Shots fired, large fights terrorize Kansas City Zoo goers

KANSAS CITY, MO (KCTV) - As police continue on Wednesday to investigate Tuesday's violence at the Kansas City Zoo, city leaders are looking at changes to the zoo's free admission days for residents of Jackson and Clay counties.

Kansas City Zoo goers described Tuesday afternoon running for their lives after hundreds of teens were involved in fights inside the zoo and shots were fired in a zoo parking lot. "It was very scary," Liberty resident Jaimi Heckadon said. "All hell broke loose."

As she and her group bolted for the exit, Heckadon said she heard people screaming about officers using pepper spray. "The problem was these teenagers. None of them were escorted by an adult," she said.

Extra security was already on hand, but dozens of Kansas City police officers responded to the zoo after the issues erupted about 3:30 p.m. The zoo closed at 4 p.m. as scheduled.

No serious injuries were reported because of the issues. Authorities said Tuesday that 10 arrests were made and gun was found on top of a fire pit in Swope Park, which surrounds the zoo.

On Wednesday, police said "numerous arrests were made for fighting in public and assault."

Marc Hoefer said Tuesday that the zoo and police response "was outstanding." But he like many other zoo goers said Tuesday that they would not return for a free zoo day.

Zoo and park officials said they will immediately look at what changes need to be made in response to Tuesday's problems.

Mayor Sly James emphatically said Wednesday that "we had young people who were misbehaving badly." However, he does not believe violence at the Country Club Plaza involving large groups of youth and Tuesday's events at the Kansas City Zoo are connected. "It's not my job to take separate incidents that happen in one part of town and one that happened in another part of town and try to create something. Those are separate incidents. They weren't the same people involved. It wasn't the same place or the same time or circumstances," he said.

However, some of innocent patrons caught up in the violence say they believe the Plaza violence and Tuesday's violence at the zoo are connected and the city must do more to ensure families can be safe when going to Kansas City's top attractions.

Residents of Jackson and Clay counties could get into free to the zoo on Tuesday because of voter support for a zoo tax. The day coincided with mild weather and spring break for many area districts. One zoo goer told KCTV5 that he saw 20 police cars. He said he was at the zoo with his toddler and felt unsafe. He said he saw multiple fights involving individuals and large groups break out inside the zoo and in the parking lots.

Heckadon, who is a season ticket holder, said she had gone to the zoo with her 9-year-old son, a friend and her friend's 10-year-old son. They were in the Africa section about 3:30 p.m. headed toward the tram when they saw four teen girls get into an argument. "They were screaming. They were yelling. One threw a punch," she recalled. "Their boyfriends came around and ended up in it. Then there was about 20 kids."

She said the closest worker sprinted to the area and yelled into her walkie talkie for help. "That's when all hell broke loose," Heckadon said. "A stampede of teens came storming toward us. We had to shield the boys with our own bodies. It was that tense. Hundreds of teens were flying down there."

As they were fleeing, they saw three Kansas City Police Department officers rushing to the melee. She had parked on the grass near Starlight Theatre. She said as they were heading to their vehicle that they heard shots ring out. They got to the vehicle as quickly as they could and got ready to leave. "My 9-year-old said, 'We were just in a riot.' And my friend and I were still speechless at that point," Heckadon said.

She said she immediately thought of the issues at the Country Club Plaza where large groups of unsupervised teens and young adults have been involved in fights and shootings. "There were hundreds of teens and they were coming in groups with no adult presence. It's exactly like the Plaza," Heckadon said. "They have no adult presence and it's a free-for-all. The zoo is a place for families and small children."

Jimmie Todd was leaving the zoo amidst the gunfire and screaming. "Everybody got scared when they started firing shots," he said. "A bunch of fights and a lot of arguing and the cops tackling the kids. They tackled them on the ground. They sprayed mace."

Marc Hoefer was at the zoo with his wife and 11- and 8-year-old children. An 11-year-old friend joined them. "It was crowded. It was a different crowd. There was not a lot of courtesy. It was very packed and very tense," he said. "There was a strong police presence. There were a lot of pockets of youth. You could see there was a lot of tension. I didn't expect to walk about and see what I saw but I wasn't surprised."

As he was leaving, zoo employees directed him and his group to use a different exit. As he was moving toward his car in the parking lot, he could see a large group of youth gathering and bickering occurring. That's when he heard the shots fired from about 100 yards away. "There was a lot of chaos. The zoo response and police response was outstanding," he said.

Another attendee told KCTV5 she was there with her husband, daughter and two grandchildren. As they were leaving the zoo for the day, they saw a number of police officers in the parking lot and people on the ground in handcuffs. The woman said as they continued on to their car, they saw a large group of people on a hill above the parking lot. They then heard four to five shots fired and saw smoke from a gun. The witness said they got into their car as quickly as they could, got the children down and drove off, terrified. "I was scared. I thought I was gonna get shot or somebody was going to hit me. I don't know if they'll ever have a free day again," Diamond McEwe said.

Issues with a previous free admission day on a Sunday in April 2013 had prompted changes, including moving from weekends. The changes had seemed to prevent subsequent issues in 2013. Zoo Director Randy Wisthoff officials said Tuesday that they were not expecting such large crowds on Tuesday. KCTV5's Nikita cam earlier Tuesday showed crowds packing the glasses overlooking Polar Bear Passage where Nikita and Berlin play and swim.

Wisthoff said more than 19,000 showed up, which was more than the 15,000 zoo officials had prepared for over the course of the day. "What really compounded it was it started out kind of cool and windy. We only had about 6,000 in," Wisthoff said. "But at about 3, 3:30, that number jumped to 19,905 and we're just putting 4,000 an hour into the zoo, which is just way more than what we can handle."

Nearly 30,000 showed up when issues arose in April 2013. According to a Kansas City police report, a large number of teens arrived between 2 and 3:30 p.m., and began to cause problems. "At that time, at least 500 to 600 teams and adults were observed standing outside the main gate to the zoo. Officers were contacted and attempted to start moving people from the front gates," the police report says. "At that time, it was decided to immediately close the zoo for the day instead of at 4 p.m. A short time later, numerous fights began to break out at the entrance to the zoo and front parking lot."

The last patrons left the zoo about 5 p.m. Wisthoff said the issues had primarily been pushing and shoving when thousands showed up in a short period of time, and zoo workers asked for extra officers, who were moving many to the parking lot when the shots were fired. "It ended up we had a lot of people concentrated toward the front," he said. "They moved some of the disturbances out to the parking lot and told the kids to leave."

The last free zoo day had been Dec. 30. There are four free zoo days per year. The next free zoo days in 2014 are scheduled for June 24, July 15 and Aug. 5. Wisthoff said he doesn't want to eliminate free days or only have them in the dead of winter. "There are some zoos in the country that may have all their free days in January or February," he said. "We try to really reach the needs of the voters to have free days when school was out so we could get people here to see what they put their money into. That was part of the reason why people voted for it."

He said the zoo must "make sure we have our free days and to figure out what we can do to make them safer." He said attendance should not exceed 15,000. He said one option is requiring an adult to come with a teen, adding that all options will be considered. "It just got a little bit out of control and young kids were pushing and shoving," Wisthoff said. "It's hormones. It's spring. We'll have to figure out how to fix the problem."

Some officials would like to see vouchers issued so residents can come to the zoo at their convenience during the course of a year rather than having large crowds amass on certain designated days. He said there were numerous children who were at the zoo on Tuesday who had never been to a zoo before. "There were a lot of kids here today who had never been to the zoo before, and that's what really makes you feel good," he said. "I had little kids tells me they'd seen the penguins for the first time and were blown away by the exhibit. So we have got to make sure we protect that and the people who come to the zoo who helped pay for it."

A spokeswoman for James said Tuesday that the mayor will work with zoo and park officials and City Manager Troy Schulte "to ensure the free day benefit remains something our residents can feel safe enjoying."

But some of those who were there on Tuesday said they won't return for a free zoo day. "I feel safe going back to the zoo but not on a free day," Hoefer said.

The zoo posted this information on their Facebook page:

"Today the KC Zoo hosted well over 19,000 guests at the first of four Zoological District Free Days in 2014. It was amazing to see all of the families enjoying the zoo on this beautiful spring day. Unfortunately, a handful of unruly guests marred the day when pushing and shoving created disruptions inside the zoo. A majority of the events covered by the media took place outside of the zoo, particularly the shot which was fired west of Starlight. KCPD has commented that no injuries occurred and at least 10 were arrested in separate incidents.

"Our goal is to ensure that every guest enjoys a family-friendly atmosphere, even on free days. We will again revisit our free day process with all vested parties. While we wish these unfortunate events had not happened, we will work internally and externally to accommodate free days as they continue.

"We welcome your feedback and hope to see you soon at the Kansas City Zoo."

Temple University student assaulted with a brick: Funny how race isn’t mentioned

I’m going to continue to track this story to see if it ever comes to any resolution – or if any more facts emerge.

NBC Philadelphia reports that two Temple University students out walking to get something to eat were verbally and then physically assaulted by a gang of teenagers ranging in age from 8-14 years.

A 19-year-old Temple University student suffered serious facial injuries after an attacker hit her with a brick only a block from campus Friday. The student was walking with her 20-year-old boyfriend, who also attends Temple when a group of about 10 teens and young children began taunting them, according to sources. http://www.nbcphiladelphia.com/news/...251734641.html

According to the boyfriend, who asked to not be shown on TV, “A couple of them started to grab at her earrings and her hair,” he said. “My instinct was to stop them from hurting us and leave and get away.” He says he asked the group to back off, but his request went unheard as a female member of the group took a brick and smashed his 19-year-old girlfriend in the face. “Her teeth were out of place,” he said. “It was terrible, it was terrifying.” “What scared me most,” he said, “was that there were a lot more of them than us. So even though they were small kids, if they all had bricks, I might not be here talking to you right now.” The female victim was rushed to Hahnemann University Hospital, where she underwent emergency surgery to save and align her teeth.

Now I’m not familiar with Philadelphia and certainly not the neighborhood surrounding Temple University. However, one thing is certainly missing from this report — a description of the attackers — y’all know exactly what I mean. And there is no way you can’t tell me that simple fact isn’t known.

Thank God the story for these Temple University students didn’t end like the extremely disturbing story of Christopher Newsom, 23, and Channon Christian, 21, in Knoxville, Tennessee. Their horrific killing occurred in January 2007 and to this day I believe most people have never heard of this horrendous assault.

Newsom, 23, was a standout baseball player who was working as a carpenter. Christian was a 21-year-old student at the University of Tennessee. The happy couple had been dating for a couple months. After having dinner, the plan was to visit friends to watch a movie, but the couple never made it. When they arrived at the apartment complex where Christian’s best friends lived, they were carjacked by multiple assailants — all black — four men and one female.

It wasn’t just the crime committed by the assailants, but the crime by the media in not covering the story. This warped idea of social justice has to end — just as we reported about Chris Lane in Oklahoma, Delbert Belton in Spokane Wash, 13-month old Antonio Santiago in Brunswick Ga — and others.

We are watching what happens in Philadelphia.

Guess what? A surveillance video reveals a bit more about the girls who attacked the Temple University student with a brick.
Will it matter to the media now?

As we mentioned yesterday, we’d keep an eye on the Temple University student assault and guess what, there’s new information to report. A surveillance video caught the suspects on camera, and now their race is revealed.

According to Philly.com “Police are looking for the group of teenage girls who hit a Temple University student in the face with a brick, and are warning students to be on alert near the school’s North Philadelphia campus.

All four suspects are described as black girls who were about 16 or 17 years old. Police said one had braids and a red t-shirt; another had straight hair, tattoos on her arms and chest, and a denim jacket; a third was about 5 feet tall and wore her hair in a bun; and the fourth was tall, had straight hair and was wearing white clothing.

It appears to be a trend.

In a message sent to students and staff Monday night, the university said its campus safety department was aware of “multiple off-campus assaults on Temple students” in the area of North 17th Street just west of the campus.”

A 20-year-old student told NBC Philadelphia that she was also attacked by a group of girls on Friday night. And Temple said a pair of juvenile girls tried to snatch a student’s purse on Monday evening. “We are asking everyone to remain alert and report any suspicious activities to Temple Police immediately,” the university’s message said.

Heartfelt sympathies go out to the victim and her family and we pray that the suspects will be apprehended and brought to justice. I’m a dad who has a daughter attending college. We parents send our children off to further their education, not to become targets for barbaric behavior.

15-yr-old arrested for Philly brick attack; race of victims not mentioned. Why?

New update in the Temple University student assault case: NBC Philadelphia reports, “Philadelphia Police said a 15-yr-old girl has been arrested Tuesday and is expected to be charged with aggravated assault for allegedly hitting a 19-year-old Temple University student in the face with the brick, nearly knocking her teeth out. Four other teens, a 17-year-old, two 15-year-olds and a 14-year-old, have also been taken into custody related to the assault. Detectives say these teens may also be arrested soon.

The arrest came four days after the unprovoked brick attack. The 19-year-old woman, was walking with her 20-year-old boyfriend around 6 p.m. on Friday evening when she says a group of girls and boys began taunting and touching them. When they pushed back, the girls allegedly started swinging. “My boyfriend pushed the girl away from me that hit me in the face and then the girl’s sister came at me with a brick,” said the victim, who asked that her identity not be shared.

What a shame this young lady withholds her identity as the victim, undoubtedly due to fear. We’ve come to a point in America where victims continue to live in fear for retribution attacks. Her boyfriend was interviewed, but he asked that his face not be shown on camera.

Some may ask why we’re following this case? The point is simple: trend analysis. Police say there were two other attacks that took place within minutes of the brick attack. But isn’t it interesting the media won’t report the race of victims? Again I have to ask, why? If this were black-on-black violence, does no one care? But because the victims were white, it doesn’t fit the narrative of the Left. We never stopped hearing about the “white Hispanic” George Zimmerman.

Another Temple student, a 20-year-old junior, said she was walking down her street when she was punched by a several girls, just 15 minutes before the brick attack. Capt. Frank Banford, commanding officer of Philadelphia Police’s Central Detective Division, said “the girls are also responsible for a third attack in which they allegedly assaulted another woman who is a Temple University student.

How does the academic mind work? Temple spokesman Ray Betznger said the university has no immediate plans to review its notification procedures. He says that could come at the end of the semester when officials typically review all university procedures.

Hate to say it, but Temple University may just need to get ready for the deluge of lawsuits that I am quite sure are coming. And they had best not wait until the end of the semester.

Two Teens Arrested After New Details Emerge About Horrifying Mob Attack on Man Who Stopped to Help Boy He Hit With Car

Detroit police have arrested two teenagers in connection with the brutal attack on a man that stopped to render aid to a small child after hitting him with his vehicle Wednesday.

The teens, ages 16 and 17, were arrested early Saturday morning, Detroit police spokesman Sgt. Michael Woody said, according to the Detroit Free Press. They are preparing warrant request for charges.

The teens were part of a larger mob that beat Steve Utash, 54, after his truck hit David Harris, 10. When Utash stepped out of his vehicle to help the child, he was savagely beaten. Police say the 54-year-old, who is now in a coma after suffering multiple head injuries, was not at fault for the accident. Instead, they say the boy stepped out in front of the pickup as it was headed down the road.

Woody called on the 10-12 others believed to have participated in the attack to surrender to authorities.

“To drag this out any further is really futile,” Woody said, according to the Free Press. “We’re getting closer and closer. We need to put this thing to rest for the sake of the family and citizens.”

Utash’s son, Joseph, thinks his father was intentionally targeted, but was torn on whether the attack could be classified as a “hate crime.” Utash is white and witnesses have reportedly described his attackers as black.

“I’ve talked to one Detroit police officer and I think that, personally in my own heart, I think it was all a setup from the gate,” he told WWJ-TV, ”meaning that my dad’s been driving up and down Morang for 15, 16 years working for the same company and they know he has a job, they know he has money and they robbed him. You know, he had a bag with all his stuff in it. He showed me that he had all this money in his wallet that morning, telling me he just took the money out of the bank so he could pay his dentist.”

“As far as a hate crime, it might be,” he added. “You know, it’s like you go in Detroit and you’re white, you don’t belong. Seriously. I’ve been pulled over by police before and they’re like ‘Get back across 8 Mile,’ like I’m not supposed to be over there, like I’m not allowed to go in Detroit.”

The 54-year-old remains in a coma. His family says he was so severely beaten, he was nearly nearly unrecognizable.

“If it went on any longer, my dad wouldn’t be in the hospital right now, he would be in the morgue. The way he looked, I am surprised that he is alive,” Joseph told WWJ-TV. “He has bruising over his face, his eyes are swollen, I believe it’s his left eye that is completely swollen shut. He also has a big, huge knot on his forehead like he got hit with an object, not a fist.”

A nurse that stopped the beating and helped Utash recalled the moments of the attack.

“He was already down, bleeding from the mouth and the nose – so there wasn’t nothing else they could do to him but kill him,” Debra Hughes told WWJ-TV.

“Then EMS came and I kept him calm, I kept his hands down and everything so he could be comfortable,” she continued. “He had the biggest gash on his head I ever seen – he was bleeding from the mouth and he was unconscious when I first got there … being a registered nurse, I thought I could go out and help him.”

If he wakes up from his coma, he will have a long journey ahead to recovery, Utash’s family says.

“It will be months just for him to have therapy,” daughter Mandi Emerick told the Free Press. “We know the damage is in the frontal lobe. The doctors said he can either wake up and be fine or might need people to dress him. We’re glad he’s stable, but not knowing is still pretty nerve-racking.”

At the time of publication, over $86,000 had been raised online to help fund Utash’s treatment.

The young boy hit by Utash’s vehicle is expected to recover, according to his uncle, WWJ-TV reported.

Police Make Heartbreaking Discovery Next To White Man Gunned Down By Black Teens

Philadelphia man out for a walk last week was gunned down by three Black teens in cold blood. And when police found the man’s body, they made a heartbreaking find right next to it.



According to NBC Philadelphia, the three black teens got “bored” playing basketball and decided to go rob someone. After seeing one man with a large dog, and deciding not to rob him, they then saw 51-year-old James Patrick Stuhlman walking his terrier. http://www.nbcphiladelphia.com/news/...296849631.html


Stuhlman typically walked his dog with his 13-year-old daughter. But on the night of his murder, March 12, he had told her to stay home because it was getting dark out, which very likely saved her life.

As he walked down the street, Stuhlman, who owned a local landscaping company, saw three teens approach him. Then they grabbed and robbed him, and shot him once in the leg. “At one point, he did plead for his life,” Captain James Clark said Thursday at a news conference, according to the New York Daily News. “He said, ‘Please don’t shoot me, please don’t shoot me,’ and they still shot him one more time.”

That second shot took his life.

So “Hands Up, Don’t Shoot” really did happen — not in Ferguson — but in a Black-on-White capital murder in Philadelphia.

So can we expect Barack Obama and Eric Holder to demand a civil right investigation? Don’t bet on it.

On Thursday, 15-year-old Brandon Smith and a 14-year-old whose name has been withheld — because he is supposedly a “child” — were arrested by police. They said they decided to rob Stuhlman because his dog was smaller than their intended first target. The shooter, identified as Tyfine Hamilton, 15, is still at large. Philadelphia police consider him “armed and dangerous.”

Typically, the teens have all been in trouble with the law in the past.


Capt. Clark warned Hamilton at a press conference: “Get with your parent and turn yourself in before we come and get you…We know where you are.”

Philadelphia Police Lt. John Walker said that when police arrived at the scene Stuhlman was laying in a pool of blood and was already unresponsive. The family man still had his flashlight in his hand.

But what police found next to him was heartbreaking. His dog was pawing him, sniffing at his face, and whimpering.

“The dog was lying next to him — appeared to be scared and in shock,” Walker said.

“His daughter goes for a walk with him almost every night,” added Clark. “For whatever reason, he said to her, ‘it’s a little late tonight I don’t want you walking with me.’ So in effect, he may have saved his daughter’s life.”

Smith has been charged in relation to the murder and is still in custody. But the unnamed teen was inexplicably just charged with robbery despite being an accessory to murder. Police are offering a $20,000 reward for information leading to the arrest of Hamilton.

OKLAHOMA CITY (AP) An Australian man attending an Oklahoma college on a baseball scholarship was shot and killed in what police described Monday as a random act of violence by three ''bored'' teenagers who decided to kill someone for the fun of it.

Christopher Lane, 22, of Melbourne, was found dead Friday while visiting the town of Duncan, where his girlfriend lives. Three boys, ages 15, 16, and 17, are in custody and face a court appearance Tuesday afternoon.

Duncan Police Chief Danny Ford said Monday a woman called 911 after she saw Lane stagger across the road and fall to the ground in the south-central Oklahoma town of about 24,000 residents. Ford said Lane, who was staying with his girlfriend and her family in Duncan, had jogged past a home where the three boys were staying. He said the shooting appeared to be completely random.

Autopsy results are pending. Ford wouldn't say how many times Lane was shot.

Ford said the 17-year-old has given a detailed confession to police, but that investigators have not been able to locate the murder weapon. ''They saw Christopher go by, and one of them said: `There's our target,''' Ford said. ''The boy who has talked to us said: `We were bored and didn't have anything to do, so we decided to kill somebody.'

''They followed him in the car to that area, shot him in the back and drove off,'' Ford said.

He said the district attorney is expected to file first-degree murder charges Tuesday, and all three will be arraigned at Stephens County District Court. It wasn't known if the three will be charged as adults or as juveniles.

Sarah Harper, Lane's girlfriend, told the Australian Broadcasting Corp. that the two had only returned to the United States from Australia last week. ''He didn't deserve any of this,'' Harper told the network. ''It's heartbreaking that it was such a random choice those guys made that drastically altered so many lives in the process.''

Lane attended East Central University in Ada, about 85 miles west of Duncan. He started 14 games at catcher last year and was entering his senior year. ''He was an absolute joy to coach,'' baseball coach Dino Rosato said in a statement issued by the school. ''Chris was an extremely well-respected teammate. ... He set a great example for all of his teammates, but more importantly for the younger players. He was a mature student-athlete who his teammates could look to for advice and support.

Ford told Oklahoma City television station KOCO that one of the teenagers said they shot Lane for ''the fun of it.''

The chief told the Duncan Banner that police detained the three boys near a car and had retrieved a dismantled shotgun from the vehicle, but that Lane had been shot with another gun that had not yet been found. He said police have had ''problems'' with two of the three juveniles previously. He did not elaborate.

Peter Lane, the boy's father, told Australian broadcasters there was no explanation for his son's death. ''It is heartless and to try to understand it is a short way to insanity,'' he said.

'Bored Teen' Chancey Luna Sentenced to Life Term for Australian Student Murder

An Oklahoma teenager convicted of murdering a college baseball player in 2013 was sentenced Tuesday to life in prison without parole.

Chancey Luna, 18, was found guilty in April of first-degree murder in the shooting death of Christopher Lane, a 22-year-old Australian on a baseball scholarship at East Central University.

Luna and two other friends were accused of shooting Lane in the back while he jogged — later telling investigators that they did it because they were bored, Duncan police said.

One of the co-defendants struck a deal to testify against Luna, while the third teen, Michael Jones, was sentenced to life in prison in March.

Luna was tried as an adult in the case, although his defense team argued he should have been in juvenile court because he was 16 at the time. They also claimed the teens wanted to scare Lane, not kill him.

The federal post-conviction relief stage can take years, noted New Orleans lawyer Nick Trenticosta, who is handling the federal post-conviction appeal of condemned killer Kevan Brumfield in the 1993 ambush slaying of Baton Rouge police Cpl. Betty Smothers.

Brumfield was convicted and sentenced to death in 1995, and his federal post-conviction relief petition is only now before the U.S. Supreme Court, Trenticosta pointed out. He noted that he was appointed for the federal post-conviction work in Brumfield’s case a week before Hurricane Katrina hit in 2005.

Cpl. Betty Smothers' murderer wins U.S. Supreme Court decision, chance to get off death row



A Louisiana death row inmate has won a chance to avoid execution after the U.S. Supreme Court issued a 5-4 ruling Thursday (June 18), concluding he might be mentally disabled.

Kevan Brumfield was convicted in the 1993 shooting death of Baton Rouge Police Department officer Cpl. Betty Smothers. The mother of six children, including Louisiana Sports Hall of Fame football player Warrick Dunn, Smothers was driving a grocery store manager to make a bank deposit when Brumfield gunned her down.

After Brumfield was sentenced to death, The Supreme Court in 2002 ruled in Atkins v. Virginia that it is unconstitutional to execute persons the court considers to be legally "mentally retarded." A federal judge then ruled that Brumfield was mentally disabled and thus protected from execution. But the 5th U.S. Circuit Court of Appeals in New Orleans reversed the judge's ruling.

The majority opinion, written by Justice Sonia Sotomayor, notes Brumfield sought a competency hearing based on evidence that he had an IQ of 75, a fourth-grade reading level, had been prescribed "numerous medications" and was twice treated at psychiatric hospitals as a child, had been identified as having a learning disability and had been placed in special education classes.

A press release issued by Baton Rouge District Attorney Hillar Moore's office, however, said the majority opinion ruled on procedural matters and "largely ignored the facts and circumstances surrounding this case." The release points to the dissenting opinion's note that Brumfield has spent two decades "engaged in a ceaseless campaign" of appeals.

"This office will continue to actively pursue the death penalty," the release says.

From here, a three-judge panel from the Fifth Circuit U.S. Court of Appeals will review U.S. District Judge James Brady's ruling declaring Brumfield incompetent. If they side with Brady, Brumfield will move off of death row and serve out a life sentence with the general prison population, his attorney Nick Trenticosta said.

Trenticosta said the decision also sets a precedent that states must provide resources, like court-appointed council and psychological analysis, to help prisoners process post-conviction appeals. "If you're a judge and someone comes to you with meaningful evidence of a constitutional violation, you can't just blow it off," said Trenticosta. "So it's a great decision in that regard."

The story of Smothers' murder is well known in Baton Rouge. Dunn was an 18-year-old senior at Catholic High, where he was a standout player, when his mother was killed. He went on to play at Florida State and then for 12 years in the NFL with the Tampa Bay Buccaneers and Atlanta Falcons.

Convicted along with Brumfield in the Jan. 7, 1993, murder was Henri Broadway of Baton Rouge. The 36-year-old Smothers was working as an off-duty security officer at the time.

The real problem is he was convicted and sentenced to death in 1993 and 22 years later it's still in court.

This is not the only serious crime he committed. He had a long rap sheet. If I remember correctly he was involved as a juvenile with the torture death of a little boy Willie Strowder, in Baton Rouge. The little boy was tortured, and raped, then tied to a chair and drowned.

Man accused of shoving jogger, ethnic intimidation

A Pleasant Ridge man was arrested Wednesday afternoon, several weeks after police said he shoved a female jogger into oncoming traffic, brandished a knife and told her that "he hates white people," according to court documents.



Rodney Arnold, 34, of Pleasant Ridge, was arrested and charged with ethnic intimidation, aggravated menacing, assault and carrying concealed weapons.

On May 11, a woman was jogging in the 5900 block of Montgomery Road when a man shoved her into the street and caused her to fall in front of oncoming traffic, according to an affidavit in Hamilton County court records.

The woman said that the attacker pulled out a knife, pointed it at her and stated that "he hates white people," according to the affidavit.

The woman told police that she was able to flee the scene safely.

Arnold was found by police about an hour and a half later, when police received calls about a man in the same area with a knife, documents state. Police said Arnold admitted possession of the knife at the time they located him.

Arnold's bond was held at $90,000 in a court arraignment Thursday morning.
