View Full Version : Looking for info on tribal council laws and rules, Native Americans please help

I was wondering if you are married to a man who is a Native American and he is challenging you in tribal court for custody rights and fear that the court will not be fair due to you the wife not being Native American and not well liked, if you move off of tribal land would they the tribal court still have jurisdiction? Logic tells me that they would no longer have jurisdiction if you have set up residence for yourself and children (wife currently has custody) away from tribal land. What are the laws and rules on this? Do you have a link?

If you don't live on tribal land, the tribe has no jurisdiction, especially if the the wife is not native. I don't have any links though. :(

I think in this case they would have to go thru a reg court and mediate somehow? cause once your off tribal lands I dont think they have jurisdiction over you.same as if someone commits a crime off tribal lands and the person is native that tthe tribal police has to deal with it(the person can lose land if given any and so on)but there is a native american chat on Yahoo and maybe someone there can help you out.or I have a friend who is a chief in canada and Im me and I can give you his sn and maybe he has an idea since he is divorced also.and would know or can help you out.lots of nice natives in the chat room (also some rude ones) but there are a lot who live on reservations who know the laws.under chat its listed under countries and community then countries and culture.maybe someone can point you in the right direction also
id also ask your lawyer if you have one or a judge how this would work.but as far as I know native american women(or used to be) were the ones who kept the kids,home,etc.not sure if its still like that but maybe someone in chat can help you out.like Ive said some are very helpful others arent.couldnt hurt to try getting it straight from the "sources" so to speak.Im part native american but wasnt raised that way.so I dont know the laws.but see if that helps maybe they have links or know someone to contact in your state.
