In Case You Weren’t Aware, New Orleans Is A Sanctuary City…

…in which a Kate Steinle murder could happen any minute.

Not that anyone would notice, because after all in New Orleans murders aren’t even news at present. When you’re barely halfway through the year, and there are nevertheless 100 murders, what’s one more carcass on the side of the road?

And furthermore, having a bunch of violent criminals here illegally from foreign lands setting up house in Orleans Parish couldn’t possibly add to the threat posed by the locals, right?

So maybe it isn’t such a big deal that the political leadership of New Orleans opted two years ago to stop cooperating with the federal government by refusing to detain illegal criminals so ICE could come in and deport them.

At the time, Louisiana’s then-junior senator David Vitter blasted a furious letter to Orleans Parish sheriff Marlin Gusman with some of the most choice language you’ll hear from a political leader of that stature…

    August 22, 2013

    The Honorable Marlin N. Gusman
    Orleans Parish Sheriff
    819 South Broad Street
    New Orleans, LA 70119-7418

    Dear Sheriff Gusman:

Recently, you announced that you have reversed your previous policy and are now actively preventing federal Immigration and Customs Enforcement (ICE) personnel from enforcing federal immigration laws. This dangerous change in policy essentially makes New Orleans a “sanctuary city” and violates federal law.

I urge you to revert to your previous policy by cooperating with federal immigration enforcement officials as mandated by federal law. If you do not, I am very concerned that this will kill all efforts to procure any new, additional federal funds to help deal with your federal consent decree obligations or for any other New Orleans law enforcement purpose.

As stated, your new policy is a blatant violation of federal immigration law. In 1996, Congress passed a law that specifically prohibits state and local governments from enacting sanctuary policies. The Illegal Immigration Reform and Immigrant Responsibility Act § 642(a) states: “Notwithstanding any other provision of Federal, State, or local law, a Federal, State, or local government entity or official may not prohibit, or in any way restrict, any government entity or official from sending to, or receiving from, the Immigration and Naturalization Service information regarding the citizenship or immigration status, lawful or unlawful, of any individual.”

Despite this clear expression of congressional intent, some very liberal, anti-enforcement state and local governments continue to enact policies that actively frustrate enforcement of federal immigration laws. They have been rightly dubbed “sanctuary cities.” To address this problem, I introduced legislation that prevents sanctuary jurisdictions from receiving Community Oriented Policing Service Programs (COPS) grants from the federal government. Sadly, your new policy puts New Orleans at the top of the list of law-breaking sanctuary cities. As you know, this was stated and celebrated by several ultra-left, anti-enforcement organizations upon your announcement.

Equally concerning to me is the message that your recent announcement sends to the country and to illegal aliens. Orleans Parish has already received horrible nationwide press surrounding the out-of-control dysfunction of the Orleans Parish Prison. Instead of addressing needed reforms to the Orleans Parish Prison, you are telling the country that you will actively prevent federal enforcement of immigration law. What an embarrassment.

This public embrace of sanctuary policy also tells every illegal alien listening to break U.S. law, come on over, and come to New Orleans in particular. In some cases, this puts residents of Orleans Parish in harm’s way unnecessarily; we know of many instances in which an illegal alien is released by local authorities and then commits a fatal crime. This also further depresses wage rates in New Orleans in an already very sluggish economy. This particularly hurts those already struggling with relatively low wage rates.

For all of these reasons, I again urge you to comply with federal law and fully cooperate with federal immigration enforcement. If you do not, I am very concerned that this will kill all efforts to procure any new, additional federal funds to help deal with your federal consent decree obligations or for any other New Orleans law enforcement purpose.

    Sincerely,
    David Vitter
    U.S. Senate
New Orleans’ problems are far greater than whether it’s a sanctuary city, after all – the city is covered with potholes, its economy is slowing down due to an avalanche of stupid policy choices over the past two years, it’s in hock to its firefighters for staggering amounts of money, its law enforcement has ceased to function in any legitimate sense and its political class is busy playing ISIS with the historical monuments of insufficient political correctness amid all the carnage.

But since we’re looking at sanctuary cities across the country with outrage in the wake of the Kate Steinle murder and a spate of other violent events involving sanctuary cities and criminal illegals, let’s just remember that New Orleans has joined that lawbreaking club. Maybe that fact ought to be taken into consideration in next year’s legislative session, and the city defenestrated in the state budget until such time as it is brought in line with the law.

UPDATE: Meanwhile, today Vitter filed an amendment to wipe out all federal funding for sanctuary cities. Here he is on the floor of the Senate introducing the amendment…

‘GREAT point!’ Dana Loesch asks why bakeries need to follow laws but sanctuary cities don’t?

    July 10, 2015 | Nicole Haas

There’s a double standard in America when it comes to obeying the law.

Conservative firebrand Dana Loesch took to social media to ask a very good and timely question: Why do businesses have to “follow the law” but cities labeled “sanctuaries” do not?

LAWMAKERS PASS A LAW TO MAKE CALIFORNIA A SANCTUARY STATE!
    By Timothy Core|Monday, July 13, 2015

If you are wondering why so many from the California State Legislature have remained silent regarding the shooting in San Francisco that claimed the life of Kate Steinle; It is because they passed a law that allowed the string of events that caused the shooting.

On October 5th 2013 Governor Jerry Brown quietly signed AB-4 ,known as the TRUST ACT, into law.

AB-4 was introduced on December 3rd 2012 by CA Assemblyman Tom Ammiano and was co-authored by Assemblyman Alejo, Senator De León, and Assemblyman V. Manuel Pérez. AB-4 officially took effect on January 1st 2014.

AB-4 was passed under Suspension of the Rules, a parliamentary procedure in which a deliberative assembly sets aside its normal rules of order to do something that it could not do otherwise.

So what does this have to do with San Francisco being a Sanctuary City? The answer may shock you! The California State legislature, by passing AB-4, made a California State Law that said local jurisdictions did not have to cooperate with federal officials in instances regarding immigration.

The Law lists out 37 specific instances -some of which are vague at best-, at least 1 of which the illegal immigrant in question must have been CONVICTED of within the last 5 years, and if that criteria is not met here is what the bill says:
If none of the conditions listed in subdivision (a) is satisfied, an individual shall not be detained on the basis of an immigration hold after the individual becomes eligible for release from custody.
And for the record, Felonious Identity Theft is not listed, nor is any kind of Cyber Crime.

But it gets even worse. With the passage of PROP 47 in California in 2014, many felonies, that would have previously met the standard for notification to ICE, are now misdemeanors under the law, and as such do not meet the requirement for detainer or notification.

The members of the California State Legislature who voted to pass this law are:

ASSEMBLY: Alejo, Ammiano, Atkins, Bloom, Bocanegra, Bonilla, Bonta, Bradford, Brown, Buchanan, Ian Calderon, Campos, Chau, Chesbro, Dickinson, Eggman, Fong, Frazier, Garcia, Gatto, Gomez, Gonzalez, Gordon, Hall, Roger Hernández, Holden, Jones-Sawyer, Levine, Lowenthal, Medina, Mitchell, Mullin, Nazarian, Pan, Perea, V. Manuel Pérez, Quirk, Quirk-Silva, Rendon, Salas, Skinner, Stone, Ting, Weber, Wieckowski, Williams, Yamada, and John A. Pérez

SENATE: Beall, Block, Calderon, Corbett, Correa, De León, DeSaulnier, Evans, Galgiani, Hancock, Hernandez, Hill, Hueso, Jackson, Lara, Leno, Lieu, Liu, Monning, Padilla, Steinberg, Torres, Wolk, Wright, Yee

And of course we can’t leave out California Governor Edmund Gerald “Jerry” Brown Jr. who signed AB-4 into law.

Do it. And when the rest of the states decide that no federal money is going to places that declare themselves sanctuary for illegals, things will finally be right with the world. Maybe Mexico wants them back. See how they like them apples.

Revealed: 276 'sanctuary cities' let 8,145 illegal offenders free in just 8 months, 17,000 total
    By Paul Bedard • 7/13/15 8:04 AM

Some 276 "sanctuary cities," nearly 50 percent more than previously revealed, released over 8,000 illegal immigrants with criminal records or facing charges free despite federal requests that they be turned over to Immigration and Customs Enforcement for deportation, according to an explosive new report.

The Center for Immigration Studies, revealing new numbers it received under the Freedom of Information Act, said that those releases from cities that ignored federal demands came over just eight months and are just part of an even larger release of 17,000 illegals with criminal records.

Author Jessica M. Vaughan, director of policy Studies for the center, also reported that many of those illegals have been rearrested after their release and charged with nearly 7,500 new charges, including child sex abuse.

The report, titled "Ignoring Detainers, Endangering Communities State/local agencies release criminals rather than obey law," provided to Secrets, is expected to fuel U.S. anger over sanctuary cities and the murder by one freed illegal of a San Francisco woman earlier this month.

"The Obama administration has given sanctuaries free rein to ignore detainers by ending the successful Secure Communities program and replacing it with the Priority Enforcement Program. This new program explicitly allows local agencies to disregard ICE notifications of deportable aliens in their custody by replacing detainers with 'requests for notification,'" wrote Vaughan.

"The only truly effective and lasting solution is for Congress to spell out in federal law that local law enforcement agencies must cooperate with ICE by complying with all detainers or face sanctions in the form of disqualification from certain kinds of federal funding," she added.

The new federal documents show that there are at least 276 sanctuary cities, more than the 200 previously believed, and are in 43 states, also more than previously revealed. Instead of turning illegal immigrants facing criminal charges over to ICE under its "detainer" rule, the sanctuaries simply ignore the request in many cases let the illegals go.

ny of those released had more than one ICE "detainer" request.

The majority, 5,132, had past criminal records, like Juan Francisco Lopez-Sanchez, the illegal previously deported five times and now charged with murdering 32-year-old Kate Steinle. Of those, 2,984 had a prior felony conviction or charge.

And, 1,867 offenders who were released were re-arrested, accumulating 7,491 new charges, including child sex abuse. Vaughan's report found that 10 percent of the new charges involved dangerous drugs and seven percent were for driving under the influence of alcohol.

ICE Director: We Don’t Want To Hit Sanctuary Communities ‘Over the Head With a Federal Hammer’
    by Ian Hanchett21 Jul 2015

Immigration and Customs Enforcement Director Sarah Saldaña said that she doesn’t want to “hit somebody over the head with a federal hammer” with regard to sanctuary communities and refused to state what negative consequences she would support placing on sanctuary communities in testimony before the Senate Judiciary Committee on Tuesday.

After Senator Sen. David Vitter (R-LA) pressed Saldaña on the lack of consequences for sanctuary communities, and what would happen to them, she answered she is “in the middle of looking at that.”

Vitter again followed-up on what would be the negative consequences for sanctuary communities, and Saldaña re-iterated that she was looking into it.

Vitter continued, “This has been going on for years and you still are not prepared to say that there is ever going to be any negative consequence to those [sanctuary] jurisdictions. When is that going to change?”

Saldaña answered, “I presume when you all address comprehensive immigration reform, perhaps it can be addressed there.”

Later, Vitter pressed Saldaña on whether there was a way to “stop sanctuary cities from flaunting federal law” under the current law, without passing immigration reform that the Obama administration supported.

She answered, “And that’s what I understand you all are working on.”

Later in her testimony, Saldaña, when asked what negative consequences she would support, stated that she didn’t want to “hit somebody over the head with a federal hammer,” and advocated a “jurisdiction-by-jurisdiction” approach. However, she said she would be happy to work with the committee on whatever legislation it proposes.

The testimony concluded with Saldaña refusing to state what consequences she would support for sanctuary cities.

My mother, her family, my fathers family all emigrated from Poland. They had to wait for quotas, wait for transportation to the harbors, have a legal sponsor in the USA and assurance of a place to live and jobs. They were required to submit to a health evaluation upon arrival at Ellis Island before being allowed on US soil. It is called following the law.

    ..

Oh, but they'll let the "federal hammer" come down on law-abiding American citizens!

    ..

they can by immediately stopping all federal funds of any kind to those cities... How is making some cities obey the same laws that everyone else does already "bringing a hammer on them"?

    ..

They are breaking the law. The only thing broken about our current immigration policy is that the Executive branch is failing to do it's job in enforcing the laws on the books. Legal immigration is difficult for a reason. This is the best nation in the world. You don't hear about central Americans sneaking into and staying Mexico.

    ..

No amnesty ever....we do not need immigration change, we need immigration enforcement and send the illegal invaders out of the country.

    ..

I understand the frustration. I was so frustrated listen to this person shirt around answering a simple question. I'm very upset. How can I as a U.S. Citizen be required to follow the laws of our country when my own government doesn't follow or enforce laws? Ridiculous isn't the right word, Senator Vitter.

What an illegal immigrant did to this young Marine is DAMN deplorable
Written by Allen West on February 5, 2016

I received this through one of the military email networks to which I belong, WAYMOR, Inc. It’s operated by one of my mentors, COL Wayne “Lobo” Morris USMC. The email below came to us from another Marine, Vietnam Veteran Captain Jud Blakely.

The story is pretty self-explanatory and just breaks your heart. This is the real story happening out there to Americans because of illegal immigration. This is why we should not have “sanctuary cities” harboring illegals who are causing death and injury to our American citizens. Please, if you can find it in your heart, let’s help out this Marine, Beth Wiggins. Just amazing. Just damn deplorable.

    Jud here…

…and I thought as long, as hard, and as well as I could before sending this to you-all…but I have no other way to give Beth Wiggins and Eli, her young son, a helping hand.

Beth is a single mother, Eli has just turned six, and Beth is the definition of “Never Give Up.” Her resilience under the crush of what has befallen her is humbling to witness.

In her mid-30’s now and a former Marine MP––that’s right, I said Marine MP––from 1995 to 2003, Beth was also a heck of a softball player until she chose to become a mom.

Beth and Eli live in Atmore, Alabama which is 40 miles NE of Mobile on the Florida line. I know her because she was my son’s supervisor at the Airbus assembly plant here.

Paul and Beth work for a security outfit called Alutiiq (“A-loo-tick”). Beth has been with Alutiiq since she left the Corps and has been both a mentor and role model for Paul.

Three months ago Beth Wiggins was riding her motorcycle to work, was run into by a drunk driver on I-65, barely survived, and had to have both legs amputated at the knee.

The drunk driver––it was a hit and run––was found by the police and turned out to be an illegal from Mexico. No insurance, of course, and he’s now vanished into the wind.

    girl

Beth is blessed with great parents and close siblings…but with over $200,000 in medical and rehab bills, Beth is finding out that dealing with insurance companies is a battle.

And so…I ask that you consider sending Beth Wiggins a few bucks via this link to a GoFundMe.com account set up for her by several of her co-workers and former Marines.

This woman and mother is just a marvel of friendship, leadership, and will to succeed.

    Thank you…and Semper Fi,

    Jud

Illegal alien cop-killer explains how sanctuary city helped him hide in plain sight

    February 9, 2016 | Michael Dorstewitz

A Mexican national, who murdered a police officer after having twice crossed the border into the United States illegally, told a Houston newspaper how sanctuary cities were his friend for allowing him to hide in plain sight.

Convicted killer Juan Leonardo Quintero told The Texas Tribune in a recent interview that sanctuary cities tied the hands of law enforcement by not allowing officers to check the immigration status of people within their jurisdiction.

Quintero first crossed the border in 1994 and was deported four years later after being charged with sexual indecency with a 12-year-old girl.

Although he was told he’d face a 10-20 year prison sentence if he came back, Quintero returned to Houston seven months later. He knew Houston was a sanctuary city where there was a minimal risk of being caught.

His luck held for eight years until he was caught speeding in 2006. When Quintero was unable to produce identification, Houston police officer Rodney Johnson arrested him and placed him in the back of Johnson’s squad car.

Although Johnson searched Quintero, he didn’t search him well enough: he shot the officer repeatedly in the back of the head, killing him.

And because Houston is a sanctuary city, Johnson’s wife is a widow.

The Nation Sinks to New Lows: Dismisses Tragedy of Teenager Murdered by an Illegal Alien as “Tokenism”

June 17, 2016 By Ira Mehlman

The Nation magazine makes no pretense at objectivity. It has long stood proudly and openly at the far left fringe of American politics. As such, no one should be surprised or disturbed that it takes an open-borders stance on immigration or by its vehement opposition to Donald Trump.

However, in its most recent rant on both of those topics, writer Julianne Hing stepped over the line of decency. She not only attacked Trump and groups like FAIR, she impugned the character of a murdered teenager and dismissed his father’s tireless efforts to spare other families similar grief as “tokenism.”

Jamiel Shaw Jr. was gunned down in front of his Los Angeles home in 2008 by an illegal alien gang member who had been sprung from the county jail a day earlier. “Shaw is the father of Jamiel Shaw Jr., a 17-year-old football star who was killed in 2008 in Los Angeles by Pedro Espinoza, a 19-year-old undocumented gang member who, as the popular story went, mistook the unaffiliated Shaw for a rival gang member and shot him to death. (The actual case may have been more complex.), Hing writes.”

The parenthetical hyperlink actually appears in The Nation article. The link takes readers to a 2008 Los Angeles Times article reporting on unproven allegations by Espinosa’s attorney that Jamiel Jr. was affiliated with a rival gang. The accusation was nothing more than a sleazy tactic of a lawyer trying to get his client off. No evidence was ever produced to substantiate the posthumous character assault against the murder victim. Espinosa, on the other hand, was found guilty of the murder and will be spending the rest of his life in prison.

But Hing’s assault on the Shaw family does not stop with dredging up discredited innuendo against Jamiel Jr. She goes on to accuse Jamiel Sr. of exploiting his race (he’s African-American) and his son’s death by serving as a surrogate for Trump who can get away with (in Hing’s estimation) bias against illegal aliens. “Shaw’s blackness gives him cover from accusations of anti-immigrant racism that follow Trump and his white supporters, and his awful grief laid bare chastises would-be critics into silence.” In one sentence, she manages to both label Jamiel Sr. as a shameless opportunist and assert that opposing illegal immigration is inherently racist.

From there Hing’s tone morphs from insulting to condescending. “How can anyone turn away from a father who will spend the rest of his life grieving the loss of his baby boy? The response from pro-immigration forces has never been able to meet the emotional urgency of Shaw’s arguments. Such is the power of tokenism. (Emphasis added.) Such is the power of a tragic and violent story disconnected from context about immigration and crime,” she writes.

A murdered 17-year-old and his father’s political activism on behalf of immigration enforcement are reduced to opportunistic “tokenism” because the power of the Shaws’ story (and those of many other families who have suffered at the hands of illegal aliens) stand in the way of The Nation’s dream of a nation radically transformed by mass immigration.

It’s not that The Nation (and most especially Ms. Hing) is necessarily opposed to playing on emotions when discussing immigration. Hardly a week goes by on the magazine’s website that does not include some shameless appeal to emotion featuring families “torn apart” by the “heartless” enforcement of immigration laws.

Jamiel Shaw Jr., Kate Steinle, and thousands of other victims of illegal aliens and our government’s indifference to them, are not “tokens.” They were real people with real families who grieve for them. If The Nation can’t muster a little genuine compassion for them, the least they can do is refrain from trampling on their graves.
