my fiance and i live in an apartment complex. in the apartment under us to the right live a woman and her son. he is 12 i guess, maybe 13. anyway, he started throwing his basketball against the balcony. i ignored it, he's just playing, right? he now throws it so hard he shakes our apartment and both apartments on either side of us. all of us have asked him to stop. he won't. we have talked to his mom. she cusses us out and tells us to mind our business. wth? :mad: this is my business you witch. and the next time that ball hits my door, whether it is an accident or not, i am calling the police and letting them take care of it. if it hits my car again, you are paying to fix it. he has knocked 3 dents in my car, and i let it go. each time he and his mom promised he would no longer bounce near the cars, they can't afford this, blah blah blah. wellll.... he is till bouncing, RIGHT WHERE HE ALWAYS IS!

and my landlord. my stove burner blew up in march. we told him, he ordered a new burner, told us it was in. still didn't fix it. we have asked him AT LEAST once a week for the past 9 months to fix it. he hasn't! the wall in out tub just fell in. we told him, he said he'd get around to it. that was a week ago.

i just found out that in kentucky, we have the right to withhold rent until he at least fixes the stove. better bet he is not getting another Edited cent from either one of us. i also found out we can sue for the difference, but i don't have the money for that.

he has also been in our apartment without our permission, while we weren't there several times. none of these times was an emergency, so we can sue for that too. but again, who has the money. a neighbor told us they go into out apartment sometimes, and once we were int he back room. someone knocked. we figured it was brittney and stayed put. 5 minutes later someone is in out house yelling 'hello, anyone home?" fiance goes out, landlord yells at him, cursing and threatening him. he shut out power off (also illegal in ky, no matter what). i hate him. i want to break a window over his head. better yet, i want to super glue that stupid, ugly hat to his head. you freak.

i didn't know we had rights before yesterday. fiance found a book of renters rights at the library, and i'll be Edited if we haven't had the right to now pay his sorry behind for 9 months now.

and the best part ...

we have a prostitute! she has a small child, and while he sleeps at night, she makes rounds to some of the guys and ... well. i know this for sure because my fiance's friend "poop face typical dumb stupid drunk guy" who lives right beside us tells us this stuff. i won't go on about this.

Do not attempt to get around the profanity filter. Let the system star out the entire word. There have been neumerous posts about this. Any continued violations will result in a 3 day suspention of the account.

I am sorry you live in such a bad place, you know you can get a lawyer for free, I dont remember what place it is you call that can help you though. I will look into it though for you. I would sue your lanlord, seems he is doing a few things that are illegal and that is sad, you have to go through that. pm me or email if you want to talk.

:( I am sorry that you are going thru this. I would like to kick your landlord in his :mad: well, ya know.
Is there a legal aid office in your town? Check in the government pages and if these is one give them a ring and see if they can help you.

I would for sure call about that kid. If his mom won't stop him, maybe the police will.

umm.. from what i remember is that if your landlord doesnt fix something within 30 days you can refuse to pay rent and/or have it fixed yourself and take him to court for the money you paid!!

You can usually get free advice about this from a tenants right organization. Before you withhold rent Iwould make sure you don't have to do a rent escrow with the court.
I went through something like this in MN and we had to notify the landord in writing about repairs they were suppose to take care of. The landlord then had 14 days to respond or fix it. If the landlord did not comply we then had to go to the court house and file a rent escrow with the court. We paid our rent money to the court and they held it until the landlord fixed what they were suppose to fix.

Some states have specific steps you have to follow when it comes to withholding rent from the landlord. You don't want to get evicted for not going about this the right way. JMO

If ya REALLY wanna move..........stop paying his rent and save up and find another place where you know you'll be safe :)

I had a landlord about 6 yrs ago, the furnace QUIT WORKING in the middle of winter and I nagged him for a good 2 1/2 weeks before he ordered another one. Here I was I had a 2 y/o at home and was pregnant with my 2nd child. I moved the hell out of there before the furnace got there. He also did a number of other things, but this topped the cake.( I stayed at my mom and dads place... they divorced and were trying to sell it) so I didnt have rent to pay, just utilities and it helped me save up money for another place.

Best of luck to you. I've been there and done that, its not fun.

Call your local housing authority and complain to them. They will go after him to make repairs. But keep in mind that he can also refuse to renew your lease when it comes up for renewal.

i didn't know about the editing part. i have been away from the boards for a year i think, and i have only revently been back on the past few weeks or so.

we just found out we could withhold rent. this is the first time renting for both of us. we will be withholding rent now until all is fixed.

i have a rough draft of a letter, but i want to make sure i am not rude or anything to increase my chances of getting anything done.

Howdy fellow Kentuckian. :) I'm in the eastern part...no jokes, please. LOL

I had to do a bit of research on tenants' rights not too long ago (the landlady refused to give back ANY of my $600 security deposit because I'd only given three weeks notice instead of 30 days, but my one year lease had expired and I was on a "holdover tenancy" and under Ky law, only had to give 10 days notice). Which part of KY are you from? I have a partial list of places that you can contact for the legal stuff.

BTW, the landlord can only enter your apartment to make repairs or in an emergency without a court order. You can also require that he give you two days' notice before he enters.

Oh that's just horrible. We used to have people like that living across the street from us and they had a big ol' basketball hoop right out in the street. Basketballs were hitting our cars, the house, everything. Every time one came into our yard we'd confinscate it. When we got about ten of them we cut them in half and cut eye holes in them, made masks out of them--and then when they started their basketball playing, we and some of the neighbors put on our basketball masks and just went and stood in the front yard staring at 'em. For some reason that put a stop to it. Oh yeah and I called the city code enforcement too:)
