What a nasty letter for a $16.96 debt!

BUFFALO, N.Y. - A collection agency tried to collect a $16.96 debt with an letter that addressed its recipient with a four-letter word for excrement. "Dear S---," began the letter attempting to collect from an old record club membership. The word was spelled out in the letter, which arrived in an envelope addressed to "S--- Face."

"I've never seen anything quite so brazen," said attorney Kenneth Hiller.

He said his client plans to sue Nationwide Collections Inc. of Fort Pierce, Florida, next week. Under U.S. law, debt collectors are not allowed to use profanity to collect a debt, Hiller said, nor are they supposed to threaten legal action over such a small amount.

Nationwide President Phillip McGarvey said the October 2007 letter was automatically generated after his company bought about 350,000 Columbia House accounts. "S--- Face" is the name under which the account was opened and the way the coupon to start the club was filled out, he said.

Hiller's client has signed an affidavit saying he never signed up for the music club membership under that name. "It looks bad to the observer who is not familiar with the industry," acknowledged McGarvey, "but anybody who understands the volume would understand how this could happen. ...You've also got people filling in famous people's names."

If Columbia was STUPID enough to have a policy of filling the order cards without validating them, they deserve to lose out on the fee.

I used to live in an apartment complex, the handyman would fill out all kinds of "club memberships" with fake info to be delivered to empty apartments. Since non eo the packages would fit in the tiny mailboxes, the post office would leave them at the office and he would pick them up when the office manager was out on the grounds. He got fired when they found out but I wonder how much loot he collected ?

I cannot even believe that. And over such a small amount. WTH was the person addressing it thinking?!?!

I doubt they will lose thier job unless they do get sued.
I had a collection company calling about a years old bill
that my husband had with his ex wife. This man ( I will never
forget his name as long as I live) harrased the hell out
of me every damn day for months , several times a day even.
He would cuss at me , yell at me and threaten me.
He told me that it did'nt matter if it was my husbands old
debts that I was responsable for them and he would
hound me untill he got "his" money. I threatend to
record the calls, my husband even got on the phone
one time and warned him. I contacted a lawyer and was
told to take notes and get proof of what this man was doing.
I even called the company he worked for and talked to his
so called supervisor. NOTHING was done to this man even
after being told he was fired. He called again about a year
later , told me his name, who he worked for and the reason
for the call. I in a not so nice manner told him to F himself.
Hung up and had my phone turned off. All I have is my cell
now, If I start to get calls on it, I swear.....


by the way, the debt was legally erased off of my husbands
credit. It no longer can be submitted to be put back on his credit
But.....they can still TRY to collect. Stupid laws dont protect the
general public.
