*banging my head on the desk & wondering why I quit smoking*

I quit my job last Monday, no notice, nothing, long story, but the short version is I was working myself past exhaustion, he is doing things that are illegal, FAILED to pay my overtime & to top things off, hit on me..I'm married, he's married, it's sick..No wonder we couldn't keep help!!! (really wanting a cigeratte)

I SHOULD have gotten my last paycheck today, I went to pick it up plus $25 cash I had won off the game machine..
Guess who didn't get a paycheck?..Then the SOB tries to KEEP my $25, says he was going to put it on my paycheck..IT"S NOTHING TO DO W/ MY PAY!!!!!!!it DIDN"T COME FROM HIM, IT CAME FROM THE COMPANY WHO OWNS THE MACHINE..

If you quit your job, are laid off, or are fired, your employer must pay you all monies you earned by the next scheduled pay day."

Tells me I should have a check tomorrow afternoon sometime..

Then my old boss calls me (in a good way) tells me about a new job at a new place he's opening, tells me the SOB fired him a week after I quit, asks me how much I made per week becuase the owner was trying to dump my manager down to $300/week plus the new gal (bartender won't even get into that one) was now SALARY $700/week..I NEVER MADE THAT MUCH EVEN W/ 90 HOURS!! and I'M TWICE AS EXPIERENCED..

My head is pounding..if I don't get a check tomorrow afternoon I'm filing against him w/ the state & small claims..I'm not fooling around, I'm beyond that now..if ya stuck w/ me thanks, if this made sense great..I'm beyond PO'd

I am a big believer in something telling you to leave a job when it becomes as unbearable as you described. When it is something ILLEGAL it is time to get out asap...why do time for some slimeball who will walk away scott free?

I understand you want your money and hope you get it. I wish you a better job next time.

In California - if you are not paid you can collect a days pay for every day that you are not paid on time up to 30 days. (Did that make sense?)
You do have to get a lawyer but i did this once and it was quick and painless.

I'm sorry that this happened to you.

Sounds like he may be paying her for services rendered...




I say go after him with the labor board anyway, sounds like he violated some pay laws way before this.

Call the Labor Board and file a complaint with them. Be as loud as you can be. And if he doesn't pay you, tell him that you will be suing him for payment. He can be a real pain about it but you can sue for wages and you can make his life misery with the labor board. Report all abuses that he is incurring to them and anything illegal that he is doing. Don't tell him that you are doing it. And report him to the IRS. That will really make his life a mess.

I've calmed *some* tomorrow is going to be very interesting for him..

(& Mama LOL..as I pictured myself...)

I spent today getting applications out, I'm free all day tomorrow..need to occupy myself somehow :cool: ;) ;)

yes i agree call the labor board. not only can you get this guy in serious trouble you can regain back wages for all the over time he never paid you for plus interest :)

When I was younger I worked for McDonalds and I quit because I was being messed around BIG time, it took filing a claim with the Labor Board and I got my check the NEXT day, they put me off for four weeks, we are talking a minimum wage check so not a fortune, I clled every single day to the local MCdonalds, the corperate office, and finally decided to report their butt. Dont let them mess you around, $700 a week BEFORE tips for bartending? BS!!! I know a bartender that makes that much with tips, but unless you are working in a major casino or at a specialty club you aint going to make it

I am proud of you for quitting, take your talents elsewhere, you will find a good job, hopefully you can find one that pays well AND makes you happy, now that would be great!

Ayup, and she was part time at 6.00/hour when I quit (so I was told..it would take straight 116.7 hours to make 700, and well ain't no way..)..and the thing that got me yesterday was I was there EVERYDAY I was booking acts, running promos, meeting w/ the sales reps, scheduling, doing the ads (rewriting, proofing, meeting w/ those reps), inventory AND ordering..I was NOT just tending bar..and that hootch gets that much..

Least I can hold my head high & wasn't getting paid for other things..


Well folks here I go for my check, if I'm not back in a few hours pass a hat for some bail money? ;)

Have you thought about reporting him to the local Alcohol board? Maybe you can threaten to get his license revoked for bad practices. Maybe then, he'll get you your money.
