    Angry legal question about unreturned borrowed items

    i had a friend borrow 6 cds from me, as well as a tshirt 3 months ago. she was supposed to being them back 3 days after she borrowed them, but i haven't seen them since. she is now saying she only borrowed 5 cds. there is always a reason she can't bring them to me, and when i try to get directions to get to her, she skirts around the issue. i haven't heard from her in about a month. my question is, is there anything i can do about this, such as a police report or something? she has about $120 worth of stuff, more after taxes. since i let her borrow them, i'm not sure if i can do anything... please help me out here, any advice will help.

    My best advice is call a lawyer and ask them. They would know more about it. Good luck.

    And you call this person a friend...Sorry but you don't even know how to find where she lives. I learned years ago not to loan anything to friends or acquaintances. I lost many valuable books to so called "friends". Friends would return things. I don't think you could ever do anything but I would still call the police and find out what recourse you have. Maybe she has done this to other people and if they all call the police, then maybe they could do something. Good luck. (hope I didn't offend you)

    Maybe you could bluff her and tell her that your attorney will be in contact with her and that the attorney says she will have to pay all attorney fees and court costs. I don't know but I think I would seriously rethink allowing anyone to borrow your stuff, we did that with movies and never got them back, then we had people that we had known for a long time come visit but that ended our friendship because they stole items from us, and then told us their little 3 year old put the stuff in their bags and they didn't know, but the stuff that came up missing were way to high on shelves for their 3 year old to reach. Some people just don't have respect for others belongings.
    Seems to me I have become not only a ford fanatic but a bbs fanatic too, your all contagious!!

    I'm not a complete idiot, some parts are missing!

    nanajoanie, you didn't offend me at all. i've been thinking the same thing. as soon as, if i ever, get my stuff back from her, i won't be talking to her anymore. i have done nothing but help her out the past few months we've been talking (we had been out of touch for a while). i have gone to get her mail for her since she is staying out of town, before she moved i would go to her house and help her with her baby, things like that. i usually don't lend my things to anyone, but she took them and pretty much walked out with them. i kept telling her to put my stuff down, and at one point she had set them on the table, but picked them back up and stuffed them in her bag when i wasn't looking, and when i called her later asking where the hell my stuff went, she says 'ah, i just snuck them out, but don't worry they'll be back by tuesday.' i've told her not all of the stuff belongs to me, alothough it does, and i've told her through email that i need it back before i get in trouble over it. this was yesterday, i am giving her time to get back from work etc. if that doesn't work i'm gonna tell her i've filed against her and see what happens then. she is already in trouble from driving drunk and unisured, i don't think she wants more court problems. this is deffinitely a lesson learned the hard way.

    What is it about people who can't return things any how? I learned LONG LONG ago not to ever loan anything out.. wish my mom would learn! She loaned some of my books out over six months ago and hasn't gotten them back yet!

    Good luck dear. It's time to get tough. I agree with AngelGrim and bluff that your attorney "SAID" even if you don't have one. I did this once with a car my son bought. They assumed because he was a teenage boy that he messsed up the motor mounts. I told them my lawyer said they had to fix my car NOW or give me a replacement. They fixed it and had it ready the next day after a month in the dealers garage. We got a lemon. It was a Pontiac Fiero - the split engine car that they don't even make anymore because of motor mount problems. I believe in the 'bluff routine' since it's cheaper than the lawyers

    maybe a very slow reader borrowed your books!! Sorry couldn't resist. No advice here. I could count on one hand the people I would loan something too. I have very dear friends that I know would return the items, but I also know they would be returned in poor condition.

    Do you have her phone number? www.switchboard.com has reverse lookup.

    Since it's not exactly stealing, it's probably a civil matter and the police aren't likely to get involved, so small claims court is probably your best bet.
