    Federal Judge Orders Release of Information That Would Tie Obama to IRS Scandal

    For the second time this week, a federal judge has tossed a monkey wrench into the mechanism of the Obama caliphate machine. For two years, Cause of Action has been seeking information about the IRS transferring taxpayer information to the White House. Lois Lerner at the IRS was allegedly passing information to Obama adviser Jeanne Lambrew. Sharing confidential taxpayer information is a felony under section 6103 of the tax code.

    The ironic thing is the IRS refused to say whether it broke the law in violating section 6103 because answering the question would violate section 6103. The judge, Amy Berman Jackson, who ruled:

    “This court questions whether section 6103 should or would shield records that indicate confidential taxpayer information was misused, or that government officials made an improper attempt to access that information.”
    The information passed between the IRS and the White House could include the tax returns of the Koch brothers. In fact, several of the records transferred are suspected to be on Obama’s enemies list. The Obama administration was supposed to turn over 2,500 documents relating to the FOIA (Freedom of Information Act) were supposed to be turned over at the end of 2014, but never were. Instead the White House and IRS stonewalled just like they have in all of Obama’s scandals.

    Dan Epstein, executive director at Cause of Action responded to the decision by the judge:

    “As we have said all along, this administration cannot misinterpret the law in order to potentially hide evidence of wrongdoing. No administration is above the law, and we are pleased that the court has sided with us on this important point.”
    Here is the rule on taxpayer information:

    (a) General rule

    Returns and return information shall be confidential, and except as authorized by this title—

    (1) no officer or employee of the United States,

    (2) no officer or employee of any State, any local law enforcement agency receiving information under subsection (i)(7)(A), any local child support enforcement agency, or any local agency administering a program listed in subsection (l)(7)(D) who has or had access to returns or return information under this section or section 6104 (c), and

    (3) no other person (or officer or employee thereof) who has or had access to returns or return information under subsection (e)(1)(D)(iii),subsection (k)(10), paragraph (6), (10), (12), (16), (19), (20), or (21) of subsection (l), paragraph (2) or (4)(B) of subsection (m), orsubsection (n),

    shall disclose any return or return information obtained by him in any manner in connection with his service as such an officer or an employee or otherwise or under the provisions of this section. For purposes of this subsection, the term “officer or employee” includes a former officer or employee.


    The penalty for a federal employee disclosing taxpayer information illegally is a $5,000 fine, five years in prison or both. The party whose information has been disclosed can also bring a lawsuit in a federal District Court.

    Leading members of Congress are ripping IRS officials for erasing a computer hard drive after a federal judge ordered it to be preserved.

    “The destruction of evidence subject to preservation orders and subpoenas has been an ongoing problem under your leadership at the IRS,” Committee on House Oversight and Government Reform Chairman Jason Chaffetz and Rep. Jim Jordan, wrote in a letter to IRS Commissioner John Koskinen late Thursday.

    “It is stunning to see that the IRS does not take reasonable care to preserve documents that it is legally required to protect,” Chaffetz, a Utah Republican, and Jordan, an Ohio Republican, said in the letter to Koskinen.

    The IRS recently admitted in court to erasing the hard drive even though a federal judge had issued a preservation related to a Microsoft Freedom of Information Act lawsuit against the federal tax agency last year, according to court documents. Microsoft accuses the IRS of inappropriately hiring an outside law firm to audit it and of failing to hand over related documents requested under the FOIA.

    Chaffetz and other members of the oversight panel began calling for Koskinen’s impeachment in October. Chaffetz and Jordan in their letter point out that the IRS in March 2014 also destroyed 422 backup tapes containing as many as 24,000 emails sent or received by Lois Lerner, former director of IRS’ Exempt Organizations Division.

    huh? so the irs thinks they have to accept fraudulent claims? heck i know someone audited by the irs for giving what the irs thought was too much to their church and they had to provide all documents before they could get a refund!!!!!!!!!!!!!! so why do they hand over billions to those who they know or suspect to be fraudulent but question when a person they think gives to much to a christian org gets questioned?????
