Holder’s days as attorney general may be numbered as resignation calls double overnight
Published: 12:20 AM 10/28/2011 | Updated: 11:48 AM 10/28/2011
By Matthew Boyle - The Daily Caller

Attorney General Eric Holder’s tenure in the Obama administration may be coming to an end. At least eight members of Congress have now called on Holder to resign over the growing Operation Fast and Furious scandal.

Republican Reps. Vicky Hartzler of Missouri, John Mica of Florida, Quico Canseco of Texas and Gus Bilirakis of Florida each told The Daily Caller on Thursday that they believe Holder should step down now. The number of members of Congress calling for Holder to end his career in government because of Fast and Furious is now eight, a number which has doubled in one day.

Previously, Republican Reps. Joe Walsh of Illinois, Raul Labrador of Idaho, Blake Farenthold of Texas and Paul Gosar of Arizona called on Holder to resign.

A spokesperson for Mica, a powerful congressman who serves on the House oversight committee and chairs the House Transportation Committee, told TheDC that he “thinks Attorney General Holder should resign, for more than just the Fast and Furious operation mishandling.”

Hartzler spokesman Steven Walsh said the congresswoman doesn’t think Holder is capable of leading the Justice Department after his flimsy May 3 testimony before the House Judiciary Committee.

“Congresswoman Hartzler is of the opinion that documents pertaining to Fast and Furious call into question Attorney General Holder’s testimony before the House Judiciary Committee,” Walsh said in an email. “In particular, she is concerned with his testimony regarding knowledge of the timeline of the gun program. Given the information we now have, she is of the opinion that Mr. Holder is not up to the task of advocating on behalf of the American people and should resign.”

At that May 3 hearing, Holder said he had not learned of Operation Fast and Furious until a few weeks before — even though Iowa GOP Sen. Chuck Grassley told TheDC he personally handed Holder an inquiry letter about the scandal months before.

Since then Grassley and House oversight committee chairman Rep. Darrell Issa, the two leading congressional Fast and Furious investigators, have probed the White House for answers to questions about how Obama knew of the program before Holder claims he knew. Obama addressed Operation Fast and Furious in an interview on Univision about a month before Holder claims he first learned of the gun-walking program.

In an email, Canseco told TheDC that Operation Fast and Furious endangered many Americans in his Texas district, which includes “almost 800 miles of U.S.–Mexico border that is already struggling to deal with the threat of Mexican cartels and violence that is spilling over from Mexico into the United States.”

“Attorney General Holder’s approval of an operation that could put the lives of Americans at risk, as was the case with Operation Fast and Furious, and the fact that he misled Congress — whether intentionally or not — about his involvement has demonstrated to me that he does not possess the judgment that I believe is necessary to serve in the position of Attorney General of the United States,” Canseco said.

“Attorney General Holder’s lack of judgment has only made the situation along the U.S.–Mexico border that much more difficult to deal with as he made it possible for the Mexican cartels to be better armed, compliments of the American taxpayer.”

Canseco added that it would be in the best interest of Americans’ safety for Holder to step aside now.

“I call on him to put the safety and interests of the American people first and resign as Attorney General,” Canseco said.

It will take a lot more than 8 Republicans to get Holder to resign. He has violated his oath as AG. He has stonewalled on investigations that should have been done and let racist black radicals off the hook because he is a racist. He and Obama have a lot of potential problems if they relinquish power, and Obama needs Holder as the head of the Department of Injustice during the upcoming election to see to it the election fraud is unimpeded.

Obama and Soros would hate losing Holder like Hitler would have hated losing Himmler. they have no intention of giving up power or respecting investigations based on a constitution they thumb their noses at. it will take a substantial outcry from the citizens, including some Democrats before Holder will go. I hope I'm wrong.

....

Good thought. Then would the investigation stop? They must be debating this as we comment and have weighed all the pros and cons. The storyline:
1) we are racists
2) it was started under Bush
3) he didn't know
4) who will be the fallguy?

etc etc etc

But who we get in exchange--will it be worse?

A GOOD MAJORITY OF AMERICANS ---believe it or not---DON'T YET KNOW ABOUT FAST AND FURIOUS---THANKS TO THE MAINSTREAM PRESS. You've got to hand it to them and Soros ----they ARE effective!

....

It's the mainstream press. They absolutely WILL NOT report ANY story showing the Obama administration in a bad light. Right now, CBSnews.com has no mention of the 8 congressmen demanding Holder step aside, rather they are running with a stroy on how 1 Tea Party Organizer is asking Michelle Bachman to step aside. We MUST topple this activist American press.

....

Holder's shameful, disgraceful record of "achievement" as asst. AG to that guy during the Clinton years, what's his name? Oh ya, Janet Reno - anyway, that should have DISQUALIFIED him to EVER work for the Federal government EVER AGAIN.

Of course, he's a Democrat, and, well - they have no shame.

Eric Holder to testify on Fast and Furious
By Sharyl Attkisson October 28, 2011 2:05 PM

CBS News has learned Attorney General Eric Holder has agreed to appear before the House Judiciary Committee regarding "Fast and Furious." The hearing will take place Dec. 8th.

Judiciary Committee member and head of the House Oversight Committee Rep. Darrell Issa (R-CA) had requested that Holder appear, in part to dig deeper into when-he-knew-what about ATF's so-called "gunwalking" operation Fast and Furious.

In May, Holder testified that he only first heard about Fast and Furious a few weeks before. However, as CBS News reported, documents and memos indicate he had been sent multiple briefings mentioning Fast and Furious in 2010.

Holder later explained in a letter to Congress that he didn't read those memos, and that in any event, nobody at the Justice Department who knew of Fast and Furious was aware of the specific "gunwalking" tactics used.

Also today, Rep. Elijah Cummings (D-MD) requested a public hearing with the former Director of ATF: Kenneth Melson. "A hearing with Mr. Melson would help the Committee and the American people better understand what mistakes were made in Operation Fast and Furious, how these tactics originated, who did and did not authorize them, and what steps are being taken to ensure that they are not used again," wrote Cummings in a letter today to Rep. Issa.

Rep. Cummings says Melson's attorney has indicated Melson would be "pleased to cooperate."

Below is a copy of the Cummings letter.

October 28, 2011

The Honorable Darrell E. Issa
Chairman Committee on Oversight and Government Reform
U.S. House of Representatives
Washington, D.C. 20515

Dear Mr. Chairman:

As I have stated repeatedly, I believe Operation Fast and Furious was a terrible mistake with tragic consequences. As I have also stated, I support a fair and responsible investigation that follows the facts where they lead, rather than drawing conclusions before evidence is gathered or ignoring information that does not fit into a preconceived narrative.

On several occasions over the past month, you have called on Attorney General Eric Holder to appear before the House Judiciary Committee to answer questions about when he first became aware of the controversial tactics used in Operation Fast and Furious. The Attorney General has now agreed to testify before the House Judiciary Committee on December 8, 2011, when you will have another opportunity to question him directly.

With respect to our own Committee's investigation, I do not believe it will be viewed as legitimate or credible-and I do not believe the public record will be complete-without public testimony from Kenneth Melson, who served as the Director of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF).

A hearing with Mr. Melson would help the Committee and the American people better understand what mistakes were made in Operation Fast and Furious, how these tactics originated, who did and did not authorize them, and what steps are being taken to ensure that they are not used again.

Our staffs have already conducted transcribed interviews with Mr. Melson and the former Deputy Director of ATF, William Hoover. During those interviews, these officials expressed serious concerns about the controversial tactics employed by the Phoenix Field Division of ATF as part of this operation. They also raised concerns about the manner in which the Department of Justice responded to congressional inquiries. Both officials also stated that they had not been aware of the controversial tactics being used in Operation Fast and Furious, had not authorized those tactics, and had not informed anyone at the Department of Justice headquarters about them. They stated that Operation Fast and Furious originated within the Phoenix Field Division, and that ATF headquarters failed to properly supervise it.

Since the Attorney General has now agreed to appear before Congress in December, I believe Members also deserve an opportunity to question Mr. Melson directly, especially since he headed the agency responsible for Operation Fast and Furious. My staff has been in touch with Mr. Melson's attorney, who reports that Mr. Melson would be pleased to cooperate with the Committee.

Thank you for your consideration of this request.

Sincerely,

Elijah E. Cummings
Ranking Member

Predicted first question to Holder on December 8th: “What is your exact definition of ‘a few weeks’?”

comments

Holder is making flash cards with numbers that he will hold up to answer a question. This should speed things up:

1. George Bush
2. I don’t recall
3. Guns? What guns?
4. Mexico?
5. Dick Cheney
6. I know nooooothing! (a la Sgt Schutz).

...

In the real world, Holder would be toast. But in DC, well…

Holder has to either claim stupidity or ignorance because he was not doing his job. I contend that his best defense would be to start drooling, setting his mustache on fire and yelling out references to the little green men pursuing him.

...

I wonder what made him finally decide to testify. My guess is that Obama wants him out and getting him to hang himself under oath would allow Obama to make Holder the fall guy. The investigation then ends at the DOJ rather than the White House.

...

“What is your exact definition of ‘a few weeks’?”

Senator: What is your exact definition of ‘a few weeks’?

Holder: Well, as you know, Senator, a week can be interpreted variously as a number of periods of time we may call days, which of course may also be interpreted as eras or epochs of time – for example, we sometimes refer to the “day” of slavery in America, which of course is in reference not to one twenty four hour period, but hundreds of years during which my people were held in bondage against our will and forced to endure harsh labor and indescribable indignity at the hands of cruel and heartless white taskmasters, not unlike your lily-white racist self, Senator. A “few weeks” of living hell, so to speak.

....

Issa has been very vocal and specific in accusing the DOJ of stonewalling his investigation. I expect Holder will be defiant and evasive leaving Issa’s committee little choice but to take this to the floor of the House for action. I would be very surprised if Holder found much support among House Democrats other than maybe the Black Caucus.

...

I want to know why Dec. 6 ? Why wait so long ? This just gives Holder and Co. time to fabricate stories and shred / redact documents. Do it Monday morning at 9: and hold him in seclusion till then !

....

Nixon’s AG John Mitchell ended up in prison for less.

Connie Mack becomes the 30th congressman to call for Holder’s resignation
By Matthew Boyle - The Daily Caller | The Daily Caller – Tue, Nov 1, 2011

Attorney General Eric Holder’s service in the Obama administration may be coming to an end. Thirty members of Congress are now calling for Holder’s immediate resignation — a number that grows larger every day.

Florida Republican Rep. Connie Mack became the latest congressman to demand that Holder step down, telling The Daily Caller late on Tuesday that “Eric Holder should resign Fast and Furiously!”

Mack is a high-profile political figure who entered Florida’s Republican primary for Senate last week. Mack’s decision to call for Holder to resign appears to signal that it’s politically popular.

Also, Mack’s wife, California Republican Rep. Mary Bono Mack, previously told the TheDC that she’s deeply concerned about Holder’s behavior throughout the investigation into Operation Fast and Furious.

“Congresswoman Bono Mack is deeply concerned about ‘Fast and Furious’ and certainly a resignation is not out of the question,” her spokesman Cort Bush told TheDC earlier this week.

North Carolina Rep. Walter Jones tweeted on Tuesday afternoon,”It’s time for Eric Holder to go!” He joined 28 other members who had called for Holder to resign by Tuesday morning.

The Justice Department and President Barack Obama’s White House haven’t answered any of TheDC’s requests for comment about the growing contingent of congressmen calling for Holder to immediately remove himself from office. (RELATED: Sen. Feinstein: Lax gun control is real ‘problem’ with Fast and Furious)

The administration’s continued failure to defend Holder suggests that the president may be keeping the door open to pushing Holder out of office to prevent the scandal from seeping into campaign season.

Three presidential candidates — Rep. Michele Bachmann, former Pennsylvania Sen. Rick Santorum and former Massachusetts Gov. Mitt Romney — have made, in one form or another, a call for Holder’s resignation.

Although only Republicans have called for Holder to resign thus far, one Democrat told TheDC that he wants the investigation to plow forward and figure out what Holder knew and when he knew it.

“There needs to be much more investigation by the Administration and/or Congress on how this program started and what if any oversight by the Attorney General,” Texas Democratic Rep. Gene Green told TheDC. “It is absolutely critical that our nation’s leading officials be honest in their testimony before Congress. I hope the Justice Department and Congress will continue to look into these very serious charges to uphold the integrity of our system.”

The continued congressional pressure on Holder comes as the Attorney General’s top deputy, Assistant Attorney General Lanny Breuer, testified before a Senate Judiciary Committee hearing on Tuesday. At the hearing, ranking Republican member Sen. Chuck Grassley of Iowa pushed Breuer on his recent claims that he was responsible — at least partially — for not informing Holder that gun walking tactics were used during the Operation Fast and Furious.

Gun-walking is when the Bureau of Alcohol, Tobacco, Firearms and Explosives allows straw purchasers to take guns across the border without stopping them, even when law enforcement agents have the chance to do so. Straw purchasers are people who can legally purchase weapons in the United States but do so with the known intention of trafficking them into Mexico.

In a late Monday night document dump that appears to have been an attempt to shield Holder from more public pressure, Breuer admitted that he knew gun-walking occurred during Operation Wide Receiver — a Bush administration program from 2006 and 2007 that employed similar, but more subtle tactics.

Grassley pressured Breuer into admitting that a statement in a letter the DOJ sent him on Feb. 4, 2011, was not true. “ATF makes every effort to interdict weapons that have been purchased illegally and prevent their transportation to Mexico,” the letter from the DOJ to Grassley said.

After reading it aloud during the hearing, Grassley turned to Breuer and said: “That statement is absolutely false and you admitted as much last night that you knew by April of 2010 that ATF walked guns in Operation Fast and Furious. That’s correct, yes?”

“Yes, senator,” Breuer replied.

Breuer technically didn’t admit that the DOJ lied there in the letter because, when Grassley followed up asking him if he reviewed the letter before it was sent, Breuer equivocated. “In direct answer to your question, senator, I cannot say for sure whether I saw a draft of the letter that was sent to you,” Breuer said. “What I can tell you is at that time I was in Mexico dealing with the very real issues that we’re all so committed to.”

During that same hearing, Breuer and California Democratic Sen. Dianne Feinstein tried to blame what they consider lax gun laws for Operation Fast and Furious’ failures, even though it was the law enforcement agents responsible for enforcing gun laws who were selling guns to Mexican drug cartels. Feinstein’s communications staff has continued to refuse to answer whether the senator, who is up for re-election in 2012, believes that Obama administration officials responsible for Operation Fast and Furious need to be held accountable.

Rep. Mack, the latest to call for Holder’s resignation, serves on the House oversight committee, which has spearheaded the congressional investigation into the scandal. Another member of the committee who hasn’t yet called for Holder’s resignation, Rep. Tim Walberg of Michigan, is waiting until after Holder testifies on December 8.

“There are apparent inconsistencies in Attorney General Holder’s testimony before Congress and the facts, and Representative Walberg does not believe Mr. Holder and the Department of Justice has taken the investigation of this matter seriously,” Walberg’s spokeswoman Sarah Kuziomko told TheDC. “Attorney General Holder will be testifying before the House Judiciary Committee on December 8 and Representative Walberg hopes he uses that opportunity to explain his misleading statements and clarify who it is that authorized ‘Fast and Furious.’”

Florida Republican Rep. Bill Posey’s spokesman also told TheDC he’s “very concerned about what he has seen to date regarding fast and furious.”

“Executive Branch officials are obligated to tell the truth when testifying under oath before the Legislative Branch,” Posey’s spokesman said in an email. “If that turns out not to have been the case with any official, including Mr. Holder, then they should resign their office. Rep. Posey is following the House Oversight Committee’s investigation and would like it to have the time to finish so all those involved are held accountable.”

Previous members who’ve called for Holder’s immediate resignation include: Former House oversight committee chairman Rep. Dan Burton, House Transportation Committee chairman Rep. John Mica, House Small Business Committee chairman Rep. Sam Graves and Reps. Ted Poe, Blake Farenthold, Louie Gohmert, Quico Canseco, Rodney Alexander, Paul Gosar, Allen West, Tim Huelskamp, Mike Pompeo, Duncan Hunter, Devin Nunes, Dennis Ross, Trent Franks, Lynn Jenkins, Raul Labrador, Joe Walsh, Gus Bilirakis, Paul Broun, Randy Hultgren, Stephen Fincher, John Culberson, Michael Grimm, Andy Harris, Mike Coffman and Vicky Hartzler.

Holder on 'Fast and Furious': Never again
By PETE YOST - Associated Press | AP – 45 mins ago

WASHINGTON (AP) — Attorney General Eric Holder said Tuesday that an investigation of arms traffickers called Operation Fast and Furious was flawed in concept as well as in execution, never should have happened and "it must never happen again."

Holder's comments came at a Senate Judiciary Committee hearing where the panel's ranking Republican, Sen. Charles Grassley of Iowa, said Operation Fast and Furious represented an "utter failure" by federal law enforcement officials to enforce existing gun laws.

Grassley said he wants to know who the attorney general "plans to hold accountable" for the arms trafficking probe.

In opening remarks, Holder said that he wants to know why and how firearms that should have been under surveillance could wind up in the hands of Mexican drug cartels.

Holder has already lied under oath. Now that he admits that it was flawed in concept and execution he needs to resign...

...

Holder belongs in a Prison. Hope and Change ended up being Corruption and Lies. This whole regime belongs in Prison. And sadly, these skum politicians never seem to pay any price for corruption, manslaughter, unconstitutional acts, or their obvious lies. How and when did America let politicians become immune to our laws?

...

Here we go again. When the fire gets hot in Washington, the blame games start. Why cant we see we have people in high places that have no idea what they are doing. This starts at the top. Unless we want this country turned upside down, we must start cleaning house.

...

Holder should be in prison as a flight risk for what he has done. He is responsible for the death of a border agent named Brian Terry. Stop this criminal administration they have no respect for Americas' laws and have publicly refused to enforce the ones they do not agree with. The only way to legally change law is though legislative action.... and not "Executive Orders"

...

Holder lied to Congress about the program and now is trying to pass the blame to someone else, which is the way this administration functions.

....

Three, two, one .... all together now ... "It's Bush's fault" ....

...

I find it really disturbing when those in authority (Attorney General and other ATF superiors) would wash their hands and claim they know nothing about a govt operation in arms trafficking called 'Fast and Furious' when they issue and dictate orders to their subordinates.

...

This had nothing to do with "tracking guns" . Any law enforcement officer knows this is nonsense. This was about CREATING EVIDENCE of the "Gun show loopholes" that Hillary Clinton and Obama railed about in their March 2010 embrace of the UN Treaty that would strip Americans of the Second Amendment. Since they could FIND any evidence because it doesn't exist, they decided to CREATE evidence. DON'T let the media and a few politicians steer this investigation away from it's root cause. Obama had to sign off on this from the beginning because it was a domestic law enforcement agency operating across borders.

...

Obama administration sells guns to Mexican Drug cartels so Mexican drug cartels can kill other Mexican drug cartel members. Those deaths would then be traced back to guns sold in the US. That was SUPPOSED TO BE the catalyst for a call for tighter gun control laws.

Unfortunately US Border Agent Brian Terry was also killed and the beans were spilled. Don't be surprised if they STILL try to use this to push tighter gun control laws.

How's that hopeychangey thing workin' out for ya?

..

Here's an idea, close the border, period. Stop the games going on for whatever reason and just close it. Strange how this country from the top down can't find qualified people in various agencies anymore, can't get quality medical care, can't get back to the standards we enjoyed forty years ago. Now, it's just one fool supporting another. We all talk about taking back the country but by now it's so infected with corruption, usury or plain inadequacy, what exactly is there left of any value to take back in these United States of Can't?.

...

If this guy does not lose his job over this, then not only is Obama the WORST President in US History, his administration will go down as the MOST Corrupt in US History

Holder regrets misleading Fast and Furious letter
By PETE YOST - Associated Press | AP – 39 mins ago

WASHINGTON (AP) — Attorney General Eric Holder expressed regret Tuesday that the Justice Department sent Congress a misleading letter early this year rejecting allegations of serious problems in the arms trafficking investigation called Operation Fast and Furious.

At a Senate Judiciary Committee hearing, the attorney general said that the probe was flawed in concept as well as in execution, never should have happened and "it must never happen again."

Holder's comments came as the panel's ranking Republican, Sen. Charles Grassley of Iowa, said the operation represented an "utter failure" by federal law enforcement officials to enforce existing gun laws.

Holder said that he wants to know why and how firearms that should have been under surveillance could wind up in the hands of Mexican drug cartels.

Grassley asked who the attorney general "plans to hold accountable" for the arms trafficking probe.

In August, the Justice Department replaced three officials who played critical roles in the arms trafficking probe — the acting director of ATF, the U.S. attorney in Arizona and a prosecutor who worked on the arms trafficking probe. The department's inspector general is still investigating the case, at Holder's request.

Grassley pointed to a Justice Department letter the senator received last February saying that federal agents make "every effort" to intercept weapons that have been purchased illegally and prevent their transportation to Mexico.

Holder said that the letter was based on incorrect information and that "I regret that." The attorney general said the incorrect information was supplied by the U.S. Attorney's office in Phoenix and the Bureau of Alcohol, Tobacco, Firearms and Explosives

Regarding the fallout from Fast and Furious, Holder said that "unfortunately, we will feel its effects for years to come as guns that were lost during this operation continue to show up at crime scenes both here and in Mexico."

Several ATF agents have testified that they were ordered by superiors to let suspected straw buyers walk away from Phoenix-area gun shops with AK-47s and other weapons believed headed for Mexican drug cartels, rather than arrest the buyers and seize the guns there.

The goal was to track the guns to trafficking ring leaders who long had escaped prosecution. ATF lost track of some 1,400 of the more than 2,000 weapons whose purchases attracted the suspicion of the Fast and Furious investigators.

Grassley's investigation brought problems in Operation Fast and Furious to light early this year. Sen. John Cornyn, R-Texas, was expected to question Holder on whether federal agents in Texas adopted the same controversial tactic called gun-walking used in Arizona in Operation Fast and Furious.

Holder also may run into questioning by Democrats on the panel over new FBI rules on intelligence collection activities, an issue of importance to civil liberties groups concerned that in a post-Sept. 11 world, the government is loosening restrictions on investigative tactics.

In the years since 9/11, Congress and the Justice Department have granted the FBI "ever-greater powers to investigate Americans with less basis for suspicion and less oversight," said Elizabeth Goitein, co-director of the Liberty and National Security Program at the Brennan Center for Justice.

Holder, who says he learned of problems in Fast and Furious early this year, has become a focal point for criticism in a congressional investigation by the House Oversight and Government Reform Committee chaired by Rep. Darrell Issa, R-Calif. Republican critics have suggested Holder was informed of the problems as early as July 2010 when the operation's name turned up repeatedly in weekly departmental reports. The reports provided updates on dozens of investigations, including Fast and Furious, but do not mention the gun-walking tactic.

Holder used the hearing as an opportunity to urge support for ATF.

The attorney general cited congressional testimony by some of the ATF agents in the probe who said they lack effective enforcement tools. They have sought clearer legal authority to arrest straw purchasers and tougher prison sentences for them. Holder asked Congress to "fully fund our request for teams of agents to fight gun trafficking."

On Monday, the committee's chairman, Sen. Patrick Leahy, D-Vt., asked whether the Justice Department's inspector general has expanded its probe of Operation Fast and Furious to include earlier Bush-era arms trafficking probes that relied on gun-walking.

The Associated Press reported on Friday that a briefing paper prepared for then-Attorney General Michael Mukasey during the Bush administration in 2007 outlined failed attempts by federal agents to track illicitly purchased guns across the border into Mexico. Those failed attempts involved an earlier gun-walking probe run out of the same ATF office in Phoenix that later handled Operation Fast and Furious.

A month ago, the AP also disclosed that several hundred weapons wound up in the hands of arms traffickers in a second Bush-era gun-walking probe beginning in 2006. It was called Operation Wide Receiver and was run out of the ATF's office in Tucson, Ariz.

The IG's office says in a semiannual report that it is reviewing Operation Fast and Furious "and other investigations with similar objectives, methods and strategies." A spokesman for the IG's office, Jay Lerner, declined to comment on whether the investigation has been expanded to cover Wide Receiver and the probe that the briefing paper to Mukasey referenced.

http://news.yahoo.com/holder-regrets-misleading-fast-furious-letter-162809913.html

Watching the Senate hearings concerning 'fast and furious" and I want to throw up. Leahy, Schumer and Whitehouse busily absolved Holder and blamed the Bush administration on operation "wide receiver'. Grassley for his part attempted to get Holder to explain how this could happen and he, Holder, not be aware. With Leahy in charge you know the outcome of this "intense" questioning. Why do we Americans continue to condone this charade?

...

"The (alleged overt) goal was to track the guns to trafficking ring leaders who long had escaped prosecution."

Without question, the covert goal was the implementation of new gun control laws or restrictions. Holder and everyone associated with letting the guns walk, whether during Bush's or Obama's administrations, should be prosecuted for various crimes, up to and including accessory to murder.

...

"Misleading Letter" ??? It's called perjury. They arrested Martha Stewart for it, it should do just as well for elected officials in a matter this serious.

...

Holder regrets getting caught and that someone is holding him responsible. His whole career has been a slew of botched raids and thuggery. He also regrets he could not kill more people before he gets jetisoned from Office.[/i]

Forget the circus. Here’s the real scandal. Attorney General Eric Holder is on the hot seat this morning at the Senate Judiciary Committee. Sen. Charles Grassley is pressing Holder on continued Fast and Furious stonewalling and lies. Holder has just dismissed as a “distraction” the scrutiny of his false testimony over when he knew what. Holder says “I did say ‘a few weeks.’ I could have said ‘a few months.’” Weeks, months. Whatever.

See Matt Boyle for background, opening prepared statements.http://dailycaller.com/2011/11/08/grassley-to-push-holder-new-evidence-contradicts-claim-about-when-ag-learned-of-fast-and-furious/

Watch online here. http://www.c-span.org/Events/Lawmakers-Question-Holder-on-Operation-Fast-and-Furious/10737425323-1/

Philip Klein notes Holder’s concession this morning: http://campaign2012.washingtonexaminer.com/blogs/beltway-confidential/holder-concedes-atf-let-guns-walk-mexico

U.S. Attorney General Eric Holder conceded this morning that under his leadership, agents allowed guns to “walk” into Mexico, where they ended up in the hands of drug lords, and he said that the effects of this mistake would be felt for years to come.

“I want to be clear: any instance of so-called ‘gun-walking’ is simply unacceptable,” Holder said in his opening statement before the Senate Judiciary committee. “Regrettably, this tactic was used as part of Fast and Furious, which was launched to combat gun trafficking and violence on our Southwest Border. This operation was flawed in concept, as well as in execution. And, unfortunately, we will feel its effects for years to come as guns that were lost during this operation continue to show up at crime scenes both here and in Mexico.”

When will Holder feel some effects and consequences?

Holder asserts this morning: “”Fast and Furious was a flawed response TO, not cause OF’ the problem of U.S. guns going to Mexico.” Setting up for more gun control, Holder says the solution is more money for DOJ and more enforcement “tools” for the government.

In July, DOJ engaged in its first gun control head fake.

Reminder: “In the wake of swelling outrage over the Obama administration’s fatally botched Fast and Furious straw gun purchase racket, the DOJ is punishing the very whistleblowers who protested the scheme in the first place. This is a head fake. Instead of exercising more control over lawless bureaucrats within its own agencies, the Obama administration is tightening its grip over law-abiding gun shops.”

Holder is doubling down on corruption and stupidity — blaming gun shop dealers again, despite the fact that licensees were key in exposing Fast and Furious.

Grassley is not having it. He stated this morning: “This tragedy should not be used to call for more gun control.” And added: “It doesn’t matter how many laws we pass if those in charge of enforcing them don’t do their duty!

Holder brags this morning about how DOJ has handled Fast and Furious: “I took action.”

Yes: To cover it up.

More coming…

Yesterday, Attorney General had his chance to "come clean" on Fast and Furious---yet he continues to skirt around the truth of what really happened and when.

Republican senators tried to get Holder to take some of the responsibility; but he did not. Some lawmakers were hoping that Eric Holder would FINALLY tell the whole truth. They were disappointed.

U.S. Senator John Cornyn (R-TX) gave Holder an opportunity to apologize to the family of murdered Border Patrol Agent Brian Terry, where two Fast and Furious guns were found at the murder scene.

Senator Cornyn rapid-fired questions directly to the Attorney General: "Have you apologized to the family of Brian Terry?"

"Have you even talked to them?"

"Would you like to apologize today for this program that went so wrong, that took the life of a United States law enforcement agent?"

"Are you winging this or do you actually know?"

Eric Holder slithered around most of the direct questions. It is possible that when the dust settles and we finally hear the truth, that Mr. Holder committed perjury AGAIN! Eric Holder and his boss, Barack Obama---cannot declare themselves to be Judge, Jury and Executioner! Fast and Furious, alone, is grounds to call for impeachment.

MR. HOLDER: NO ONE IS ABOVE THE LAW!

Will you join 28 other Representatives who want Eric Holder to RESIGN?

Even the leftist Washington Post wants to shut this down. They admitted that Holder walked around the truth; but somehow, to them, that doesn't matter! They reported yesterday: "Without a doubt, the operation was a debacle, and it has led to untold bloodshed and friction with Mexico. The ATF's acting chief has been reassigned, and subpoenas are flying on Capitol Hill."

My Friend, it matters to us! We do want the whole truth!

Eric Holder previously denied that any gunrunning was taking place. He had sent a letter to Congress vehemently defending Fast and Furious, telling the lawmakers that ATF had not been allowing guns to "walk" across the border. Then, earlier this year, he went before the House Committee on Oversight and Government Reform, committing perjury, lying to U.S. Rep. Darrell Issa (R-CA) about his knowledge of the gunrunning sham. Holder originally called Fast and Furious a "local, Arizona-based operation." He did manage to correct himself on that yesterday.

In May, when asked by Issa about when he learned about Fast and Furious, he replied, "over the last few weeks." I suppose in the devious mid of Eric Holder, a "few weeks" could mean NINE MONTHS? U.S. Senator Chuck Grassley (R-IA) and Rep. Darrell Issa found five emails or memos briefing Holder about Fast and Furious since July, 2010!

When Senator Cornyn demanded how this aligned with his previous statements, Holder responded: "I'm not sure I understand the question."

Holder quipped that he could not "be expected to know" all what happens within the Department of Justice. He said he could not be expected to be familiar with all the contents of all the memos that are addressed to him. After all, he supposedly "oversees" 117,000 employees in the DOJ! He cannot be bothered to read all of the memos, according to the Attorney General.

As to the requested apology to slain Agent Brian Terry...Holder's detached response was: "I certainly regret the bloodshed of a uniformed civil servant."

THE BOTTOM LINE: ATTORNEY GENERAL ERIC HOLDER DID NOT TAKE ANY RESPONSIBILITY FOR HIS DOJ ACTIONS---which has resulted in over 300 killed on both sides of the border! Does he have any shame?

Again, another hearing where we saw the Attorney General try to "save his own skin" or possibly the"hide" of his boss, Mr. Obama, as well!

Attorney General Eric Holder has been officially subpoenaed by U.S. Rep. Darrell Issa (R-CA), the chairman of the House Oversight and Government Reform Committee, for an early December appearance. But "Teflon Holder" might still not give us the entire truth.

"IT'S TIME WE KNEW THE WHOLE TRUTH!" Issa blasted.

And those are the exact words we have been using for over one-half year in communicating about this fiasco and ATF sham! We have helped to expose the "stonewalling" and "perjury" actions by Holder; yet he still maintains his innocence.

Rep. Darrell Issa states: "Top Justice Department officials, including Attorney General Holder, know more about Operation Fast and Furious than they have publicly acknowledged. The documents this subpoena demands will provide answers to questions that Justice officials have tried to avoid since this investigation began eight months ago."

Eric Holder showed absolutely no remorse for his Fast and Furious actions. In fact, he accused Republican senators who tried to get to the bottom of this, with the facts; Holder yesterday accused them of playing "gotcha games" and engaging in "cynical political point scoring." Again, he tried to deflect criticism away from him facing potential criminal charges for perjury---to the supposed political mantra of this scheme.

LYING TO CONGRESS IS NOT A "POLITICAL STUNT!"

NOW---he is facing the biggest battle of his life. NOW---he is facing the biggest lies of his career! Eric Holder's lack of being "trustworthy" is more than just a grave concern, according to Congress. He must now be a "thorn in the flesh" to President Barack Obama. Holder literally LIED to Congress. And he must be either FIRED or RESIGN! How can the nation's top enforcement official LIE to Congress?

But here is the real purpose of Fast and Furious.

Holder was not "winging it." He has taken a perfect play from the liberal "play book" and from his mentor, Barack Obama. Holder is using his Senate Committee appearance and the entire operation of Fast and Furious as a push for renewed gun control legislation! This is really what is at stake here.

U.S. Senator Chuck Grassley (R-IA), the ranking member of the Senate Judiciary Committee, said in July that he suspected a political motivation behind Fast and Furious. He stated: "My suspicion is they (the Obama administration) do not like the Second Amendment the way it is, and they are going to do everything to hurt guns and restrict guns. So they could have been building a case for that. But I can't prove that."

The Obama Administration has worked under the radar---as well as via Fast and Furious---to generate additional gun controls in the United States of America. Obama's disdain for the United States Constitution, especially the Second Amendment which guarantees us the right to keep and bear arms, was manifest yesterday through Eric Holder when he asserted: "Beyond identifying where errors occurred and ensuring that they never occur again, we must be careful not to lose sight of the critical problem that this flawed investigation has highlighted: We are losing the battle to stop the flow of illegal guns to Mexico. One critical first step should be for congressional leaders to work with us to provide ATF with the resources and statutory tools it needs to be effective."

The truth will eventually come out. Fast and Furious ultimately does not have anything to do with supplying guns to Mexican drug cartels---it has everything to do with the long-range, anti-gun Obama plan of undermining the Second Amendment rights of the taxpayers of the United States!

In doing the research into the logistics and actual firearms that were used in Fast and Furious, we have learned that very few of the weapons that were purchased and "walked" into Mexico were what the drug gangs really wanted. Of the 2,000 weapons acquired by Mexican drug cartels, very few were their "weapons of choice."

However, coincidentally, most of the Fast and Furious weapons used are the types that Mr. Obama is most interested in limiting or doing away with altogether. You see where this is going. Mr. Obama wants to use Fast and Furious to call for the elimination of weapons marked by American "gun-grabbers" throughout the nation, especially by the gun-opposition group headed by Jim Brady.

More importantly than LYING to Congress---he is guilty of being an "Accessory to Murder!" The communications tell the story of the lies! Eric Holder must resign! Plain and simple. How can we have the nation's top law enforcement person lying to Congress? He must be held accountable. Eric Holder must be made to tell the truth of what he knew and when...even if it gets his boss, President Obama, in hot water!

How many more murdered U.S. agents---or how many more murdered Mexicans---will happen due to the Fast and Furious guns?

Congressmen: Obama ‘complicit’ in Fast and Furious without action on Holder
By Matthew Boyle - The Daily Caller – 7 hrs ago

Several of the 43 members of Congress demanding Attorney General Eric Holder’s resignation because of Operation Fast and Furious believe it is President Barack Obama’s responsibility to dismiss him if Holder won’t step down on his own. If Obama fails to replace his attorney general, they said, he may share in the guilt for the program’s failure and the resulting scandal.

At a Tuesday press conference, Idaho Republican Rep. Raul Labrador, one of the first lawmakers to demand the attorney general’s resignation, asked if Holder is protecting Obama by remaining at the helm of the Justice Department.

“As our nation’s top enforcer of the principles of law and justice, Mr. Holder has now lost credibility and should step down immediately,” Labrador said. “The question now for Mr. Holder is whether he’s only protecting himself or whether he’s protecting others, perhaps all the way to the top of the administration.”

Rep. Allen West of Florida added that if Obama fails to act, he will ultimately share the blame for Fast and Furious.

“I ask the president of the United States of America to recommend to Eric Holder that he resign from his position,” West said. “If the president does not agree with that stance, then perhaps the president of the United States of America is also complicit in this horrible, tragic event.”

Rep. Tim Huelskamp of Kansas said President Obama has had plenty of time to call Holder and ask that he resign. He announced that he had checked Obama’s public schedule, and suggested a specific time for the president to have that conversation.

“I believe it’s time for the president to join us and step up to the plate and ask Mr. Holder to resign,” Huelskamp said at the Tuesday presser. “I’ve checked the president’s schedule and it looks pretty open today. Perhaps he could place a call shortly after he takes off from Hawaii and heads to Australia. It’d just take a few minutes. He could have done it yesterday, but of course I guess he was on the golf course and was too busy.”

The White House and the Justice Department have ignored the growing pressure from members of Congress for Holder’s resignation, even as media scrutiny has intensified. The number of federal lawmakers calling for Holder to step down has steadily increased since Texas Republican Rep. Blake Farenthold first suggested it on Oct. 4.

AG Holder is a proven liar. That, alone, should be grounds for resignation, impeachment or firing. Also, Holder is guilty of breaking Pres. B. Obama's campaign promises to leave state's rights alone by authorizing the raids on state-approved medical marijuana dispensaries. Why Obama is not censuring him over this is beyond comprehension. Campaign promises are broken all of the time, so next time, let's vote this hypocrite out!

...

Holder should have been fired when he dropped charges on the Black Panthers for voter intimidation that was on video!

...

Giving assault weapons to Mexican drug cartels in the hopes of finding them later is either:

a) The absolute dumbest idea ever, ever, ever.

b) A malicious attempt to create a crisis in order to increase gun control on law abiding citizens. "Look at all these guns we found that we can trace back to the US".

Rahm Emmanuel said, "Never let a crisis go to waste." Eric Holder believes that sometimes you have to create that crisis.

You can rest assured that Eric Holder will not step down on his own, he will have to be forced out because Obummer will not ask him to step down either, nothing they do is wrong according to them.

...

The funny thing is there is evidence of this happening but Liberal choose to ignore the story. IT'S ALL BUSHES FAULT, RIGHT?

...

The Democrats strategy is to stall. Their liberal media will cover for them and not report what is going on. Due to the liberal medias silence on the matter, most Americans do not even know what "Fast and Furious" is and would be supprised if Obamas involvement was exposed. I am supprised this article got published at all.

Eric Holder debates definition of ‘lying’ with congressman
By Matthew Boyle - The Daily Caller | The Daily Caller – 50 mins ago

When Wisconsin Republican Rep. Jim Sensenbrenner and Attorney General Eric Holder had a sharp back-and-forth on whether or not officials in the Department of Justice lied to Congress. The questioning was during Thursday morning’s House Judiciary Committee hearing on Operation Fast and Furious. “First let me make something very clear, in response to an assertion you made, or hinted at: Nobody in the Justice Department has lied,” Holder said in response to accusations that he or his confidantes lied to Congress. “Nobody has lied.”

“Then why was the letter withdrawn?,” Sensenbrenner retorted, referring to a factually inaccurate letter one of Holder’s deputies, Assistant Attorney General Ronald Weich, sent to Iowa Republican Sen. Chuck Grassley on February 4. In that letter, Weich claimed that guns were never allowed to walk.

Holder and one of his other deputies, Assistant Attorney General Lanny Breuer have both admitted that statement was false in recent Senate hearings. “The letter was withdrawn because there was information in there that was inaccurate,” Holder replied to Sensenbrenner’s question.

Still unsatisfied, Sensenbrenner followed up again. “Tell me what the difference is between lying and misleading Congress in this context?,” he asked Holder. Holder responded that whether a statement is a lie or misleading comment depends on what the person making it is thinking at the time. “If you want to have this legal conversation, it all has to do with your state of mind, and whether or not you had the requisite intent to come up with something that can be considered perjury or a lie,” Holder said. “The information that was provided in that February 4th letter was gleaned by the people who drafted the letter after they interacted with people who they thought were in the best position to have the information.”

Fast and Furious was a Bureau of Alcohol, Tobacco, Firearms and Explosives program overseen by the Justice Department. The operation facilitated the sale of thousands of weapons to Mexican drug cartels via straw purchasers. Straw purchasers are people who can legally purchase guns in the United States with the intention of illegally trafficking them into Mexico.

At least 300 people in Mexico were killed with Fast and Furious weapons, as was U.S. Border Patrol agent Brian Terry.

Dr. Michael Eric Dyson calls Eric Holder ‘the Moses of our time’ [video]
Posted at 6:08 pm on May 30, 2013 by Twitchy Staff

He can’t seem to follow the Ten Commandments, but don’t let that dissuade you from recognizing Eric Holder’s status as a modern-day Moses. This afternoon, Dr. Michael Eric Dyson reached heavenly heights of delusion, telling MSNBC’s Martin Bashir that the scandal-plagued Holder is “the Moses of our time.”

Cast your eyes and ears upon this epic derpitude: http://www.youtube.com/watch?feature=player_embedded&v=Iy0IlzT-JQI

Transcript:

“He is the chief lawgiver of the United States of America, so to speak.
He is the Moses of our time, at least for this administration.”

Dude. Duuude.

In addition to being an MSNBC contributor, Dyson is a sociology professor — which explains his expertise when it comes to both the Bible and the American system of government.

Ladies and gentlemen, this is stupidity of biblical proportions.

BOOM! Judge Jeanine SCORCHES Eric Holder, says he should be INDICTED
Posted by The Right Scoop The Right Scoop on June 1st, 2013

I’ve really come to look forward to Judge Jeanine’s monologues because she is one of the few who will tell the brutal truth no matter how politically incorrect or sensitive. And in this week’s monologue she takes on America’s top law enforcement agent and head of the DOJ, Eric Holder, and rakes him across the coals for the lies he has told and how he is running the DOJ. She calls him a political operative and says he needs to be indicted – and then she writes the actual indictment. Fantastic!

LIAR!
Posted 07.31.13 by Jennifer Burke

Eric Holder is a liar. Now, I could list a plethora of things that he has lied about. Things like whether or not the New Black Panthers intimidated voters during the 2008 elections. Or perhaps I should talk about the botched gun-running program Fast and Furious that resulted in the death of Border Patrol Agent Brian Terry and hundreds of Mexican citizens. Or maybe I can discuss his lies surrounding the cover-up of the Benghazi massacre. We could also talk about lying about the reality of the Fort Hood shootings with going along with the labeling of that terrorist attack as ‘workplace violence’ instead of a terrorist attack. Do you see what I’m getting at. Let me say it again. Eric Holder is a liar! And finally, the House Judiciary Committee has the guts to call him what he is.

On May 15, 2013, during testimony before Congress, Eric Holder lied under oath. When asked about the possibility that members of the press could be prosecuted under the Espionage Act of 1917, Holder replied, “In regard to potential prosecution of the press for the disclosure of material. This is not something I’ve ever been involved in, heard of, or would think would be wise policy.” Given the fact that his testimony included numerous “I don’t knows” and “I’m not aware”, whether or not Holder was telling the truth was immediately suspect to many.

One week later, it was revealed that Attorney General Eric Holder signed off on a warrant to investigate FOX News White House Correspondent James Rosen as a co-conspirator in espionage. His crime? Doing his job as a reporter and working for a news outlet that has been targeted by Obama since he became president.

This is the type of dictatorial governance that one would expect in Communist China, not in the United States of America! When news of Holder’s direct culpability in the targeting of and spying on James Rosen came out, many on both the left and the right called for Holder’s resignation. In keeping with his pattern of rewarding those who do his bidding in cover-ups, Obama adamantly stood by Holder. The latest finding by the House GOP Judiciary, coupled with the bi-partisan demand for his resignation, should be a game changer.

http://www.youtube.com/watch?v=JvoOszHwIrw&feature=player_embedded&list=UU-Qf4gwKxpxUfWXDcyn1r3Q

The House GOP Judiciary Report states the following:

Rather than admit that he gave deceptive testimony, and that Mr. Rosen was actually a target of prosecution (and futhter raise the ire of the media), Mr. Holder instead represented that Mr. Rosen “was never a true suspect, to thread this legal needle, the Attorney General argues that the privacy protection act is written incorrectly. He maintains that the current law permitted him to tarnish Mr. Rosen as a suspect, but only for the purpose of investigating a third party. The committee rejects this facile reading of the law and rejects a needless, duplicative legislative ‘correction’ that serves only to provide cover for Mr. Holder’s misleading testimony’.

While all those who seek justice and truth should be thrilled by this decision by the House GOP Judiciary Committee, the tiptoeing around the reality of this situation is uncalled for given the fact that Holder has previously been found in contempt of Congress. Call him out for what he is. Say outright, “Eric Holder LIED!”

Committee Chair Bob Goodlatte (R-VA) went on to say:

“The deceptive and misleading testimony of Attorney General Holder is unfortunately just the most recent example in a long list of scandals that have plagued the Department. These kind of missteps are not acceptable and I will challenge Attorney General Holder’s mismanagement of the Department of Justice at every step.”

While the Judiciary Republicans may be calling for a change in leadership of the Justice Department, the American people have another idea. As reported by the Washington Times a few weeks ago, more than one million signers have signed a petition from TheTeaParty.net that calls for Eric Holder’s resignation and prosecution. After all, his actions in all of these scandals were not ‘missteps’. They were willfully done and highly calculated.

It’s not wonder that many have referred to the DOJ as the ‘Department of Injustice’ during Obama’s tenure as president. Rather than act in the position of Attorney General as the top attorney of the people and the country, Holder has instead used this authoritative position to work as Obama’s henchman and, in this case, hit man. The message? Go against the president and you will be punished. Where is the justice in that?

Remove Holder from office and prosecute him to the fullest extent of the law. No justice. No peace.

Articles of Impeachment Filed Against A.G. Eric Holder!

Posted on November 18 2013

This has been a long time coming. After years of lying before Congress and deceiving the American people, articles of impeachment have finally been filed against Attorney General Eric Holder. Rep. Pete Olson (R-TX) introduced House Resolution 411, marking the first attempt to impeach a sitting-Cabinet member in nearly 137 years.

The criticisms against Holder are well documented. For the past five years, Attorney General Eric Holder has systematically misled Congress and undermined the credibility of the Justice Department in the eyes of the public.

While in office, Holder has refused to cooperate with congressional investigations into Operation Fast and Furious, a failed gun-walking operation that gave guns to the Mexican cartels. This has been linked the deaths of hundreds of Mexican civilians, as well as the death of U.S. Border Patrol agent Brian Terry.

Eric Holder has also refused to prosecute Lois Lerner and other IRS agents who unlawfully disclosed private tax records to third-party organizations. Holder’s refusal to prosecute proves that he supports unlawful behavior as long as the ends justify the means (read: as long as conservative groups are targeted).

Holder has also taken a play out of the President’s playbook and personally chosen which laws to enforce. The Constitution mandates that the Executive Branch enforce the laws as they are written. But the last few years have proven that Holder is more than willing to pick and choose which laws are enforced and which laws are defended before the Supreme Court.

Finally, Holder has proven uncooperative with Congressional investigations into the DOJ’s unlawful surveillance targeting journalists, and each probe into these unconstitutional programs has been met with more and more hostility.

By all measures, Attorney General Eric Holder has failed to live up to his oath to “support and defend the Constitution of the United States against enemies foreign and domestic.” Holder has betrayed the trust of the American people, making it obvious that HE is a domestic enemy of the Constitution! Eric Holder will go down in history as the most unconstitutional Attorney General!

The Resolution has been drafted and introduced in the House of Representatives. While it currently has 20 sponsors, it will need a lot more support to be successful. Now, more than ever, we MUST reach out to Congress and urge them to support these articles of impeachment!

Holder’s crimes are well documented. Unfortunately, he has been allowed to hide under the veil of Obama’s executive privilege. But the last five years in office have shown that asking Eric Holder to follow and defend the Constitution is like asking a fox to guard the hen-house. Of course Eric Holder isn’t following the Constitution… that’s because he despises it!

He believes that the Constitution is nothing but outdated guidelines in much need of edits because the document does not afford him with the totalitarian power liberals think it should.

The Constitution exists as a framework to defend against tyranny. By refusing to obey or defend the document, Eric Holder can only be classified as a tyrant!

Fortunately, the Constitution provides a process for removing tyrants from office. Article II, Section 4 of the Constitution says that the House of Representatives has the power to impeach civil officers for treason, bribery, or other high crimes and misdemeanors.

The resolution has been introduced in Congress. Now WE must do our part and make sure that our elected officials support this resolution and act in our interests.

Judge won't allow Holder appeal now in contempt case
By JOSH GERSTEIN | 11/18/13 6:21 PM EST

A federal judge has refused Attorney General Eric Holder's request that he be allowed to proceed now with an appeal in a case where the House of Representatives is seeking to enforce subpoenas for documents related to the controversial Operation Fast and Furious gun investigation.

In a ruling Monday afternoon, U.S. District Court Judge Amy Berman Jackson said her September 30 ruling rejecting Holder's request to dismiss the lawsuit was not such a close call that it deserved immediate review from the U.S. Court of Appeals for the D.C. Circuit. "While the Court agrees with defendant’s characterization of the matter as significant, that is not the test," Jackson wrote in her new four-page decision (posted here http://images.politico.com/global/2013/11/18/holdercontempt1292refusedord.html ). "

Jackson's latest ruling means it is likely the Justice Department will have to produce a detailed log of what was withheld from the House Oversight and Government Reform Committee and why. Rounds of protracted litigation over the legitimacy of the withholdings seem all but certain, unless the sides come to an agreement which has heretofore eluded them. "The Court is not of the opinion that its denial of the motion to dismiss involves a controlling question of law as to which there is a substantial ground for difference of opinion," she wrote in her Monday order, issued just one business day after Holder's lawyers asked for the immediate appeal. "The ruling was based upon Supreme Court precedent and Circuit precedent, and it was decided in accordance with an opinion issued by another judge of this court in a substantially similar matter.... Defendant has not pointed to any precedent that would supply the grounds for a difference of opinion."
http://www.politico.com/blogs/under-the-radar/2013/11/holder-seeks-fast-and-furious-appeal-177665.html
Jackson noted that while she was turning down Holder's request for an immediate appeal, she has yet to rule on whether any documents have been improperly withheld from the House Oversight and Government Reform Committee under a claim of executive privilege from President Barack Obama. If she makes such a finding, an appeal would be open at the conclusion of the case.

"If the Court ultimately orders defendant to do anything, he will have an opportunity to ask both this Court and the Court of Appeals to stay the execution of that order if the conditions for a stay – which are different than the conditions for an interlocutory appeal – are present. The Court expresses no opinion at this time as to how that motion would be resolved," wrote Jackson, an Obama appointee.

A Justice Department spokesman and a spokeswoman for the committee did not immediately respond to requests for comment on the ruling.

Former House Counsel Stan Brand said it was not a major loss for the Justice Department, though he understood why lawyers their hope to head off the dispute now and send it directly to the appeals court. However, he said there was no plausible avenue for that to happen in the wake of Jackson's ruling Monday.

Brand said the next step would be detail-oriented litigation in the district court over what documents have been withheld and why.

"They still have all their claims on the merits which could take months," Brand said. "There's still not order saying they must produce a single document. We're six months or more from that final decision and it will be appealed then."

'Truly disturbing’: Eric Holder says state AGs not obligated to defend laws they disagree with

Posted at 7:02 pm on February 24, 2014

S. Attorney General Eric Holder told the New York Times that if a state has a gay marriage ban in place and that state’s Attorney General doesn’t agree with it, he or she does not have to defend it. http://www.nytimes.com/2014/02/25/us/holder-says-state-attorneys-general-dont-have-to-defend-gay-marriage-bans.html?partner=rss&emc=rss&smid=tw-thecaucus&_r=1

Holder Sees Way to Curb Bans on Gay Marriage
By MATT APUZZOFEB. 24, 2014

WASHINGTON — Attorney General Eric H. Holder Jr. on Monday injected the Obama administration into the emotional and politicized debate over the future of state same-sex marriage bans, declaring in an interview that state attorneys general are not obligated to defend laws that they believe are discriminatory.

Mr. Holder was careful not to encourage his state counterparts to disavow their own laws, but said that officials who have carefully studied bans on gay marriage could refuse to defend them.

Six state attorneys general — all Democrats — have refused to defend bans on same-sex marriage, prompting criticism from Republicans who say they have a duty to stand behind their state laws, even if they do not agree with them.

It is highly unusual for the United States attorney general to advise his state counterparts on how and when to refuse to defend state laws. But Mr. Holder said when laws touch on core constitutional issues like equal protection, an attorney general should apply the highest level of scrutiny before reaching a decision on whether to defend it. He said the decision should never be political or based on policy objections. “Engaging in that process and making that determination is something that’s appropriate for an attorney general to do,” Mr. Holder said.

As an example, Mr. Holder cited the landmark Brown v. Board of Education case, which forced public school integration in 1954. “If I were attorney general in Kansas in 1953, I would not have defended a Kansas statute that put in place separate-but-equal facilities,” Mr. Holder said.

The nation’s first black attorney general, Mr. Holder has said he views today’s gay-rights campaigns as a continuation of the civil rights movement that won rights for black Americans in the 1950s and ’60s. He has called gay rights one of “the defining civil rights challenges of our time.”

In his role as the administration’s leading voice on civil rights issues, he has at times earned sharp criticism from Republicans who see him as infringing on state autonomy. He has sued Texas and North Carolina, for example, over laws that would require voters to show identification at the polls. Studies show poor and minority voters are least likely to have identification.

His comments signal the latest manifestation of the Obama administration’s evolving position on gay rights. Mr. Obama came into office opposed to same-sex marriage. But in 2011, he decided against defending the Defense of Marriage Act and ended the “don’t ask, don’t tell” policy barring gays and lesbians from the military. The next year, the president said he personally supported gay marriage.

Mr. Holder is scheduled to address the National Association of Attorneys General at a conference on Tuesday, but reports of his comments drew immediate criticism from the president of the bipartisan group.

“It really isn’t his job to give us advice on defending our constitutions any more than it’s our role to give him advice on how to do his job,” said Attorney General J. B. Van Hollen of Wisconsin, a Republican. “We are the ultimate defenders of our state constitutions.”

While the Supreme Court struck down the Defense of Marriage Act, it has not weighed in on whether same-sex couples have a constitutional right to marry. The legal battleground, for now, has shifted to the states, and the collective voice of several attorneys general refusing to defend their laws could help sway those cases.

One of those cases is in Wisconsin, where four same-sex couples sued this month to overturn the state’s constitutional amendment banning gay marriage.

Mr. Van Hollen said Mr. Holder’s analysis might make sense in rare cases related to state laws. But he said that in states that have passed constitutional amendments, attorneys general must defend them.

“If there’s one clear-cut job I have, it’s to defend my Constitution,” Mr. Van Hollen said. “There is no one else in position to defend the State Constitution if it comes under attack.”

Colorado’s attorney general, John W. Suthers, a Republican, has also warned against attorneys general making decisions about which laws to defend.

“I personally oppose a number of Colorado’s laws as a matter of public policy, and a few are contrary to my religious beliefs,” Mr. Suthers wrote in The Washington Post this month. “But as my state’s attorney general, I have defended them all — and will continue to.”

Same-sex couples in the state are challenging Colorado’s constitutional ban on gay marriage.

But in Nevada, Oregon, Pennsylvania and Virginia, state attorneys general have refused to defend bans on same-sex marriage. Attorneys general in California and Illinois similarly refused to defend bans that were later overturned.

“The answers to these questions are crystal clear,” said Gary Buseck, legal director of Gay and Lesbian Advocates and Defenders. “Attorneys general can’t close their eyes to something that’s blatantly unconstitutional. They’re not supposed to defend the laws at all costs.”

In Arizona this week, Gov. Jan Brewer, a Republican, must decide whether to sign legislation that would allow business owners to deny service to same-sex couples. Asked in the interview about the legislation, Mr. Holder said he had not reviewed that bill and had no view on whether it was constitutional.

But he said he was certain that, if signed into law, it would face swift legal challenges. And the state’s attorney general would have to decide whether to defend it.

Very disturbing. AG's are sworn to uphold the law,

Eric Holder Cancels OKC Speech After Protests Demanding His Impeachment
By Top Right News on April 24, 2014

Attorney General Eric Holder cancelled his appearance before the Oklahoma City Police Department’s graduating cadet class Thursday amid angry protests over his scheduled visit — including by one state rep calling for his impeachment by Congress.

Mr. Holder was scheduled to deliver remarks at the graduation ceremony at 2:30 p.m. Eastern time, according to his official itinerary sent out by the Justice Department Thursday morning.

“It is true that Mr. Holder will not be in attendance,” said Capt. D. Nelson, the chief spokesman at the Oklahoma City Police Department. “No reason was stated.”

Mr. Holder’s scheduled visit to Oklahoma City drew the criticism of several conservative lawmakers who planned the protest anticipating his arrival, including state Rep. Paul Wesselhoft, Moore Republican, who has stated he believes that Mr. Holder should be impeached.

Mr. Holder’s tenure as attorney general has been highly politicized. In 2012 he was held in contempt of Congress — the first time ever for a sitting Cabinet member — for failing to provide key information about the Operation Fast and Furious gun-walking scandal.

Earlier this month, Texas lawmakers railed against the attorney general in a House of Representatives oversight hearing, telling him in front of a Capitol Hill crowd that not only should he be held in contempt, but that he should be sitting in a jail cell.

Republicans say Mr. Holder has refused to comply with several subpoenas issued from Congress for documents related to the operation and outright ignored a criminal contempt citation that members of the House issued against him months ago.

Mr. Holder’s view is that he has released all the pertinent documents, as requested, and complied with congressional investigators.

In the hearing, Rep. Blake Farenthold said: “I’m committed to maintaining the constitutional balance of power and the authority that this legislative branch has, and I just don’t think it’s appropriate that Mr. Holder be here. If an American citizen had not complied with one of the Justice Department’s subpoenas, they would be in jail and not sitting here in front of me testifying.”

In another nasty hearing an angry Holder shouted “You don’t want to go there, Buddy” at GOP Rep. Louie Gohmert (R-TX). The appearance made it clear that the pressure was starting to affect Holder’s composure, as a U.S. Federal Court in D.C. recently ruled he would likely be forced to turn over the Fast and Furious documents in the near future, which may well be incriminating.

A DOJ source told the Daily Mail:

‘Look, the attorney general isn’t afraid of a few protesters,’ the DOJ source said. ‘But you have to understand that it’s legacy building time around here, and no one wants him to get a reputation as the guy who brought chaos to a police ceremony.’

‘He’s the nation’s top law enforcement officer. What kind of message would that send? And it could have been a PR disaster for the president.’

Eric Holder Now Funding Attorneys to Help Illegal Aliens Avoid Deportation

By Brian Hayes on June 6, 2014

Yes, that headline is real. You have not gone insane, although we wouldn’t be surprised if you did, given the utter lawlessness of this administration.

Texas is being overrun by illegal aliens at the highest rates in U.S. history. More than 47,000 unaccompanied minors have been caught in the first five months of this year, a 92% increase over the same time period in 2013 . Obama is also dumping thousands of those illegals into Arizona, as payback for the crackdown on illegals by Gov. Jan Brewer and Sheriff Joe Arpaio. http://townhall.com/tipsheet/katiepavlich/2014/06/04/jan-brewer-on-border-crisis-n1847660

The Obama Administration is working hand-in-hand with Central American governments to engineer this deliberate, unprecedented invasion of illegal aliens. La Raza groups are spreading the word that Obama will sign administrative amnesty. http://dailycaller.com/2014/06/02/obama-offers-mini-amnesty-to-200000-kids-by-2016/ And nations like El Salvador and Honduras are urging women and children to make the grueling trek to cross the U.S. border, http://www.breitbart.com/Breitbart-Texas/2014/06/05/Go-to-America-with-Your-Child-You-Wont-Get-Turned-Away because Obama will never deport them, and they can receive jobs and taxpayer-funded welfare for life.

Obama has requested $2 billion — not to deport the illegals from this unprecedented invasion — but to house, clothe and feed them, and even deliver them to relatives already here illegally, so they can stay here indefinitely. http://www.foxnews.com/politics/2014/06/03/white-house-seeks-extra-14b-to-address-surge-in-children-crossing-southern/

And now Eric Holder, who is supposed to be the highest law enforcement official in America, is unleashing a new lawless program to actually provide taxpayer-funded lawyers to these invading illegals — to make sure they will never be deported by an immigration judge. And Holder is grabbing $2 million of a $315 million fund that is supposed to help secure the border, not make a mockery of border security.

From USAToday: http://www.usatoday.com/story/news/politics/2014/06/06/obama-immigration-lawyers-children-border/10060725/

Attorney General Eric Holder on Friday announced a new program aimed at ensuring that illegal immigrant children who cross into the U.S. without a parent or guardian have legal representation in the United States.

Holder announced an initiative called “Justice AmeriCorps,” a grant program to fund lawyers and paralegals and provide legal services to these children. Holder said it’s a response to Congress’ request that the Justice Department “better serve vulnerable populations such as children and improve court efficiency through pilot efforts aimed at improving legal representation.”

Holder’s move was likely to be seen by Republicans as another possible incentive for more illegal children to try entering the country. One Republican aide reiterated past GOP complaints that the Obama administration often appears willing to help non-U.S. citizens more than it wants to help citizens.

“Why doesn’t the Obama administration hire lawyers for the American citizens who are losing their jobs?” he said.

But the Administration says they need to defend a “vulnerable” population from “discrimination” based on their immigration status.

This is treason, plain and simple.

In a sane nation, Obama and Holder would be doing a perp walk right now on their way into a Federal courthouse. But as radio legend Mark Levin has described it, we are now living in a “post-Constitutional America“, and no one will dare stand up to this lawless president no matter what he does. http://cnsnews.com/news/article/exclusive-mark-levin-ameritopia-we-now-live-post-constitutional-country

And time is running out. What Obama and Holder are doing will change the fabric of this nation, forever.

No, Mr. Holder, This Has Nothing to Do With Race
By David Limbaugh July 15, 2014

Attorney General Eric Holder once again played the race card -- this time on national television, in an interview on ABC's "This Week," claiming that he and President Obama have been targets of "a racial animus" by some of the administration's political opponents.

"There's a certain level of vehemence, it seems to me, that's directed at me (and) directed at the president," said Holder. "You know, people talk about taking their country back. ... There's a certain racial component to this for some people. I don't think this is the thing that is a main driver, but for some, there's a racial animus." Reminded of his comments during Obama's first year as president that the U.S. is a "nation of cowards" on race, he refused to back down.

At this point, I don't know whether we're seeing the outworking of the gigantic racial chips on Holder's and Obama's shoulders or we're seeing just another despicable example of the two engaging in community organizing by branding their political opponents as racists.

These two have continually engaged in the politics of division, alienating Americans against one another on the basis of race, gender, age, religion, geography, income and every other conceivably exploitable category. By portraying themselves as victims and conservatives as bigots, they seek to intimidate conservatives from pursuing their agenda, divert attention from their own policy failures and keep the pot stirred on imaginary problems as cover to advance the remainder of their unpopular statist agenda.

Sorry, Mr. Holder, but it seems that we talk about race all the time and that you and President Obama just won't let it go. If there is cowardice on this issue, it's from those who refuse to let their actions speak for themselves and insist on injecting false allegations of racism into the mix to vilify opponents and avoid a discussion on serious issues.

These accusations are irresponsible and destructive to the national fabric. It is a great disservice to minorities, non-minorities and the national interest if we can't discuss the damaging effects of President Obama's policy agenda without fear of being accused of one of the most reputation-shattering offenses that exist.

When we talk about taking America back, we mean that quite literally. Though I can't formally speak for others, I can tell you that millions of people correctly believe (based on Obama's promises to fundamentally transform America, his partial fulfillment of that promise and his obsession with completing its fulfillment) that America is in a rapid, dangerous decline -- a decline that must be reversed, lest America be forever changed into something the Founding Fathers never envisioned.

President Obama openly derides the notion of American exceptionalism. He has constantly apologized for America's alleged transgressions. He "writes us up" before the United Nations, complaining to Third World anti-American, civil-rights-abusing nations that we are the ones who have an egregious record on civil rights.

Under his administration, we are witnessing the deliberate decline of our military and defense capabilities at the precise time that his policies are empowering global terrorism and Middle Eastern unrest and making a stronger, not weaker, military more imperative.

He is undermining Israel, our main ally in the region, impairing Israel's essential effort to rally international support for its right to defend itself against unprovoked Islamic violence and aggression.

He is orchestrating the false narrative of a Republican war on women, which is based on a series of lies and distortions so preposterous that it would be dismissed outright if someone in his position were not fueling it. The only war being waged on this issue is by his administration, and it's a war against the religious freedom and conscience of Christians.

He is also waging war against the American dream, discouraging self-reliance and promoting government dependency and the metastatic expansion of the welfare state, which is deeply harming the people it purports to assist. No nation, even America, can remain great if people are encouraged to see themselves as victims, to shun industriousness and to blame others for their plight.

Under his rule, more people are out of work than ever before in our history, and his economic policies -- because they are anti-business, anti-capitalism and punitive of success -- are making matters worse.

His administration has unleashed administrative agencies, such as the Environmental Protection Agency, to further harass and harm businesses in the name of environmentalism, and he is destroying the greatest health care system in history.

The president lies to our faces with liberal media protection and impunity, on vitally important issues such as Obamacare, Benghazi, Fast and Furious, immigration, voter identification, Iraq, the Department of Veterans Affairs, guns, life, "contraception," the economy, the border invasion, the Internal Revenue Service scandal, and -- yes -- race.

Obama is presiding over the least transparent administration ever, grossly usurping legislative authority and driving this nation into guaranteed bankruptcy; it's only a matter of time.

Yes, we must take the country back before it's irretrievably lost. But what worries me more than Obama, Holder and the rest of this administration is that Americans re-elected him and far too few fully realize the danger his policies pose to our prosperity and our liberty.

No, Mr. Holder, we conservatives do not talk in code. This isn't about race; it's about restoring the American dream. We genuinely pray that we can take our country back and begin the long road to healing and reigniting America's most exceptional greatness.

sorry mr holder but my violin strings are all broken. if this country was as racist (white vs black) as he believes, why did O get elected president since population wise blacks are a smaller percentage than white? how did he get to be AG and previously a judge? if white were all racists as he seems to portray then why did Ronald Reagan (a white man) appoint him in 1988 to serve as a judge for the Superior Court of the District of Columbia or why was he appointed United States Attorney for the District of Columbia by President Bill Clinton (another white man)? when a black kills a black in chicago, which seems to be a daily occurrence, which one does holder call a racist? why does he have a nicer home than many whites? Does he have privileges that whites do not have? why did he get zimmerman (who he and o thought was white) get charged and tried despite the fact the police did not have the evidence to arrest him? too many people scream racist who themselves are racists. how about defending americans and not supporting those who have illegally come into this country? he should spend more time following the constition, the whole constitution, and be fighting for the rights of all Americans over those who have broken our laws. It is the good that is inside a person and not the color on the outside! he should stop complaining - reminds me of the person who complains they have a pain in their leg to a person without legs...............................Mr Holder, stand up for the American people no matter what their race, gender or original nationality and treat them all equally...without excuses or exceptions

Eric Holder Makes a Startling Admission That Will Surprise No One
August 4, 2014 By Jennifer Burke

The Left typically feigns outrage when progressive judges are accused of using their bench and wielding their power for activism. But, when you have progressive Supreme Court justices come out as anti-Second Amendment, then the labeling of activism seems quite fitting, if not lighter in tone than required. But, Obama’s Attorney General Eric Holder, the first sitting Attorney General in history to be held in contempt of Congress, said that he proudly uses his possession of power for activism.

During an interview in The Hill with Juan Williams, who recently and erroneously attacked the entire Tea Party movement as all white, old, racists, Holder not only said that he proudly wears the label of activist, but also had some interesting words regarding his role as Attorney General. http://thehill.com/opinion/juan-williams/214174-juan-williams-holder-exclusive-proud-to-be-an-activist

“If you want to call me an activist attorney general, I will proudly accept that label,” he said. “Any attorney general who is not an activist is not doing his or her job. The responsibility of the attorney general is to change things [and] bring us closer to the ideals expressed in our founding documents.”

Later, he defiantly added that critics who say his department includes an “activist civil rights division and this is an activist attorney general — I’d say I agree with you 1000 percent and [I am] proud of it.”

Below is the description of the creation of the Office of the Attorney General as well as the role the Attorney General plays in government taken directly from the Justice Department’s website. http://www.justice.gov/ag/about-oag.html

The Judiciary Act of 1789 created the Office of the Attorney General which evolved over the years into the head of the Department of Justice and chief law enforcement officer of the Federal Government. The Attorney General represents the United States in legal matters generally and gives advice and opinions to the President and to the heads of the executive departments of the Government when so requested. In matters of exceptional gravity or importance the Attorney General appears in person before the Supreme Court. Since the 1870 Act that established the Department of Justice as an executive department of the government of the United States, the Attorney General has guided the world’s largest law office and the central agency for enforcement of federal laws.

In other words, the role of the Attorney General is to uphold the law, not to pick and choose which laws they will defend and follow with a litmus test being whether it falls in line with progressive ideology as Eric Holder’s office has done.

It is also striking that Holder would state that his role is to bring us closer to the ideals expressed in our founding documents which Barack Obama has played the role of activist as well in ignoring those founding documents in his fundamental transformation of America. If Holder were truly concerned the system of government as set forth by our Founders, would he not pursue impeachment proceedings against the president or investigate the numerous instances of abuse of power or corruption within the Obama regime?

But, at least Holder is admitting what many have stated all along. Rather than act as he should as the lead attorney for America, he has worked as an activist and as Barack Obama’s personal attorney, doing his bidding and abusing his power to push the progressive agenda.
Perhaps we should not be surprised at Holder proudly wearing the label of activist 1000% and distorting his role of Attorney General in the process. After all, he did participate in an armed takeover of the ROTC office at Columbia University and his law firm defended terrorists who attacked and killed American citizens. When you look at his history, some may think the word activist is not a strong enough word to describe his actions and agenda.

Accidental Phone Call Made by Holder Aide Proves Collusion Between DOJ and Dems in IRS Scandal
September 9, 2014 By Jennifer Burke

There has been documented evidence of Democrat collusion with the IRS to hamper the House Oversight Committee’s investigation into the targeting, harassment, and intimidation of the pro-freedom, pro-Constitution Tea Party movement. TPNN reported on emails that revealed such illegal antics in both April and May of this year. Now, thanks to an misdeal by a senior communications aide to activist Attorney General Eric Holder, collusion between the Justice Department and Democrats has been uncovered.

House Oversight Committee Chair Darrell Issa sent a letter to Holder on September 8 detailing the phone call his office received from Brian Fallon, who is also a former senior aide to Democrat Chuck Schumer. While the letter did not identify Fallon, he did admit that he made the call.

Breitbart reports that Issa believes the call was erroneously made to his office, and Fallon was actually attempting to contact the office of the Democratic ranking member of the committee, Elijah Cummings. http://www.breitbart.com/Big-Government/2014/09/09/Letter-Holder-Aide-Accidentally-Calls-Issa-For-Help-Spinning-IRS-Scandal

Cummings has been accused in the past of using his position to obfuscate the investigation into the IRS in order to hinder the investigation. http://www.tpnn.com/2014/03/15/issa-cummings-is-an-obstacle-to-congressional-oversight-in-obama-irs-probe/

While Cummings has denied playing such a role, documented evidence was found that proves that he was working in collusion with the IRS to target certain Tea Party and conservative groups. http://www.tpnn.com/2014/04/10/true-the-vote-to-democrat-rep-cummings-no-more-lies-mr-cummings-tell-america-the-truth/

According to the letter, Fallon – who is not named in the letter but confirmed he made the call – asked if the aides could release the IRS scandal documents to “selected reporters” to give Fallon an “opportunity to comment publicly on it.”

Fallon explained to Issa aides that the Justice Department’s Office of Legislative Affairs had not permitted him to release the documents to the public and he wanted to get ahead of the story “before the Majority” – meaning Issa – could share it, according to the letter.

Issa aides – who had placed the call on speakerphone – were “caught off guard by the unusual nature of the call and the odd request” and asked Fallon to “e-mail the material for evaluation.”

“At this point,” Fallon “abruptly placed the call on hold for approximately three minutes.” When Fallon returned to the call, “he was audibly shaken. He immediately stated that there was a ‘change in plans’ and that there would be no effort” by DOJ to release the material early.

This practice is known as ‘document dumping’ and happens often on a Friday evening. It is an attempt to get information leaked to the media before it is addressed or presented in a committee hearing so that the party in question can, “get ahead of it” and lessen any potential political damage.

Though admitting he made the call, Fallon denies any nefarious intentions claiming in a written statement that “There is nothing inappropriate about department staff having conversations with both the majority and minority staff as they prepare responses to formal inquiries. That includes conversations between the spokespeople for the Department and the committee.”

Issa vehemently denies such a purpose to the call.

The letter referred to a “subsequent explanation” from Fallon that “he simply called to improve the Office of Public Affairs’ working relationship with the Committee” but said the explanation “is inconsistent with statements and requests he made before he placed the call on hold.”

“It stains credulity to believe that the Department would seek to begin to improve relations via a telephone call between two individuals who had never spoken to each other before at 5:01pm on a Friday afternoon at the end of a District Work Period in the waning days of the 113th Congress,” Issa wrote.

Issa said he is “disturbed” by the “apparently longstanding collaboration between the Obama administration and Ranking Member Cummings’ staff to obfuscate and prejudice the Committee’s work through under the table coordination.”

Report: Attorney General Eric Holder to Announce His Resignation
Sep. 25, 2014 10:49am Jason Howerton

S. Attorney General Eric Holder will reportedly announce his resignation on Thursday after heading the Justice Department for six years.

Citing two sources “familiar with the situation,” NPR reports that Holder will exit the U.S. Department of Justice as soon as his replacement is confirmed, though the process could potentially drag out into 2015. http://www.npr.org/blogs/thetwo-way/2014/09/25/351363171/eric-holder-to-step-down-as-attorney-general

A White House official says President Barack Obama will announce Holder’s departure later Thursday. Holder is the first black attorney general, and his tenure is the fourth longest on the job.

But Holder’s tenure as the nation’s top law enforcement officer is filled with controversy. Holder, 63, faced harsh criticism for his involvement in the Fast and Furious gun-walking scandal, an operation that allowed thousands of guns to cross into Mexico only to be lost and end up in the hands of Mexican drug cartels.

Congress later voted to hold Holder in contempt over his withholding of Fast and Furious documents.

The DOJ also came under fire over its probe of classified leaks. The department investigated Fox News reporter James Rosen, naming him a “co-conspirator” for reporting based on the account of a government source.

Holder, one of the longest serving members of the Obama administration, has reportedly been “adamant” about leaving the Justice Department before the end of President Barack Obama’s second term.

More from the NPR report:

Holder most wants to be remembered for his record on civil rights: refusing to defend a law that defined marriage as between one man and one woman; suing North Carolina and Texas over voting restrictions that disproportionately affect minorities and the elderly; launching 20 investigations of abuses by local police departments; and using his bully pulpit to lobby Congress to reduce prison sentences for non-violent drug crimes. Many of those sentences disproportionately hurt minority communities.

And then, there’s his relationship with Congress. From the day Holder’s nomination was announced, Republicans led by Sen. Mitch McConnell, R-Ky., signaled he would be a political lightning rod.

The attorney general’s portfolio, which spans sensitive law enforcement cases and hot button social issues including marijuana and gay marriage, didn’t help. But even longtime aides say Holder didn’t do enough to help himself by shrugging off preparations and moot sessions before congressional appearances and speaking off the cuff — and obliquely.

Holder reportedly informed his DOJ staff at some members of Congress on Thursday morning about his decision to resign. He has not revealed what his future plans hold.

Solicitor General Don Verrilli is believed to be a leading candidate to succeed Holder as attorney general.

Eric Holder Resigning as Attorney General
By MATT APUZZOSEPT. 25, 2014

WASHINGTON — Attorney General Eric H. Holder Jr. will resign his post, the Justice Department said Thursday. Mr. Holder will remain in office until a successor is nominated and confirmed.

Mr. Holder, the 82nd attorney general and the first African-American to serve in that position, had previously said he planned to leave office by the end of this year. Particularly in President Obama’s second term, Mr. Holder has been the most prominent liberal voice of the administration.

The Justice Department said Mr. Holder finalized his plans to leave in an hour long conversation with Mr. Obama at the White House over Labor Day weekend.

The injustice of Eric Holder
Average Americans aren’t blind to the Justice Department’s politicization
By John Fund and Hans von Spakovsky - - Tuesday, September 16, 2014

Even we were shocked when we researched our new book, “Obama’s Enforcer: Eric Holder’s Justice Department,” at the extent to which Attorney General Eric Holder Jr. has politicized the Justice Department and put the interests of left-wing ideology and his political party ahead of the fair and impartial administration of justice. However, there is no doubt that the American public has also recognized just how politically corrupt Mr. Holder is, given this month’s very embarrassing poll conducted by Hart Research for NBC News and The Wall Street Journal.

The poll asked respondents their opinions about 10 different national political officials, ranging from Bill Clinton to President Obama to Eric Holder, as well as the Democratic and Republican parties. They were given choices of very positive, somewhat positive, neutral, somewhat negative, very negative and “don’t know the name.” About a third of respondents didn’t know who Mr. Holder is (37 percent). However, those Americans who knew Mr. Holder gave him the second-lowest “positive” rating of anyone or any organization on the survey at a mere 15 percent. Only Arizona Sheriff Joe Arpaio had a lower “positive” rating than Mr. Holder. The attorney general’s “positive” rating was less than half of the positive rating of the Republican Party and 27 points behind that of his boss, Mr. Obama, who was rated favorably by only 42 percent of respondents.

Mr. Holder’s combined “negative” rating of 32 percent was higher than that of Mr. Clinton, Sen. Marco Rubio, Sheriff Arpaio and Sen. Rand Paul. In fact, the poll balanced the total positive feelings survey participants had against the total negative feelings to figure out what the participants as a whole thought of each of the politicians in the poll. Mr. Holder, at 17 points, had the highest negative gap of any individual in the survey — only the Tea Party had a higher negativity gap at 23 points.

Contrary to what liberal elites think, the average American isn’t dumb and can see when someone is abusing his office and allowing politics to drive his decision-making. They may think they can fool the American people, but that is a mistake that many arrogant politicians and government officials have made in the past, and Mr. Holder is just another in a long line of such government officials. From his misbehavior in everything from the New Black Panther voter-intimidation case to Operation Fast and Furious to the IRS targeting scandal, Mr. Holder has shown the public why he is the first and only attorney general in our history to be held in contempt by the House of Representatives.

As a longtime, current employee of the Justice Department told us, Mr. Holder and his subordinates have “racialized and radicalized” the department “to the point of corruption.” They have “embedded politically leftist extremists in the career ranks who have an agenda that does not comport with equal protection or the rule of law; who believe that the ends justify the means; and who behave unprofessionally and unethically. Their policy is to intimidate and threaten employees who do not agree with their politics, and even moderate Democrats have left the department, because they were treated as enemies by administration officials and their lackeys. Another black employee who has worked for the Justice Department for decades said to me, ‘There is no justice left in Justice under this administration.’”

As this poll demonstrates, the American people recognize that Mr. Holder is an ideologue who considers himself part of Mr. Obama’s political team first and the attorney general a very distant second. His first loyalty has been to helping the president break, bend, ignore or fail to enforce the law, doing untold damage to our constitutional system and the rule of law.

he just recently stated he feared cops which as the doj makes a person wonder. he has also thrown the race card wherever he could and did not seem to have a conscience that he was putting a person on trial because of their non-black race or defending a person not on fact but on race. he has been cited for contempt (first ag to be so cited), he proudly announced he is an activist which as doj basically says he is one sided, fast and furious has been credited to him even though he claimed to know nothing but did nothing about the fact that a government employee was murdered. he has said he will only follow the parts of the constitution that he wants to which is imho unjust and anti-america. I almost forgot to mention he says he is afraid of cops.....i wonder why..................especially since for all intensive purposes he is over them

the big question now will be who will O put there to replace him? a muslim terrorist? I think a person who is willing to follow our constitution, enforce it and treat people equally where they will not be based on age, gender, political party or race is a start. They themselves would have to be law abiding.............

Citing two sources “familiar with the situation,” NPR reports that Holder will exit the U.S. Department of Justice as soon as his replacement is confirmed, though the process could potentially drag out into 2015.

So ... he is going to resign .... as soon as he is good and ready.
If the Dems lose the Senate ... who will BO put in Holder's place.
If the Dems carry the elections ... BO will find no suitable replacement and Holder remains ?

Obama accepts Holder resignation, praises record
1 min ago | By NEDRA PICKLER and JIM KUHNHENN of Associated Press

WASHINGTON (AP) — President Barack Obama is accepting the resignation of Attorney General Eric Holder and praising him for his deep commitment to ensuring all Americans receive equal justice under the law.

The president said during an East Room ceremony that it was a "bittersweet moment" to accept Holder's resignation after six years on the job. But he added that he was glad Holder would stay on until a successor is confirmed.

Obama praised Holder for his track record in a variety of areas, especially for reinvigorating the defense of civil rights.

Holder, for his part, said he was proud of what the department had accomplished but said that work remains to be done.

This is a breaking news update. Check back later for more.

EARLIER STORY: WASHINGTON (AP) — Eric Holder, who served as the public face of the Obama administration's legal fight against terrorism and weighed in on issues of racial fairness, is resigning after six years on the job. He is the nation's first black attorney general.

The White House said that President Barack Obama would announce Holder's departure later Thursday and that Holder planned to remain at the Justice Department until his successor was in place. White House officials said Obama had not made a final decision on a replacement for Holder, who was one of the most progressive voices in his Cabinet.

Advisers to Obama and Holder said the attorney general had been planning his departure with the president for some time. Some possible candidates who have been discussed among administration officials include Solicitor General Don Verrilli, California Attorney General Kamala Harris, Massachusetts Gov. Deval Patrick, Deputy U.S. Attorney General James Cole and Sen. Sheldon Whitehouse, a former Rhode Island attorney general.

Holder, a 63-year-old former judge and prosecutor, took office in early 2009 as the U.S. government grappled with the worst financial crisis in decades and with divisive questions on the handling of captured terrorism suspects, issues that helped shape his tenure as the country's top law enforcement official. He is the fourth-longest serving attorney general in U.S. history.

He also took on questions of racial fairness, working to improve police relations with minorities, enforce civil rights laws and remove disparities in sentencing. Most recently he became the Obama administration's point man in the federal response to the police shooting last month of Michael Brown, an unarmed black 18-year-old in Ferguson, Missouri. In the shooting's aftermath, he enlisted a team of criminal justice researchers to study possible racial bias in law enforcement.

The news of Holder's resignation came as civil rights leaders and the families of Brown and Eric Garner, who died in a New York City police chokehold this summer, were appearing at a news conference in Washington calling on the Justice Department to take over investigations into the deaths.

The Rev. Al Sharpton urged the White House to meet with civil rights representatives before appointing a replacement. "There has not been an attorney general with a civil rights record equal to Attorney General Eric Holder," Sharpton said.

In his first few years on the job, Holder endured a succession of controversies over, among other things, an ultimately abandoned plan to try terrorism suspects in New York City, a botched gun-running probe along the Southwest border that prompted Republican calls for his resignation, and what was seen as failure to hold banks accountable for the economic near-meltdown.

But he stayed on after Obama won re-election, turning in his final stretch to issues that he said were personally important to him. He promoted voting rights and legal benefits for same-sex couples and pushed for changes to a criminal justice system that he said meted out punishment disproportionately to minorities.

Stung by criticism that the department hadn't been aggressive enough in targeting financial misconduct, Holder in the past year and a half secured criminal guilty pleas from two foreign banks and multibillion-dollar civil settlements with American banks arising from the sale of toxic mortgage-backed securities. Even then, critics noted that no individuals were held accountable.

A former deputy attorney general in the Clinton administration, Holder was pulled away from private practice to reshape a Justice Department that had been tarnished by a scandal involving fired U.S. attorneys and that had authorized harsh interrogation methods for terrorism suspects.

He immediately signaled a new direction for the incoming administration by declaring that waterboarding was torture, contrary to the George W. Bush administration's insistence that it wasn't.

In the first year of his tenure, Holder was widely criticized by Republicans and some Democrats for his plan to try professed Sept. 11 mastermind Khalid Sheikh Mohammed and other alleged co-conspirators in New York. The plan was doomed by political opposition to granting civilian criminal trials to terrorist suspects, who arguably would have had greater legal protections in civilian courts than in military commissions. The attorney general gave up the effort, but he continued to maintain that civilian courts were the most appropriate venue. He argued that his original plan was vindicated by the successful prosecution in New York of Osama bin Laden's son-in-law.

Under his watch, the Justice Department cracked down on news media reporting on national security matters. The department secretly subpoenaed phone records from Associated Press reporters and editors and used a search warrant to obtain some emails of a Fox News journalist as part of a separate leak investigation.

On matters of policy, Holder spoke frankly about how his upbringing — his father emigrated from Barbados and his sister-in-law helped integrate the University of Alabama — helped shape his thinking. He referred to America in 2010 as a "nation of cowards" in its discussions of race. He later lamented that "systemic and unwarranted racial disparities remain disturbingly common."

Al Sharpton: I’m Helping Obama Pick Eric Holder’s Replacement
by Tina Nguyen | 4:18 pm, September 25th, 2014

In a newly-released statement, Al Sharpton announced that he and his organization, the National Action Network, were “engaged in immediate conversations with the White House on deliberations over a successor whom we hope will continue in the general direction of Attorney General [Eric] Holder.”

To be clear, as he told BusinessInsider, he’s not actually picking picking the next candidate for Attorney General. “We did not say we are in the decision making,” he told them in an update. “We are in conversation to reach out to them to have meetings about what we want to see in a successor.”

In his statement, Sharpton called the outgoing AG’s tenure “more than exemplary,” and he was “proud [but] disappointed” to hear about his resignation, initially reported earlier this year.

“We are proud that he has been the best Attorney General on civil rights in U.S. history and disappointed because he leaves at a critical time when we need his continued diligence most,” Sharpton said, citing his work in the Ferguson shooting aftermath, upholding voter rights, and curbing an excessive use of police force. ” Policing of Americans is the critical challenge of today, especially Blacks and Browns in particular,” he added. We will aggressively pursue the Justice Department’s involvement in dealing with these matters in his remaining days and in the days ahead of his successor.”

Sharpton hosts a nightly political talk show on MSNBC.

If Rush Limbaugh’s Thoughts on Holder’s Resignation Turn out to be True, America is in Big Trouble
September 25, 2014 By Jennifer Burke

There have been calls for the ousting of Eric Holder, activist attorney general who operates more like Obama’s personal lawyer, from office for quite some time. His tenure has been plagued with scandal after scandal and Holder’s defiant attitude is not what one would expect from the man who is supposed to represent America and the constitutional best interests of American citizens. As the first sitting Attorney General to be held in contempt of Congress, Holder has obstructed justice and, when he sought to get justice, it was selectively applied depending upon ethnicity.

"There may be a Supreme Court vacancy --
and I can see Barack Obama nominating Eric Holder to fill it."

- Rush LImbaugh

11:12 AM - 25 Sep 2014

We already know what Holder thinks of the Constitution. He has no respect for it as is evidenced by his words and actions. After all, he is an attorney general who as a college student participated in the armed takeover of an ROTC office with the demand that the name of the office be changed to black activist and Civil Rights leader Malcolm X.

The possibility of Holder being nominated is scary enough. But, would there even be a chance that he would get confirmed, especially if Republicans took control of the Senate? Let’s put it this way. unprincipled Republicans stood with Democrats in confirming a radical Marxist and self-admitted activist as Attorney General. If he ever obtained a seat on the Supreme Court, America as we know it, or shall I saw as we remember it before Barack Obama’s destruction, will be in even more dire straits.

I know people of all races, all religions and all nationalities. they are all well educated whether by books and/or experience. one thing we all have in common is a love of our country and grave concern as to what america is becoming. right is now wrong and wrong is now right. there is disrespect for our laws not just from the people around us but from higher up in government. one person said to me that having a person like al sharpton as a representative of blacks, makes them angry (they used stronger language) and embarrassed that someone just because they are black would take his word for anything. no one should follow anyone just because they are the same race, gender nationality and believe their words are gospel. Prejudice creates a weakness, stunts a person's growth because some people are more focused on this than improving their own lives. having a chip on your shoulder can be a heavy burden - we all have some because we can say...if only i was taller, shorter, fatter, thinner, prettier, more handsome...but a successful person can work beyond this chip and make up for any short coming we believe we have. By holder's actions, i think he still has a bolder that he carries around and has found himself in a powerful position to strike back at those he feels has made him feel bad about himself. he even had warning for his own son regarding martin/zimmerman http://news.investors.com/ibd-editorials/071813-664295-justice-report-black-youths-commit-quarter-murders.htm#axzz3EQsMcsck we live in a troubling world and imho we do not need those in power in our government to fan flames where there are none.

Obama picks Brooklyn prosecutor Lynch for attorney general
Reuters By Aruna Viswanatha and Roberta Rampton 17 mins ago

President Barack Obama will nominate Brooklyn federal prosecutor Loretta Lynch to replace the retiring Eric Holder as U.S. attorney general and if confirmed, she would become the first black woman to serve in the post, the White House said on Friday.

The 55-year-old North Carolina native and Harvard-trained lawyer has deep experience in both civil rights and corporate fraud cases. Lynch is known for a low-key personality and stirred little controversy during two tenures as U.S. Attorney for the Eastern District of New York.

Her nomination requires Senate confirmation. The Senate twice previously has voted to confirm her to federal prosecutor jobs, the last time in 2010.

In a statement, White House spokesman Josh Earnest called Lynch "a strong, independent prosecutor" and said Obama would formally announce her nomination to be the nation's top law enforcement official at an event in the White House Roosevelt Room on Saturday.

Obama, the first black U.S. president, named Holder as the first black attorney general in 2009. Holder announced in September that he would resign. With Holder leaving after six years on the job, Obama picked Lynch, who is not a member of the president's inner circle, as the first black woman for the job.

Sources close to the Obama administration said they expect Lynch will generate little controversy, making for a smooth Senate confirmation process.
The top Republican on the Senate Judiciary Committee, Chuck Grassley, said she will "will receive a very fair, but thorough, vetting" by the panel. "I'm hopeful that her tenure, if confirmed, will restore confidence in the Attorney General as a politically independent voice for the American people," Grassley said.

Her nomination would be one of the first big changes for Obama to announce after Republicans won control of the Senate in congressional elections on Tuesday. Lynch was one of several candidates Holder had recommended to succeed him.

Lynch emerged as a leading contender after a previous top choice, former White House counsel Kathryn Ruemmler, pulled out of consideration amid concerns her involvement in controversial Obama administration decisions could complicate her confirmation.

Holder, one of Obama's closest allies, has had a rocky tenure as attorney general. He clashed frequently with congressional Republicans over gun control, same-sex marriage, and a desire to try terrorism suspects in civilian instead of military courts.

In one 2011 email released earlier this week, Holder referred to Republican members of the House Oversight Committee chaired by Darrell Issa as "Issa and his idiot cronies."

Lynch, born in Greensboro, North Carolina, Lynch earned her college and law degrees at Harvard, worked in the Brooklyn U.S. Attorney's office between 1990 and 2001, and served in the top post from 1999-2001 and since 2010.

She developed a close relationship with Holder through her work on the attorney general's advisory committee, which she has chaired since the beginning of 2013.

In her first stint in the U.S. Attorney's office she worked on the prosecution of New York police officers who were convicted in connection with the torture of Haitian immigrant Abner Louima, an incident that became a national symbol for police brutality.

More recently, her office has brought several high-profile cases, including the indictment, in April, of Republican U.S. Representative Michael Grimm for fraud.

Her office has worked closely with Justice Department headquarters on several big corporate fraud cases, and helped investigate Citigroup Inc (C.N) over shoddy mortgage securities the bank sold, which led the bank to enter into a $7 billion settlement in July.

Lynch's office also was involved in the December 2012 $1.2 billion accord with HSBC (HSBA.L) over the bank's lapses in its anti-money laundering controls.

Prosecutors in Brooklyn are also investigating a member of Putin's inner circle, Gennady Timchenko, in connection with an oil trading and money laundering probe.

I would ask her:
1. based on the findings and information, how would she handle the irs scandal since the irs has not been transparent, ignored the courts demands, has held lois lerner in contempt and as of now, is scott free as far as punishment for not following the laws of the land and has made a mockery of the justice system. even the lawyers of the irs have for all intensive purposes defied the law and refused to do as they have been ordered. it is possible that those in the irs have been hiding information that would prove illegal activities. would she seek justice?

2. as more information gets revealed regarding fast and furious, would she seek the truth and if necessary go after eric holder should she find that he was involved in this activity that has cost at least 1 border patrolman his life. along with fast and furious there is also a similar activity involving grenades. would she get to the bottom of these deadly wrong doings?

3. benghazi costs 4 american lives amid cover ups and lies that could lead directly to the white house and shed light on the parts taken by rice, clinton and obama. would she continue the investigation and possible prosecution of those involved in perpetrating lies in order to cover up any duplicity.

4. va executives have been allowed to gracefully exit their positions and even retain their benefits that put the lives of US service members at great risk. could she or would she follow up to see that those who have done wrong, pay for their crimes?

5. generally speaking would she protect those guilty of crimes who hold office in the US of A or would she do the job that she would be sworn to uphold as ag?

personally i hope that she would not follow in the steps of the man she would replace whose egregious acts left american citizens feeling that the position was abused, misused and ignored the Constitution and laws of this country.

Obama’s Attorney General Nominee: Voter ID Laws Are Racist, And Must be Stopped

By Brian Hayes on November 9, 2014

Scalded by their sudden loss of the Senate, the Obama Administration is in full panic mode, trying to confirm as many nominees before Republicans take control of the upper chamber in January and shut this circus down.

One huge appointment is the replacement of disgraced (and potential Federal inmate) Attorney General Eric Holder, who resigned under an unprecedented cloud of scandal last month.

Obama knows that if he waits for a GOP Senate they will crush the new nominee with embarrassing questions about Fast and Furious, the AP and James Rosen spying scandals, and much more. So he is trying to slip in a so-called “moderate” nominee under the radar while Harry Reid still runs the show.

That nominee is Loretta Lynch, a U.S. Attorney in New York, whom the press has helpfully labeled “uncontroversial”, “moderate” and “respected” to present a narrative that she is the anti-Holder.

But a new video has surfaced that shows that Lynch is just as radical as Holder, and just as dangerous to American justice and electoral integrity.

In a speech given in Long Beach earlier this year, Lynch, specifically called out voter ID laws as passed by racist Southerners to deprive Blacks and Hispanics of the right to vote.

Said Lynch:

“50 years after the march on Washington, 50 years after the civil rights movement, we stand in this country at a time when we see people trying to take back so much of what Dr. King fought for. We stand in this country. People try and take over the State House and reverse the goals that have been made in voting in this country.

“But I’m proud to tell you that the Department of Justice has looked at these laws and looked at what’s happening in the Deep South, and in my home state of North Carolina has brought lawsuits against those voting rights changes that seek to limit out ability to stand up and exercise our rights as citizens. And those lawsuits will continue.”

The video was uncovered by Pundit Press. http://thepunditpress.com/2014/11/08/obama-ag-nominee-lynch-voter-id-laws-were-passed-by-racist-southerners-must-be-stopped/

http://www.youtube.com/watch?feature=player_embedded&v=AcH4ZWA1seY

Of course the very idea that voter ID is “racist” or “disenfranchises” anyone is preposterous. Would Lynch prosecute CVS and Walgreens for refusing to sell Sudafed to people without photo ID? Airlines for refusing to board anyone without a photo ID? Liquor and convenience stores for refusing to sell booze or cigarettes to those without ID? Why aren’t those restrictions also racist?

Because everyone knows that minorities have photo IDs too — and can get them for free from states if need be. This has nothing to do with race, and everything to do with facilitating mass voter fraud, the Democrat Party’s ace in the hole.

At the end of her speech, Lynch ridiculously tries to tie her battle to stop voter ID laws to Nelson Mandela. I guess she didn’t get the memo. Mandela supported and put into place strict photo voter ID laws in South Africa.

http://toprightnews.com/wp-content/uploads/2014/10/mandela-vote.jpg

So when you hear about how “moderate” Lynch is from the mainstream media this week, trying to force the Republicans to confirm the “moderate”, “first African-American woman” as Attorney General, forget it. Lynch is just as radical as Holder, and just as dangerous.
