Ok, brief background. The offic mgr (also owners wife)does accts payable and receivable. she has NO training in this and it shows. For the past four months, we have been getting dunning calls and WAY over due bills. I am SURE owner doesn't know anything about this, cause he would go ballistic. I do the deposits, so I know there is PLENTY of money coming in, but nothing gets paid until it has to be - we have had disconnect notices for our utilites at work, and no one will send us parts unless they are COD. Anyway, here is what is up now - the shop tech got a letter at home from the health insurance company saying the policy had lapsed on 10/31. This is a thru work policy, and he gets at least $50 a week taken out of his check. The deductions have not stopped - so he asked the office mgr about it. she said she had forgotten to sent the insurance company a check, but that it had been taken care of and the policy reinstated. Then she left work early. He told me what she had said and it just didn't sound right, so I told he to call the insurance company. They told him he had NO insurance - so not only did she lie, she has in effect stolen his money by deducting it from his check. What do you guys think he should do? She is very defensive, so it wouldn't be past her to fire him rather than get caught out by her husband- hubby has anger mangement problems. Any advice?

I would ask the insurance company to send him a letter stating this, then get my check stubs that shows money was taken out for insurance, then i would talk to the owner and tell him if something wasn't done i'd be talking to the DA about possible embezzlement/fraud charges... just make sure you have all your proof first and only take copies to show the boss.

Do you also have monies taken out of your check for insurance? ALL that needs to be repaid back to the employee. There are insurance boards in ALL states, contact them. The boss should know, who cares if he yells at his wife, she needs to be replaced before she brings the business down to NOTHING.

I know I followed an employee just like yours, and I had one heck of a mess to clean up.

If something happens to someone who doesn't have insurance because of the failure on the part of the company to pay the premiums wouldn't the company be responsible for the medical bill?

I wouldn't worry about her firing your coworker. She is committing a crime. If she fires him over his questioning why he doesn't have insurance that he is paying for then she opens up a lawsuit against her.

I would take it to the owner....with physical proof not just your word. If he chooses to do nothing about it then I would report it and start looking for another job real soon

I agree that there is only so much you can do. She isn't paying the bills and the company will loose employees over this. Your guy with the insurance problem should call the labor board and get them involved. He has been paying a premium for insurance he no longer has. Let the labor board get involved. That keeps you out of it and it will protect the employee because if he is fired he can sue.

Next, make a file of all of the late notices that you receive. And let the electricity get shut off as well as the water if necessary. Eventually the owner will either get the hint or his business will go down the tubes. No one will work with someone who won't pay their bills. And nonone will work for someone who has problems paying their bills. Especially their medical insurance.
