View Full Version : My Comment about debt being paid off to society!

Yes, I realize this is a far cry from murder! :p :p
Over a year ago someone stole our only car from my husbands place of work. It wasn't enough that they stole it. They took it ran it until the put the transmission out. (It was done it the strip cuts- they took it hooping!) :mad:
They also ran it down over a very steep embankment. It had to be pulled out from between 2 trees. It was completly destroyed.
One of them was an adult, one was a kid. Both were charged as adults. And I fought tooth and nail to have the younger one charged as an adult.
Would you believe that the oldest only recieved 90 days in jail and 6 months probation! JUST 90 DAYS!!! The other only received 5 years probation.
They were both order to pay restution. We have yet to see a dime. I am FIGHTING to get it. Why am I fighting for what we are owed???
If you want my opinion that is not time enough for either of them. They owe me a debt and can't/won't pay it. At the court hearing I made a victim Impact statement. Do you know the oldest kid looked at me and laughed when he was ordered by the court to apolgize to me?!? I was so furious. The judge asked me if I could sit down at t he jail and talk to him. How could I? I wanted to strangle him. The judge saw this behavior and he still didn't get enough time.
The second Kid did apolgize. He also sent me a letter later on saying how sorry he was. Also, his probation contacted us to meet him at the distrcit attorneys office. And I did. He wanted to show me how far he has come. He is off drugs, and I hate to say it, But I was proud of him. He writes me now and then with his progress, and I always respond. Right now he is working on his drug addiction, and trying to find a job. He is working to change his life. In my eyes his debt is ALMOSt paid to society. I'd like to see him working full time. And I would like his half of my money.
To me the oldest Kid has not payed his debt to society. He has been and out of jail since. What a pile of human waste he is. He thinks its funny to do these things. In fact in December he broke into someones home and stole all her nice stuff. (computer, tv's etc.) She is a single mom busting her butt to provide- again what right did he have to do this!?! I talked until I was blue in the face to the judge. He needs a good hard sentence in a state prison. No more county games. He didnt get it, just another slap on the bottom.
That's just my 2 cents!

I don't get worked up over it anymore. Sometimes, I think, unless something hits home to you, you just don't realize certain things.
Oh, and this baby needs to plan on getting ready to come out! I'm 30 weeks and look like like I'm 40!! LOL

I know how you feel. When we went to Vegas in 2001, the kid across the street (17 at the time) broke into our house. He didn't take alot, and DH went over there and took all our stuff back (after scaring the crap out of this kid). Since he broke our window to get in, DH told him he would have to pay for it. We got an estimate from the family's cousin for $500. Haven't seen a dime.. What gets me is that last year, DH needed a part for our truck. The boy's mother works for a junkyard, so he asked her to pick it up for us. She did, and then wanted $125 for it! We paid, of course, but I couldn't help feeling like they could have covered it. After all, their child could be in the penn...

Back in 1986 a college roommate stole my CC and debit card while I was on spring break. He proceeded to wipe me out for $2,500.00. Restitution of $3,286.00 was ordered. 19 years later I have seen a grand total of $66.67. He has been in and out of jail all this time.

Oh that makes me so mad.. They need to stay in jail and have them work in jail or work somewhere while in jail to give the money back to you.. That is crazy..

As much as you are distressed about it, the guy who broke into my house and stole my car is going to be in jail for 25 years. It was a deal. And he was so stupid because he was offered two deals. And he took the one that will cost him the most amount of time.
And don't think that anyone can get through 5 years of probation without messing up. In GA you actually have to pay your probation officer and if you don't do as you should, you go directly to jail. And spend the balance of your time there.

I never said he isn't going to mess up. He is taking good strides and thats great!

I'm glad that the judge took into account that it was your only car for transportation, hopefull ythe insurance 4covered it.

You know what, I think it is time that us americans say, ENOUGH IS ENOUGH. I am sick of criminals getting a slap on the wrist, the judge saying bad bad isnt good enough, these criminals are getting probation for grand theft auto and destruction of privacy. Meanwhile the op is pregneat, has no other car, her husbands is having to try to make his way back and forth to work, what about the op if she has to go to a doctors appot or a obgyn or whatever??? It just makes me sick that what the op worked so hard for was destroyed by some idiot that got away scott free while her and hubby suffer trying to make ends meet and get a running vechile to continue life

I ONLY wish insurance would have covered it. We didn't even get a rental car. Those jerks, lol.
He's looking. And as far as I know when he gets a job, we'll have a payment hearing. We all go and the judge tells me what he can afford etc. Of course I'll accept any payment.

Decades and decades of liberal judges on the benches will continue to set back our judicial system. Time to get tough. Criminals continue because they know they can, they recruit juveniles because "they are babies and don't know that they are doing and therefore should not be held accountable" BS. I am sorry, but a 12 year old on up knows what they are doing. Heck, my 10 yr old special ed student knows the difference between right and wrong. We keep giving criminals a free pass, with no thought to the victim and restitution. I say it is time for it to stop. I was was a rotten kid, but I can guarantee you that at age 12, I knew what I was doing was wrong, I just knew better than to get caught because penalties were stiffer back then. You got swats from your principal, your parents could spank you without fear of CPS, Police knew they could arrest you without fear that the your parents would sue. But I also knew not to push my luck beyond being a run of the mill trouble maker, I skipped school, got in fights, did some drugs. I would have never dreamed of doing what kids know they can get away with today. The fear of actual punishment stopped me. Who knows where I would have eneded up without that fear.

i'm sorry op that happened to you, that punk needs a good stiff prison sentence. the ones like that............laughing.smug.showing no remorse.........ain't never gonna change. they feel no empathy and have no conscious.

The prisoners have it made, to some degree. They get free internet and cable, I pay for mine. they also get to buy q-tips, shampoo etc., name brand for cheaper than they sell it to me. My son showed me a list so I will no longer buy products that will sell to those in prison for a lot less than they will sell to me. If they want them as customers, fine, they do not need me as one.

Boy it isn't that nice in Texas. I know several people inside, and they have to buy their own shampoo, toothpaste etc. If they don't have people to put money on their books, they will let them do extra work for it. No cable, no internet, the only television is in the Day Room.
Most "farms" in Texas are working farms, so the prisoners beat on the ground, plant onions etc, or harvest most of the day. If not, they sew, cook, clean, exterminate, wash clothes etc.
I guess my point is - don't go to jail in Texas!!
Federal Pens (or "Club Fed") are a different story. I heard of one in Texas that has a golf course!!

i know how you feel back in feb of 1997 we was hit by a drunk driver whom forever changed our lives( this is the reasson dallas was early and reasson I lost my child) anyways he was only ordered to pay 500 to us!!!!!!!!!!!! At the time i was expecting my first daughter Andrianna. and she came very early. we went threw hell and he walked free! the judge said that he wish he could of charged him with murder when I lost my lil girl( it was 2 yrs later .i lost her because of injuries I had from the accident) anyways I dont think they do enough to these horriable ppl :( Oh yeah we had to file bankruptcy because of this and will never own a home because of on going bills that are due to his mistake. And we now will a lot of bills due to have a disabled child!
Ok getting to my point here I promise..
2 yrs went by he never paid us.. I found his Ex wifes number and she was MORE then willing to tell me where he works and his number!! SO I called him and he refused to give me the money. so i showed up at his work the next day and refused to leave until I got them money! LOL so went in and got a loan from his boss and paid us!:)
you were VERY LUCKY.........that don't happen much in reality. he sounds like scum

The kid who broke into my house is illiterate, ADHD, a drug addict and does not have a high school diploma. This is his 2nd or third burglary. He also had domestic violence charges as well as one for escape from the county jail. He is currently in jail and has been since he was picked up because he was in violation of his probation.
This kid will never be out of jail again or if he does get out, he doesn't have the skills to survive in normal society. He should have been put in jail permanently a long time ago. He has been given every chance possible including drug rehab and literacy classes but he hasn't done it.
I am happy that he is in jail but I wonder how many more of him are out there, just getting by. I sat in the court room and saw first offenders get 5 years of probation. A kid was put in their SHOCK program because he was breaking into cars, also a first time offender. And then there was a guy who hit and killed a kid who was an Olympic hopeful. The man was driving a car with a valid driver's license but he was blind in one eye and was barely able to see out of the other. He just didn't see the kid on the bike. And he also got a suspended sentence. He's also 60 years old, has various medical problems and putting him in jail would serve no purpose. But he has surrendered his license and will not drive again.
I watched the judge. I thought that he was fair to most people. I still would have put some of the first offender drug addicts and distributor in jail but he offered drug rehab and parole. I doubt it will happen again if they show up in his court.
