A pictorial pop quiz for you.

Which of these is a hate crime in America?

A) Submerging a crucifix in a jar of urine.

http://michellemalkin.com/wp/wp-content/uploads/2007/07/pisschrist1.jpg

B) Burning the American flag.

http://michellemalkin.com/wp/wp-content/uploads/2007/07/flagburn1.jpg

C) Putting a Koran in a toilet.

http://michellemalkin.com/wp/wp-content/uploads/2007/07/koranflush.jpg

Each is offensive and tasteless in its own way.

But only one is a hate crime in the eyes of the law — C) — and 23-year-old Stanislav Shmulevich of Brooklyn faces jail time for it. He’s a Pace University student arrested on Friday on hate-crime charges after he threw a Koran in a toilet at Pace University on two separate occasions, according to police.

Hate-crime arrests in Quran desecrations at Pace University
July 27, 2007, 8:33 PM EDT

NEW YORK (AP) _ A 23-year-old man was arrested Friday on hate-crime charges after he threw a Quran in a toilet at Pace University on two separate occasions, police said.

Stanislav Shmulevich of Brooklyn was arrested on charges of criminal mischief and aggravated harassment, both hate crimes, police said. It was unclear if he was a student at the school. A message left at the Shmulevich home was not immediately returned.

The Islamic holy book was found in a toilet at Pace's lower Manhattan campus by a teacher on Oct. 13. A student discovered another book in a toilet on Nov. 21, police said.

Muslim activists had called on Pace University to crack down on hate crimes after the incidents. As a result, the university said it would offer sensitivity training to its students.

The school was accused by Muslim students of not taking the incident seriously enough at first. Pace classified the first desecration of the holy book as an act of vandalism, but university officials later reversed themselves and referred the incident to the New York Police Department's hate crimes unit.

The incidents came amid a spate of vandalism cases with religious or racial overtones at the school. In an earlier incident on Sept. 21, the school reported another copy of the Quran was found in a library toilet, and in October someone scrawled racial slurs on a student's car at the Westchester County satellite campus and on a bathroom wall at the campus in lower Manhattan. Police did not connect Shmulevich to those incidents.

Treatment of the Quran is a sensitive issue for Muslims, who view the book as a sacred object and mistreating it as an offense against God. The religion teaches that the Quran is the direct word of God.

In 2005, Newsweek magazine published and later retracted a story claiming U.S. interrogators at a prison at Guantanamo Bay, Cuba, flushed a copy of the holy book down a toilet. The report sparked deadly demonstrations in Afghanistan and protests throughout the Middle East.

Pace University has 14,000 students on its campuses in New York City and Westchester County.

Messages left for school administrators and for officials with the New York and national chapters of the Council on American-Islamic Relations were not immediately returned Friday evening.

Ibrahim Hooper, a spokesman for the national CAIR office in Washington, D.C., has said the organization receives frequent reports of Quran desecrations in the United States, especially postings on Internet sites, but seldom makes them public.

He said CAIR decided to speak out about the Pace incidents because Muslim students are impacted by the creation of what could be viewed as a hostile campus environment.

Mark Steyn muses about the flushed Koran: http://corner.nationalreview.com/post/?q=NDcwZDliNmU3MWQwYjBlODI3ZTUzZDRiMGIzMTQzM2Y=
“Obviously Mr Shmulevich should have submerged it in his own urine, applied for an NEA grant and offered it to the Whitney Biennial.” ( See : http://en.wikipedia.org/wiki/Piss_Christ )

Actually, no. The NEA would have turned Shmulevich into the police, too. Now, if he had submerged a Bible in urine or coated a Torah in cow dung and submitted it for a federal grant, he’d be sitting pretty–and facing rave New York Times editorials instead of time behind bars. http://query.nytimes.com/gst/fullpage.html?res=9902E5DB173EF93AA1575AC0A96F9582 60

Western discourse must move well beyond condemnation of clumsy acts of disapproval, such as Koran flushing, and their aggressive prosecution under pressure by Muslim avatars of real hatred, and abettors of murderous jihad terrorism, such as CAIR—to more fundamental and unnerving questions: What role do Koranic injunctions themselves—eternal and beyond criticism (least of all by non-Muslims)—play in inciting “criminal mischief and aggravated mischief”, and much more heinous crimes against humanity, including jihad genocide, and the destruction of non-Muslim religious, cultural, and political institutions?

This is how sharia creep multiculturalism is taking over America. It’s okay to put a cross in urine, not okay to put a book in the toilet.

It is George Orwell’s Animal Farm in full force. We are all “equal” but some are more equal than others. Here we have the most intolerant of all ideologies, that imposes submission, enslaves and executes women and homosexuals and kills “apostates” who dare to leave this madness, promotes jihad and mass murder of “infidels” and even its own believers, …Yet our own people just lie down and act like these people truly deserve greater consideration than those whom they victimize. All over the world, innocents are being killed and enslaved and intimidated on a daily basis in the name of the same Koran. It deserves the same respect that its believers show to others. None.

Ask yourselves. If a Bible was trashed in Saudi Arabia what would happen to the people that did it? They would be praised as proper followers of the faith. If they killed a Jew, all the better. Then they would really go to “heaven”. And we give these people these considerations. It is insane on so many levels. Our own people have entered an upside down world.

One simple question … Who did the Koran that was thrown in a toilet belong to? … if it was bought and paid for by, and therefore belonged to, Stanislav Shmulevich then he has the right to do whatever he wants to do with his own property …

If some SOB can purchase and burn the flag of this country and be protected, then someone else should be able to buy a Koran, a Bible, or any other item and do with it as he damned well chooses …

As long as it was his own property I fail to see where there is any kind of a case that meets “hate crime” definitions …

It is George Orwell times ten.

Beating someone to death with the Koran is a hate crime, flushing it isn't.
No more than flushing the Bible would be.

That said I wouldn't do any of the above, but it is all freedom of speech, unless you are doing it with the pure intention of inciting a riot.

Hate crimes (also known as bias crimes) are crimes motivated by bias against an identifiable social group, usually groups defined by race, religion, sexual orientation, disability, ethnicity, nationality, age, gender, gender identity, or political affiliation.

Thank you.

I would see all three as hate crimes then.

I don't see any of them as a hate crime really. Flushing the Koran along with it's owner should be, just flushing the book itself shouldn't. I should be able to flush any book I want.

That said, if they classify that as a 'hate crime' why aren't the others classified as one? Our laws a very messed up.

When my friend, who is black, got stabbed a couple of times by a group of skinheads, they didn't send the hate crimes unit out for that until someone threatened to call a TV station about it.

Putting his own Koran in his own toilet would not have been a problem.

Taking a Koran that belongs to the University and putting it in a toilet is theft, destruction of property, and vandalism.

The same would be true of burning someone else’s flag or submerging someone else’s crucifix in urine.

The worst that should happen is that he pay for the book.

That should be the END OF IT.

On the other hand, since hate crime laws are illegitimate, I object to that aspect of the charges.

He wasn’t charged with theft. He was charged with two felonies, criminal mischief and aggravated harassment. It’s ridiculous.

I am looking forward to reading more about this guy who tossed the Koran into the loo.

Who is he?

Why did he do it?

Were there any witnesses?

Who discovered the Koran in the loo?

Who reported the Koran in the loo?

Who accepted the report and documented the incident?

Who do they report to on campus?

Why did this go from a campus matter to a criminal matter?

Who advised the PU administration on this matter?

At what point in the deliberations about the student’s conduct was this matter removed from a student judicial process (managed by PU’s Student Affairs division)- and who made the decision? -who made the call to enact it? - and who was in charge of the student judicial process?

Who did they report it to?

Is the FBI involved in any ongoing investigations?

Who is prosecuting this case? Who has jurisdiction?

Will the alleged perp be prosecuted by Pace University?

Is there a Muslim Student Association on campus?

Who was the last “speaker” the Muslim Student Association sponsored on campus and what did that speaker exhort Muslim students to do *politically on campus*?

Can it be determined whether or not the alleged perp was acting in defiance of the MSA’s political agenda on campus?

What do Senator Chuck Schumer and Senator Hillary Rodman [sic]Clinton have to say about the state prosecuting jihad on behalf of CAIR?

More than curious....

I think hate crimes serve a purpose, but it's been misconstrued. The only intention was so that people couldn't get out of the crime, by saying it was a crime of passion, it's just been taken too far. Someone shouldn't serve more time for a murder because it's classified as a "hate crime" I don't think anyone is walking around saying "Hey he's a great guy, I think I'll kill him tomorrow."

42 tires slashed at Army recruiting office in Silverdale;
student arrested
By The Associated Press

SILVERDALE — A college student was arrested Sunday in the slashing of 42 tires on 13 government vehicles in an Army recruiting office parking lot, saying he was angry about the war in Iraq, authorities said.

Following a number of calls about a man wearing black and slashing tires, two deputies stopped a 19-year-old college student from Colorado as he tried to run from the lot shortly after midnight Sunday, a Kitsap County sheriff's office report said.

The man put up his hands, dropped a knife and, after being made to lie on the ground and being read his rights, asked, "Is this the time where I can confess?" deputies wrote.

On a portable breath test, his blood alcohol level registered .168, more than twice the legal threshold for intoxication, according to the report.

He told deputies he decided to slash the tires of Army recruiting vehicles because he "hated the military and the government and the war we were in."

He was jailed for investigation of first-degree malicious mischief, a dangerous-weapon violation for the knife and being a minor in possession of alcohol, with bail set at $10,000.

He’ll get a slap on the wrist, and despite his confession of hate, bigotry, and threatened violence against a specific group, he of course won’t be charged with a hate crime.

Now, if he had slashed 42 Korans…

To me a hate crime is a crime inflicted against a person .. not an object. All three of the items mentions are objects. Therefore, no one is being physically hurt.

One person inflicting injury against another who is a different race, religion, ethnicity, etc., is a hate crime.

Must-see: Christopher Hitchens battles CAIR over the case.

From tonight’s Paula Zahn. This one dragged on for 12 minutes so I’ve got to do in two parts. Part one is the main event: arguably the world’s foremost atheist butting heads with CAIR tool extraordinaire Ibrahim Hooper over how, in a world where Ayaan Hirsi Ali needs 24/7 protection and American news bureaus censor their own coverage of the Danish cartoons for fear of stirring up jihad, Hooper can dare suggest that putting a Koran in a toilet is an “act of intimidation.” As you’ll see, his logic is nonsensical on its own terms: he hones in on the difference between destroying one’s own Koran and destroying someone else’s, but that has no bearing on the intimidation factor, particularly where, as here, the Korans in question didn’t belong to Muslims.

Video here. http://www.youtube.com/watch?v=XA5hvZ5xId8&eurl=

Dennis Prager makes a cameo to talk about his column today on Islamophobia. Hooper’s rhetorical parry? Dragging a guy into the conversation who’s not there to defend himself.

First Amendment Implications of Charging a Koran Desecrator Under Hate Crime Laws ...

a few examples:

1. A student steals two copies of the Koran and defaces them. He defecates on one of them. He is arrested by a Muslim detective. What would normally be a misdemeanor prosecution becomes two felonies under hate crime laws.

2. A student steals two copies of L. Ron Hubbard’s “Dianetics” and defaces them. On one of them he writes: “Scientology is a scam, and Scientologists are either crooks or dupes.” He is arrested by a Scientologist detective. What would normally be a misdemeanor prosecution becomes two felonies under hate crime laws.

3. A student steals two copies of ORGION OF THE SPECIES in one he writes EVOLUTION IS A LIE the other he burns and soon atheist wackos AND EVOLUTIONISTS richard dawkins is demanding he get life in prison

The first example is, of course, based on reality. The second is based on a hypothetical designed by Eugene Volokh in this comment. http://volokh.com/posts/1185829677.shtml#250787 The third I just made up.

How does a crime like this become a felony? What are the relevant statutes?

The fact that a Muslim detective arrested him is disturbing. Tribalism at is best/worst. Are we a nation of laws or not? And if we are, why does a highly political operative get to make this arrest?

And if it were a bible being defaced by a muslim and the arresting officer was an evangelical christian ?

I wonder what the ALCU and all the left will do when they help to strengthen the most “intollerant” religion of all - which has a “death sentence” for many of thier prized freedoms - like gay rights, freedom of dissent, liberalism, ect, ect… to the point of no return, and wake up to a real nighmare. They think christians, and conservatives are nightmares - well, they will have a rude awakening one day of what the real nighmare is, as they continue their ignorant ways.

Did any of these libs freak out about “Piss Christ”? Did they get the vapors when artist Michael D’Antuono debuted his painting of a crucified Obama wearing a crown of thorns? Or is that just reserved for Glenn Beck’s artistic expression?

Consistency is hard. But exposing liberal hypocrisy? Easy peasy!

Worth noting: Beck revealed on his program that the “urine” in that mason jar wasn’t actually urine at all. It appears to be — gasp! — beer.

Update:

Beck’s charity auction of “Obama in Pee Pee” has been removed from eBay. His masterpiece’s eBay career may be over, but it lives on in the @ObamaInPeePee Twitter account.

The Coddling of College Hate Crime Hoaxers
By Michelle Malkin • March 6, 2013 08:28 AM

American college campuses are the most fertile grounds for fake hate. They’re marinated in identity politics and packed with self-indulgent, tenured radicals suspended in the 1960s. In the name of enlightenment and tolerance, these institutions of higher learning breed a corrosive culture of left-wing self-victimization. Take my alma mater, Oberlin College. Please.

This week, the famously “progressive” college in Ohio made international headlines when it shut down classes after a series of purported hate crimes. According to the Oberlin Review (a student newspaper I once wrote for), anti-black and anti-gay vandalism/”hate speech” have plagued the campus since Feb. 9.

“‘Whites Only’ was written above a water fountain, ‘N*gger Oven’ was written inside the elevator, and ‘No N*ggers’ was written on a bathroom door” at one dormitory, according to the publication.

Swastikas and epithets were drawn on posters around the school. Activists implied the incidents were tied to Black History Month. The final straw? A menacing presence on campus who allegedly donned a “KKK hood” and robe near the segregated black dormitory known as “Afrikan Heritage House.”

Oberlin President Marvin Krislov and three college deans ostentatiously published an “open letter” announcing the administration’s decision to “suspend formal classes and non-essential activities.” The campus body immediately jumped to conclusions and indulged in collective grievance-mongering. The New York Times, Black Entertainment Television and The Associated Press all piled on with angst-ridden coverage of the puzzling crimes at one of the first U.S. colleges to admit blacks and women.

Oberlin alumna Lena Dunham, a cable TV celebrity who starred in a pro-Obama ad likening her vote for him to losing her virginity, took to Twitter to rally her fellow “Obies.” The Associated Press dutifully reported Dunham’s plea as news: “Hey, Obies, remember the beautiful, inclusive and downright revolutionary history of the place you call home. Protect each other.”

But what the AP public relations team for Dunham and the Oberlin mau-mau-ers didn’t report is the rest of the story. While Blame Righty propagandists bemoaned the frightening persistence of white supremacy in the tiny town of Oberlin, city police told a local reporter that eyewitnesses saw no one in KKK garb — but instead saw a pedestrian wearing a blanket. Yes, the dreaded Assault Blanket of Phantom Bias.

Moreover, after arresting two students involved in the spate of hate messages left around campus, police say “it is unclear if they were motivated by racial hatred or — as has been suggested — were attempting a commentary on free speech.”

Color me unsurprised. The truth is that Oberlin has been a hotbed of dubious hate crime claims, dating back to the late 1980s and 1990s, when I was a student on campus. In 1988, giant signs reading “White Supremacy Rules (Kill All N*ggers)” and “White Supremacy Rules, (F*uck (slashed out and replaced with ‘Kill’) All Minorities)” were hung anonymously at the Student Union building. It has long been suspected that minority students themselves were responsible.

In 1993, a memorial arch on campus dedicated to Oberlin missionaries who died in the Boxer Rebellion was defaced with anti-Asian graffiti. The venomous messages — “Death to Ch*nks Memorial” and “Dead ch*nks, good ch*nks” — led to a paroxysm of protests, administration self-flagellation and sanctimonious resolutions condemning bigotry. But the hate crime was concocted by an Asian-American Oberlin student engaged in the twisted pursuit of raising awareness about hate by faking it, Tawana Brawley-style.

Segregated dorms, segregated graduations and segregated academic departments foster paranoid and selective race-consciousness. While I was on campus, one Asian-American student accused a library worker of racism after the poor staffer asked the grievance-mongering student to lower the blinds where she was studying. Call the Department of Justice!

A black student accused an ice cream shop owner of racism after he told the student she was not allowed to sit at an outside table because she hadn’t purchased any items from his store. Alert the U.N. Commission on Human Rights!

In 2006, I went back to Oberlin to confront the campus with the hate crime hoax phenomenon. As I told students back then, liberals see racism where it doesn’t exist, fabricate it when they can’t find it and ignore it within their own ranks. I documented case after case of phony racism by students and faculty, from Ole Miss to Arizona State to Claremont McKenna, and contrasted it with the vitriolic prejudice that tolerant lefties have for minorities who stray from the political plantation. (You can watch the speech on C-SPAN here.)

The response from “students of color”? They took offense, of course, and characterized my speech as self-hating hate. Just as their coddling faculty and college elders have taught them to do.

I repeat: Mix identity politics, multicultural studies, cowardly administrators and biased media — and you’ve got a toxic recipe for opportunistic hate crime hoaxes. Welcome to high-priced, higher mis-education, made and manufactured in the U.S.A.

From the Cleveland Plain Dealer: http://www.cleveland.com/metro/index.ssf/2013/03/two_oberlin_college_students_m.html

ses resumed Tuesday at Oberlin College amid a report that two students are under investigation for their possible involvement in a string of hate-related graffiti found on campus over the last month.

The Associated Press reported that Oberlin police Chief Thomas Miller said the two are under investigation and are facing college disciplinary action, but that no criminal charges have been filed.

It wasn’t clear, he told AP, whether the incidents were meant as pranks or were driven by bigotry.

An interesting phenomenon.

What should be done is find out exactly what has gone on. Acknowledge the real and the fraudulent.

We all have feelings (and we should avoid diminishing the feelings of others) but we must make decisions based on facts. On actual crimes, and not on bad taste.

It is a feeling, but maybe we should all lighten up a bit.

..

And to our detriment…

“They believe they are correct, accurate, appropriate, and acceptable.”
(While remaining intolerant, to any differing opinion…)

However, there is no “WE” in they… Where is the trust (that is necessary) to actually be inclusive?

...

Trying to point out the errors of their ways to these socialistically indoctrinated college “students” is like throwing chum in the shark infested tanks of the liberal universities for the professors to dispense as proof of their screeds.

Today’s students are so lacking in basic cognitive abilities that the closest thing they do to thinking for themselves is deciding what toppings they want on their pizza.

We must reclaim the education systems starting from day one and replace the indoctrination syllabus with truth in all subjects.

..

Thomas Sowell and MM appear to be on the same wavelength this AM:

Meanwhile, Asian immigrants or refugees who arrive here are not handicapped or distracted by a counterproductive social vision full of envy, resentment and paranoia, and so can rise in the very same society where opportunity is said to be absent.

So you can buy into the Social Justice/faux hate crime agenda, or you can turn yourself into a smashing success! Imagine in a moment of weakness, MM ( and other “Asia House” alumni ) had bought this load of rubbish?

Mary Katherine Ham noted at HA,

On January 22, 2013, the DePaul chapter of Young Americans for Freedom (YAF), having attained the required permits, erected a pro-life display consisting of roughly 500 pink and blue flags planted in the ground of the campus quad to commemorate the 40th anniversary of the Supreme Court’s Roe v. Wade decision. That afternoon, numerous DePaul students vandalized the display by tearing the flags from the ground and throwing them in trash cans around campus. Del Campo, YAF’s chairman, reported the vandalism to DePaul’s Department of Public Safety, which investigated.

So ‘who’ got in trouble? The vandals that destroyed the display? Nope! The Young America’s Foundation chairman that reported them!

With the investigation completed, DePaul Assistant Dean of Students Domonic Rollins provided Del Campo with a report from the Department of Public Safety, containing the names of 13 DePaul students who had admitted to vandalizing YAF’s display. On February 5, the national YAF organization posted this document on its website. On February 8, DePaul notified Del Campo that he was suspected of violating DePaul’s Code Of Student Responsibility—including a charge of “Disorderly, Violent, Intimidating or Dangerous Behavior,” which encompasses “creat[ing] a substantial risk of physical harm,” “causing significant emotional harm,” and “bullying.”

See, I told you so: Oberlin hoax confirmed
By Michelle Malkin • August 22, 2013 09:28 AM

Well, well, well.

Loyal readers will remember my post of March 5, “Oberlin College: Still manufacturing hate crimes hoaxes after all these years” and my column of March 6, “The Coddling of College Hate Crime Hoaxers.” I recounted my alma mater’s history of hate crime hoaxes and lambasted the current college administration’s hyping and hysteria of dubious claims of hate crimes there this spring:

Oberlin President Marvin Krislov and three college deans ostentatiously published an “open letter” announcing the administration’s decision to “suspend formal classes and non-essential activities.” The campus body immediately jumped to conclusions and indulged in collective grievance-mongering. The New York Times, Black Entertainment Television and The Associated Press all piled on with angst-ridden coverage of the puzzling crimes at one of the first U.S. colleges to admit blacks and women.

Color me unsurprised. The truth is that Oberlin has been a hotbed of dubious hate crime claims, dating back to the late 1980s and 1990s, when I was a student on campus.

Thanks to reporting by Chuck Ross at the Daily Caller, we now have confirmation of just how much of a hoax this latest charade was: http://dailycaller.com/2013/08/22/meet-the-privileged-obama-supporting-white-kids-who-perpetrated-cruel-oberlin-race-hoax

One of the two students removed from Oberlin College earlier this year for allegedly circulating virulently racist, anti-Jewish and anti-gay messages around campus is an ardent leftist and committed supporter of President Obama, The Daily Caller News Foundation has learned.

Dylan Bleier, one of the two students, hosted a voter registration drive in a Walmart parking lot sponsored by Organizing for Action, the community organizing project that advances the agenda of President Obama.

The Oberlin Police Department identified Bleier and his partner in the spree, Matt Alden, as two of the principal architects of a month-long spate of racist, anti-Jewish and anti-gay messages at the small, private campus.

Read the whole piece for all the slimy details revealed in the police report.

Also must-read: Professor William Jacobson at Legal Insurrection, who did his own intrepid reporting on the lying liars at Oberlin and has a thorough recap of the media and academia’s manufacturing of this latest in a long, long line of false hate crime narratives. http://legalinsurrection.com/2013/08/the-great-oberlin-college-racism-hoax-of-2013/

I was right. Michele Malkin was right.

The enormity of the hoax cannot be overstated, and it could not have taken place without the cover up by the Oberlin administration. Had Oberlin’s President gone on television or issued a statement that the acts were a hoax, the campus and media would not have devoted weeks to portraying Oberlin as having a racism problem.

The Oberlin administration has a lot of answering to do to the community, the nation, and to Oberlin alumni. How must those alumni feel to see their school smeared based on a hoax. Will Lena Dunham now tweet about it? Will CNN cover the hoax aspect as deeply as it did the incidents? Will Melissa Harris-Perry talk about the role of racist hoaxes in creating a false narrative of racism?

Cue the crickets chirping!
