Army wife accused in arson that killed her 2 kids

GAINESVILLE, Ga. (AP) -- An Army wife accused of setting her apartment on fire botched an attempt to collect on her husband's $400,000 insurance policy when he survived and her two children died instead, a federal prosecutor said.

Billi Jo Smallwood, 35, was denied bond at a Friday hearing in northeast Georgia, where she appeared on federal charges of damaging government property by fire.

"She set fire to her own home in hopes of killing her husband and wound up killing her kids," Assistant U.S. Attorney Stephanie Gabay-Smith said.

The May 2007 fire at the Fort Campbell Army post on the Tennessee-Kentucky border killed 9-year-old Sam Fagan, and 2-year-old Rebekah Smallwood.

Smallwood's husband, Army Spc. Wayne Smallwood, crawled out of a second-level window and suffered a leg injury when he jumped. Their toddler daughter, Nevaeh, was not injured.

U.S. Magistrate Susan Cole said she denied bond mostly because Smallwood was a flight risk. The indictment against her was released Tuesday and she appeared in court in northeastern Georgia, where she has family. She will likely be transferred to Kentucky next week for a Dec. 10 arraignment.

"At this point the evidence appears strong against Mrs. Smallwood," the judge said. "It's a heinous crime that's alleged."

Matthew Cummings, a special agent with U.S. Army Criminal Investigations Division, testified that investigators determined gasoline was poured on the floor in the living room of their apartment.

He said Billi Jo Smallwood suffered second- and third-degree burns, but they were consistent with someone who set a fire. He said doors in the home had been locked from the inside and smoke detectors had been removed.

Cummings said the husband had a $400,000 life insurance policy and the investigation showed the couple's relationship was "rocky" and she was "concerned with his abuse of alcohol and drugs."

Just before the fire was set, the couple had returned from a trip to Georgia and had only $17, the agent said. She was aggravated that her husband had gone out earlier in the evening to a VFW club bar.

Smallwood's family members stood and identified themselves to the judge in support of her release on bond. Her husband, accompanied by friends in Army uniforms, stood and said, "My name is Wayne Smallwood and I am here to support my wife."

The prosecutor said Friday that Wayne Smallwood was just released from a county jail where he was in custody on a domestic abuse complaint by his wife.

The accused woman's mother testified that her daughter has been living in Brunswick recently and is active in the church. Her husband and other family members declined comment outside the courtroom but told the accused woman, "We love you, Billi," as she was led away in shackles, sobbing.

This is where we're stationed. It happened a couple of months before we moved here. I can't believe he's supporting his wife after trying to kill him!

Sounds like he was abusive. Maybe he felt partially to blame. But you would think if she wanted to kill him she would have made sure the kids weren't in the apartment first.

But why make sure only 1 of the 3 kids wasn't in the house at the time? Why not all of them?

Makes you wonder if the littlest daghter might not be his. She might have someone on the side. And thats why she wanted to get rid of him and the other kids.

PADUCAH, KY - A judge has ordered a Fort Campbell, KY soldier's wife, whose husband is from Gainesville, held without bond on charges that she set a 2007 fire that killed two of her children.

U.S. District Judge Thomas Russell ruled last week that releasing Billie Jo Smallwood, 35, would pose a danger to the public.

Smallwood's attorneys argued that she should be allowed to live with her sister and mother in Brunswick, GA. Her sister, Jennifer Rotz, testified that Smallwood was a loving parent.

Spc. Wayne Smallwood says investigators' claim that his wife was trying to harm him is absurd. He said his wife saved one child and tried to get back inside to save the others.

The fire occurred at the post on the Kentucky-Tennessee border. Smallwood was arrested in November.

He sounds like a complete idot............MORON! there is clear evidence (gasoline and smoke detector's removed) that she was trying to kill him. he prob does abuse drugs because no one in their right mind would support the killer of their children and attempted murder of themselves.

I don't think that he does drugs -- especially if he is in the service -- they pull numbers monthly...high price to pay at that point...because not only would that be Levenworth time, it would also include the Big Chicken Dinner!!!

well prob not. prob just an abuses alcohol then or is just a ding bat cause i would be wanting her to fry it it were me. burning up my children like that. i would never forgive it let alone support her.

just like Andrea Yate's husband -- he STILL supports her even though she killed his children and they are divorced.

Some could never believe the atrocity of their spouse -- hell look at some of the abusive relationships -- why do women go back to abusers??

Thanks for finding the original thread and thanks to the mod that merged the 2. Saw the update on my local news website and just wanted to update but I'm not good at all with the search. Dont use it enough. LOL

I dont understand why he would support her either. It would be very hard for me to not kill her myself after she killed the children.

There is so much more going on than has been reported in any news. I know them personally, he was in my husband's unit. We had known them for over a year before this happened. This whole thing is even more confusing when you're close to it. Nothing seems to even out at all.
As far as the person who said that they didn't think someone would be on drugs who's in the army, guess again. You'd be surprised how many do. Yea, they do have drug tests, they are so random, some people just play the odds. Some people just don't care.
Bottom line is that this whole thing is beyond sad.

Guess in the Army they don't care as much as in the Navy -- because we were all tested MONTHLY.
