Ok, I won this auction and received a plate that looks no one ounce like the one that is advertised in this auction. It was supposed to be a gift.

http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&rd=1&item=5191340966&ssPageName=STRK:MEWN:IT

So as soon as I receive it, I email the seller, and I wait two days and hear nothing, so I email them again, and wait two days, so I email them again this time I threatened to contact paypal and ebay on this issue and this is the response that I get....

Hi,

Sorry for the problem. As the auction states the designs of the items are subject to change without prior notice. Though we try to keep items as up to date as possible, we carry far to many items to keep each individual picture updated each time a manufacturer makes a change (which can sometimes be 4 times a year). If wish to return this item for the purchase price please let me know so I can issue a return authorization number.

I paid for this plate right away with Paypal and I should have known better than to buy something from someone when you can't even read their feedback. and Ok i did read the clause where it said it could change but I did not think that it would be this different, I just figured the colors would be off a bit or different, the plate I got was a plain blue background with the words written in blocks, Tennesee Titans in red and that is it. no logo, nothing. This was supposed to be a Father's day gift for my Fiance and this plate is something that he has been looking for. Anyways, I have a Response to this person that I want to send but I just want to know you all think.

I am sorry but your style of business is just plain wrong, you are falsely advertising a product and misleading your potential buyers. I saw the plate and it was a supposed to be a perfect gift for a family member and now you are telling me that you don't even have anything close to what you are advertising. you have the EXACT same plate up on at least two other auctions after I had won this auction. I had figured reading that clause you had in your auction that maybe the colors would be slightly different. I had not expected to receive something that is not even close to what you have advertised. I think this is false and wrong. I did not contact you to ask for my money back, I contacted you to receive the item that I had won, hopefully, but I can see you have very poor business habits due to the fact that you are too scared to even let anyone see your business habits. I am sorry but I am extremely angered by this. I paid you faithfully and right away and now I am the one who is getting screwed, because now I won't be able to give this to anyone, and you expect me to mail it back to you, which will cost me extra money on something that you have screwed up. But there is hope for me and others like me, I will be able to report this to the proper people. Unless you can guarantee that I will receive the EXACT plate I paid for, then I see no other alternative than to report it. Once again I am extremely angered by this and you are not a good seller for ebay, if you cannot guarantee your product. I sell on ebay too and it is people like you that make it harder for honest people like me to sell. I stand behind all my products that I sell. Too bad you can't say the same.

I think that maybe I should remove the last 3 lines but, I am so mad. It almost makes me not want to buy anything anymore, I know it won't happen due to the fact that I am an Ebay addict.
let me know what you think and what you would do in this situation I never had to deal with this before....

I really don't know what to tell you, it does say that there could be variations so I don't really think theres much you can do. If you sent them that response then its just going to anger the seller and they may leave you neg feedback for it. Personally I would say chalk it up as a loss, you could have paid much more for it, $1.81 and $5 shipping isn't too bad to lose out on, it does suck though. You would think they would send something that looked similar to the picture. I really don't see a course of action for this.

You should have checked their feedback. It has way to many negative and they have it hidden. You can't even read what the people said. That should have been a warning. Always check feedback. I am sorry this happend!! I hope you get your money back.

Well after reading and rereading my letter i agree with freebielover, I wasn't going to ask for my money back like I had stated in the letter, I was just hoping to get an exchange for what I did win, but I do have a perfect record and I do not need to have it screwed up by a terrible seller. and I did look at the feedback, but when I figured it out compared to what they have for positive it really wasn't all that bad and i didn't think it would be this bad but I guess you live and learn. it didn't cost me that much, but I thought i had finally found that one great gift for my fiance. oh well, guess i will give it to one of his nephews instead........ Thanks for the advice.....

Yea...this is definitely a live and learn lesson. There is a reason their feedback is hidden. That's the most negative feedback I have ever seen on one person...and that's just within the last month.

I hope you are able to find something similar for your fiance before Father's Day!

from the looks of the insane amount of negative feedback, this seller should be banned from ever selling anything anywhere....is it even a tennesee license plate at all?Good luck in getting this taken care of soon.

It is NOT the issue that the item wasy only $5, the issue IS, she did not get what she paid for, if this seller takes 25 ppl for $5 how much does that add up to? =$100....this is why I am staying away from ebay!

First off I would never had bid on an auction if the seller had that many negatives. That is an awful lot of negative feedback. Secondly the person stated in the description that the design of the item may vary.

Here is what she wrote........

Designs for this particular item, as listed above, may vary (color arrangement, logo placement, background style, etc.). However, the logo shall remain the officially licensed version licensed by the respective team or driver.

well this seller finally replied to all my emails, guess they didnt realize that I was being emailed 3 times- lol anyway this is what I did tell them....

To whom it may concern,

I am not interested in getting my money back from you as it will just cost me more in the end. I wanted to get the plate that I thought I was winning, but that is not going to be possibler per your response. I think that it is terrible that you carry on a business like this when the rest of us who buy and sell on ebay are honest. you should be ashamed. I am extremely angered by this and will not share my words of anger with but just to say, I will keep the plate and I am sorry I bid on your auction.
Have a "wonderful" day.

and yes the plate I got was a Tennesse Titans plate but it was just a very plain Dark Blue background with the words in block letters and in Red "Tennessee Titans" and that is it, no helmet, not logo, notta. AND I have seen some plain plates before in my time, but this one beats them all.....

If you paid with paypal you can try to file an item not as described claim to try to get your money back. Not sure if it will work sionce they did have that disclaimer up but it might be worth a try.

I do think the response you sent was much better than the first one, it showed you were not happy and it was polite at the same time. The first response would have just made them mad. Whatever happened to customer service?

if you check his auctions and right click on the pictures and look at properties, you'll see the pics are copied from multiple websites.. that shows he doesn't have the items in his possession and i think its nothing more than a scam.

sorry this happened to you. :( I'm not one into ebay, but that's pretty shotty that they allow you to keep your feedback private, that is what most ppl would want to see before they bid on an item, right? I understand it's easier, but I guess I'm a go to the store and pick it up myself kind of girl. ;) Sorry about the whole situation though, hope you can find something nice to get him.

I did find another plate, kind of like the one the bad seller has pictured, not exactlly the same but close it has the helmet on it and it says Tennessee Titans on it and its pretty cool, bought that right away-lol :) we shall see, this seller though looks to be a good seller. Thanks to all of you for your support, help and advice. I am not even going to leave feedback for that bad seller, I'd rather not risk getting the neg. feedback, when I have a perfect score
(crossing fingers) so far I have been able to make my buyers very happy. :D

I did get a response back from them, I don't recall exactaly what it said because it just made me more angry, because they claimed that "a plate was just a plate and what should it matter" and some more about how they had not time to change pictures in their auctions. I just deleted it. I will have nothing futher to do with these people. I guess some people don't know what Customer Service means... I am going to give the plate to my Fiance nephew though, at least he will get an extra something at Christmas.. :D

but in all Thanks to you all for your help!

Evidentally the guy owns this website store: http://www.whateversports.com/acatalog/148_Car_Accessories.html Am I right in assuming your seller is from Fort Payne AL? He has the same plate for sell on his site. Was the one you were sent a LICENSED item like the auction stated? or did it appear to be hand crafted? If it were licensed, it would have had something on it to that effect when you received it. Here is a link to contact info from that site: http://www.whateversports.com/acatalog/info.html

**edited to add, he also has another ebay ID that he has never used: http://feedback.ebay.com/ws/eBayISAPI.dll?ViewFeedback&userid=whateversports

yet another account associated with your seller http://feedback.ebay.com/ws/eBayISAPI.dll?ViewFeedback&userid=kmcclung (got the user name from one of the pics he had posted on one of his auctions)

wow! Thanks for all the info! you must have been very bored- lol j/k
The plate that I got, on the bottom corner has the words tag express on it and in the other corner TM/ that copyright c with the circle around it and then 1999 NFLP and on the back there are two NFL Stickers, one looks like one you would get from a NFL hat when you buy it and the other says Rico Industies, Inc. so what ever those mean, I guess its liscensed, and yes it is from Fort Payne, AL and it is VERY interesting that he has the exact same plate up for sale on his site........ Maybe i should contact him and ask him if I will be getting that plate or different one.....j/k

I thought it was against ebay rules to have more than one ebay ID.... hmmmmmm.

but I really like that Pewter liscense plate...... pretty cool.......-lol ...
not buying from these people, knowing my luck, I would end up with something aluminum. :D

Believe it or not, I know of some people who use one ID to sell with, and one to buy with. This may not be just the one person, looks like possibly a family owned business to me? could be wrong.

Also, I was asking if it was licensed because that also was in the description, and you could have definately gotten him on that if it wasn't.
