Resolution filed over former airman's lost Wal-Mart job

Associated Press - May 1, 2008 6:14 PM ET

ORLANDO, Fla. (AP) - The federal Justice Department has filed a decree to resolve a suit with Wal-Mart Stores Inc. that it filed on behalf of a former airman.

The suit, filed in March in U.S. District Court in Orlando, claimed the company didn't give Sean Thornton his job back after he was discharged from the military. It claimed Wal-Mart violated the Uniformed Services Employment and Reemployment Rights Act of 1994 by failing to reinstate him as a cashier at an Orange City store after he was discharged.

Under a consent decree the Justice Department filed Thursday, Wal-Mart would be required to pay Thornton $12,000 in back pay, less legally required employee income tax withholding and other statutory employee deductions, according to court documents.

Messages left by The Associated Press with attorneys who worked on the case were not immediately returned.

I worked for Wal-mart for two years and I would scrub someone's toilet before going back there to work. The company is all about money not the customers or the employees. There was alot of common things they did when I was working for them. The more time past the worst they get. I still haven't gotten over them taken that women's settlement from a wreck she was in that left her brain damaged. Wal-mart may have had a legal right to that money in their eyes but not mine. There is no legal or moral right to take someone's money that is suppose to be taking care of that person. I don't care if the insurance was paid through Wal-mart. It was a nasty thing to do. So this story doesn't surprise me. One thing they were famous for was starting a males pay higher then a woman's pay. I know this for a fact. They started this guys pay .40 higher then mine and we were hired for the same position in two departments beside each other he was in boys and mens and I was in infants and girls. I know that fourty cents isn't much but when this jerk always missed at least 5 days out of the month and was always leaving early. He never got wrote up and worked there until he quit. We all had to do his work when he was gone. At the end of my two years I was getting ready to leave because I was having a baby. I was going to work up to when I had the baby and not come back. My assistant and I didn't get along. Out of 5 assistants I had this is they only one I didn't like. Anyway they were trying to make me go to a softline meet for assistants and dept managers, four hours away from home. I was 71/2 months pregnant. My DH and I decided that I shouldn't take the trip. So I went to the store manager and told him that my doctor said I couldn't travel at this time. I had almost a month and a half left to work. My manager said it was ok. He told me that I could watch the store while the other were gone. Of course my assistant got mad because I went to the manager. I only did that because she wastn't in the store that morning and the meeting was the next. She came in later in the day and said since I didn't want to do things the my job required she was going to have to go ahead and post my job. She got really nasty and I got really nasty with her that too. This was not in my nature to get ugly with my bosses. But she really made me angry. I told her to post my damn job because I quit. There is suppose to be a open door policy but not at our store because it was to much back stabbing going on. It was the companies fault because they knew how these store operate and don't care as long as they are getting the money. Anyway I am sorry that I have written a book on this I just hate this company.
