Nacho Cheese Leads to Disney Suit

Nacho Cheese Leads to Disney Suit

The parents of a 4-year-old California boy are suing Walt Disney Parks and Resorts claiming hot nacho cheese scalded and scarred their son during a visit to Walt Disney World.

Isaiah Harris suffered "permanent scarring, pain and suffering" as a result of the burns, according to the suit, which seeks medical cost and punitive damages for emotional distress.

The boy's parent, Michael and Maria Harris of Chula Vista. Calif., are also seeking damages saying they suffered "serious emotional distress."

The family says the incident occured in March at Cosmic Ray's Starlite Cafe in Tomorrowland at Disney's Magic Kingdom theme park in Florida. They claim a paper cup with scalding cheese splashed on the child's face when he grabbed a food tray.

"The cheese should not have been that hot," says Sean Cahill, the family's attorney.

Disney released a statement saying that the company is reviewing the lawsuit but is saddened by the child's injuries. "It is unfortunate when any child is hurt."

This is the second suit against a Disney park this week. In the other case, a quadriplegic man claims that he was stuck in the "It's a Small World" ride for 40 minutes at Disneyland in California, and that there was no way to evacuate him in his wheelchair. He is suing for negligence and emotional distress.

Wouldn't you think the parent (s) would have felt the cheese through the container or see steam if it was scalding..or test it to see if it was too hot?

Since when is cheese runny enough to splash out of a container??

I always thought nacho cheese was thicker??

Hmm, I know that with nacho cheese the top creates like a barrier and the top will be cooler but underneath is super hot. Not sure how their lack of supervision with their son is Disney Worlds fault though.

So he grabbed a food tray......if there were a pointy knife on it, I guess the law suit would be for more.

Good thing he didn't grab that tray at McDonald's if there were coffee on it! Holy Smokes!! 4 year olds can't read the disclaimer

Glad to see the government (lawsuits) are punishing all these companies for not safeguarding children with unruly behavior and wussy parents. After all, someone has to look after these children. Thankfully now after this lawsuit, the parents will be able to hire that nanny.

Cahill said the accident occurred last March 17 during the family's first trip to Disney World. The attorney said 4-year-old Isaiah Harris sat down to dinner in an unsteady chair and grabbed a table so he wouldn't fall.

The boy's hand caught a food tray and a cup of nacho cheese flew onto his face, burning his upper lip and other spots, Cahill said, adding that his clients worry that their son's lip will be permanently scarred.

I'm no good at posting photos on here, but this is suppose to be a photo of the boy.

That does seem to be a bad burn. How long was this nacho sauce on his face for?

*thanks for the story with more of a description.

My question is, is that ALL from the burn, or from the fall? It looks more like cuts and bruises than it does burns. (at least to me anyhow).

If he was falling, why would the nacho cheese burns be centered right on his lips??

There's way more to this, than what we're hearing/reading.

Obvisouly this picture was not taken right away. The burn looks to be scabbed over previously and picked at (& not cared for). (a couple weeks after the incident?)

*I agree, more to this story.....

So the parents tried to wrangle money out of Disney and when they were unsuccessful they hired an attorney - big surprise. People like this need to stay at home with their unruly brat. I hope Disney doesn't give them a damn dime but knowing how expensive lawsuits are I bet they will try to settle. Hopefully they won't. Didn't say if the parents tried to get the kid medical attention at the park.
