Okay Most Of You Know I Got Shoved Into The Counter At Work,i Hurt My Elbow Bad,the Pain Has Still Not Left,and My Pinky Finger Stays Numb.i Have Been Seeing Their Doctor For About 2 Months,she Gave Me 2 Steriod Injections In The Elbow,and Told Me She Cant Do Nothing Else For Me And That I Will Have To Live With The Pain!! Im Angry,i Didnt Ask To Get Shoved,by The Customer,this Has Been Going On For 8 Months And Now All Of A Sudden ,we Cant Do Nothing More For You,you Can Go Back To Full Time Use Of Your Hands And Arm,but Wear Your Brace And Do Your Exercises.but We Cant Do Anymore.im Like I Drop Things And My Elbow Really Hurts Bad And Shoots Pain Down My Arm,and My Pinky Is Always Numb.now For The Question, Do I Have To Sign Any Papers Saying Workmans Comp Is Not Responsible? For All The Pain Im Having? I Just Think They Could Have Done Something For Me!! And Im Naive When It Comes To This Stuff.i Have Beeen Told Go Back To Full Time Work And Released From Their Doctor,but Im No Better.anyone Know Anything About This Stuff And What I Need To Do.please Help If You Do.!! Don't sign any sort of workman's comp release! The laws for every state are different .In SC, After I had my surgeries and received my WC settlement I signed the final papers. I had a year to refile if I had any more problems from the same injuries.
The only thing WC was really strict about in my case was seeing the Drs, physical therapist and orthopedic surgeon they wanted to use.

I'd suggest you find out what insurance company carries your companies WC policy. Call and tell them everything the Dr told you....that you were released to return to full duty and you're still in pain and having problems.....if they're not willing to send you to another Dr or do something to correct the problem ....tell them you next step is contacting an attorney.

Find a new doctor, if you feel you are not able to return to work. Good Luck. And I agree, sign nothing.

i have been working all this time but 2 months of the 8.im telling you all my left hand is better then my right will ever be agian,some days the pain is terrible. and after working my shift its even worse. yeah they gave me their doctor right at the end ,just when my doctor was gonna do something,they give me their doctor and tell me to live with the pain.i dont want any money from them,just want my elbow ,finger back. hugs everyone ann IS THAT TO MUCH TO ASK NOWADAYS??????

I didn't ask for money either. In SC you automatically receive a cash settlement anytime a work injury results in scarring or permanent loss of use of an extremity(or in my case, both). The amount you receive is based on the % of loss.
You always have to use the Drs they want you to use. Given a choice, I would have gone to my own Dr and a different orthopedic surgeon, though the Drs I had couldn't have been better. I would have chosen one of the two larger hospitals in the town a few miles away. I had to go to the smaller branch of one of those hospitals that was in the town I lived in.....they were wonderful during both surgeries.
I never thought of calling an attorney, never considered that I could have gotten a bigger settlement by calling one. All I wanted was my hands and arms fixed...If workman's comp hadn't done everything they could to fix the problem....then I'd have been talking to every attorney in the phone book.

GET A LAWYER !
ANYTHING comp can get away with THEY WILL.
Been fighting my case nearly 6 years, have YET to be fixed.
My Lawyer is a Godsend, and most work on "We dont get paid unless you get paid" basis, (like 33-1/3 of the award)
I have had 5 surgeries, too many therapies to count, God only knows how many shot of cortizone (to ease my pain) (last ones I went into a seizure right there on the doctors table)

Find another Doc. and heres one ALOT of people dont know.
You DO NOT have to do ANY proceedure you do not feel safe, or want to do.
EX> A few yrs back they sent me to a pain managment doc, he went in through my back to try to deaden the nerve in my lower leg, DIDNT WORK just messed up my back. Now they THINK they are making me go back you him, NOT, I said no. Lawyer said NO. SO now I wait..............
I go Tues the 8th for bone scan results they think I got an infection......

Sorry for buttin in on your thread, I get so worked up and mad at this topic and cant shut my mouth!!!!!!!!!

Do as everyone has suggested. Don't sign anything and get a lawyer involved. And you need a second medical opinion. Someone who can tell you exactly what is wrong and why they can't do anything for you or if they can do something then WC needs to cover it.

To me, it sounds like you have nerve damage. Did they do an MRI? I don't think that any doctor can make a true assessment of you having to live with the pain unless they've done testing.

Where I work, if you're not satisfied with the company doctor, you have the option of using your own doctor. That's not held against you.

Don't sign ANYTHING until you feel that you are better.

I'm posting again...

If I read your post correctly, did you say that a customer shoved you in the corner & that's how you got hurt? If that's what happened, did you call the police & press charges for assault?

Years ago, I worked in doctor's office. A patient tried to slap one of the employees (in the face). The patient missed because the employee stepped away. The employee did call the police & they came out to take a report.

yes i got shoved by a customer,but when i turned around to see who did it,no one stepped up and i didnt expect them to,i also had tears in my eyes,so everything was blurry. at first i thought i would be alright just bruised,but 2 days later,hospital for severe pain and numbness.now i have had x-rays ,but no mri.i have had nerve conduction test for carpol tunnel,but nothing else but the steriod shots!! im just angry ,i dont think this is fair to me.thanks everyone for your help.ann

yes!!! get a lawyer and a new doctor...get a lawyer who deals in workmans comp cases..that way if you dont win you wont have to pay! I fought for workmans comp for a year but we won...every case is different but I went to my family doctor..he sent me to specialist...after i got a lawyer i had to go thru all the monkey business with the companies doctors..but i had a great doctor and he pretty much won the case for me..they are just trying to get out of paying you. dont let them get away with it!!!

First of all, I'm sorry for all your pain...I know what you're going through.

Secondly, by all means get a lawyer, or a new one if you already have one because this guy isn't cutting it.
I worked for a semi-well known theme park in uh...Pigeon Forge :eek: in 1998, and I clearly got hurt on company property during work hours- major pothole in the lawn, a customer could of really injured themselves...but instead it was just me. :o I did the eqivalent of breaking my ankle without an actual break...and of course no one believed me. It was just a sprain they said... I finally told my Lead (I was working the toll booths) fark it, I'm leaving you can fire me if you want...but instead they called security who highly recommended I be sent home given my ankle was the size of a large grapefruit in a matter of minutes. They sent me to one of their doctors who told me the real reason I had fallen was that I was over weight and should be on a low cal diet and that it was just a sprain, of course he was right technically so the X-Rays couldn't pick up how serious it was. He sent me on my way... it was of course no better, so I went to another doctor of theirs and guess what, this guy KNEW what was up with the company's habits so to speak and actually did his job...put me in an aircast for weeks, said he might have to actually break it if it didn't get better, put me on antibotics for the off chance I might get an infection, script for pain medicine AND a cane. Once they figured that out, things changed...and I told them YOU sent me to YOUR Doctor it's not my fault the second guy wasn't agreeable to a payoff. So they put me on VERY and I mean VERY light duty for weeks, and still I went home after a few weeks because it was just that bad...so they fought everything...tried to send me to another Doctor in Knoxville and me and my lawyer said UH NO...I live 2 hours from there...send me to someone HERE. Which they did unwillingly, mainly they agreed because my lawyer wrote them a nice little letter that basically said "If you don't, she will own your company" :eek: The end result is that I have a 10% loss of mobility in my ankles, one trying to compensate for the other...and I got paid a very very small settlement. *shrug* It happened for a reason I suppose.
But yeah, get a GOOD lawyer... I wish you were in TN, I know a fabulous lawyer. :D
