says "withdrawals" are not entitled to a refund, but I did not withdraw, I was made to leave. Also I was made to leave because they allow you to fail 4 tests in Pharmacology, I failed 5. your average has to be an 80%, mine was 81.091%. Also when I asked for help, knowing I needed it, I was told that was not something they had to do, I asked a few teachers if they could tutor me and I would pay them a tutoring fee if I had to, I was told that was unetical, I don't understand that because at the University I got accepted at they have an actual program that the teachers come in to help you if you are having trouble in a class. How is that unetical? Anyway, I am not sure what I should do, but even the PHEAA people said they would not pay for something I did not get either. You opinions please!!!

Re: Gotta a question for you guys!!! (Kinda legal)
I go to college also and I know at my school it is completely legal. You flunk out or drop below full time you lose your financial aid and you get NO money back. However, I would take this to the Dean and let them know that you needed help and you never received it. That is an issue on the professors end. I know at the two colleges ive been too, professors were REQUIRED to have meeting times where you could meet with them in their office and get help or discuss issues. So what they did is technically legal and there is nothing you can do as student loans are THE most protected loans out there, but I would take action with your administration and see if they can help you out!

That is just the thing I did not lose my financial aid. They (the tech school) is was attending had to send it back to the lender so my university can claim it once I do the finacial aid app there. They are not billing me for my student loans it was required they sent them back , what they are billing me for is the money from my account that, they had to send back even though that money was supposed to last till March.

Re: Gotta a question for you guys!!! (Kinda legal)
Usually you have a limited amount of time to leave the university (either voluntarily or involuntarily) or you owe for the entire course. Basically they see it as you are still taking up a slot b/c someone else who would have completed the course could be there & if you didn't pay they would lose money.
It is not the policy of all schools to mandate help... Its a courtesy & something you should look into before going to school there.
IMO getting a lawyer will do nothing more than add lawyer fees to the money you have to pay & you'll end up paying the balance due later.

Re: Gotta a question for you guys!!! (Kinda legal)
Did you sign a contract, even if you thought it was an application, at the tech school?
I am sure it lays out all the what ifs and everything.
If they have laid out the what if on a tuition, then you are most likely responsible. Even if you did not read that part prior to signing things.
Every school has its own rules, and regulations on tuition.
Adding: a withdrawal may be done by student, professor, or administration. It may be voluntary or involuntary.

Thanks for all your thoughts. I still think I will seek legal advice on this one though.

I just have to say that I went to Kansas State Univeristy for 1 year and during that 1 year, I had made several appointments to see my advisor and not once was he there! When it was time to chose classes for my second semester, I made the appt for him to help me chose my classes as we were told to do by our teachers to do and he wasnt there. I finally got help from the Dean of the Criminology Dept (his boss man) Needless to say, I never recieved help from my "advisor." Then again, after that year I got kicked out for bad grades. lol Sorry, to busy bein sick (pregnant). LOL

Re: Gotta a question for you guys!!! (Kinda legal)
yes, you have to pay it back. it was a loan, so it would have to be repaid anyway. just because you don't finish the course doesn't mean you don't have to pay. i'm sorry you're being hit with the bill like that, good luck.

OK
I guess I was not clear on my question....
I know I need to pay back any money I borrowed from my stafford, not a problem , that is my obligation, I know this, MY question is
Should I have to pay the School I was going to the tuition for Aug to March when I was ony there from August - December??

I'm a little confused.
You have to pay back your student loan plus pay the college (for what the loan paid them for?)
IF you took out a student loan to fully cover the tuition then as far as I know..you don't owe the college anything. (as I read you said you didnt' lose your loan)
anyone else reading this the way I am?
Or am I off base.
