My husbands brother talked him into buying a 4-wheeler for him about 3 yrs ago. well he stopped paying the payments and the bank came to repossess it. My bil wouldnt let them have it and now they are going to file a civil suit against dh. We went to the county attorney and he said he can write him a letter but he is not sure he can make him give it back WTh, the 4-wheeler title is in my husbands name and I am just so pissed off right now. I spoke with a state police and he said we would have to get a court order to get it back, but the county attorney seems to think otherwise. I am so confused and mad I mean if you got a title in your name it should be legally yours right or am i mistaken.any help would be appreciated
Has your DH asked your BIL to give it back to him? That way, you could turn it in to the bank yourselves. Know that you'll have a repossession on your record and will be liable for any deficiency. Your alternative is to make up the back payments.

give the bank your bil's address. the repo men will go there and take it.

Does your husband own the bike or did he co-sign for his brother? If his brother stopped making payments and your husband was the co-signer then your husband is responsible for the payments.
I am a bit confused.

If that was my BIL I would have my DH go take the 4 wheeler back (if he knows where it is). That is why one shouldn't co-sign for things because it can come back to bite ya.

Let me clarify this, no he didnt co-sign it simply is in my dh name period. WE sent the repo man to his house to get it and he would not let them have it. We tried to get him to bring it back but he refuses so we went to get a court order to get it back but the county attorney isnt sure if we can get it back from him. I cannot understand why the county attorney cant get us a court order to get something that belongs to my dh alone. I just so discusted with this. See bil always got anything he wanted growing up and the other kids had to cater to his every whim so he thinks he can throw some crazy fit and get his way. He also actually came to his other brothers house and stabbed him with a knife because he couldnt get his way. so he is a maniac and we wont go get the 4-wheeler without the police with us. It is just a big mess. My husband is a soft hearted person and the deal was done before I could stop it. I desperately need some legal advice about what to do .

Your dh should report it stolen. If it's his, then it shouldn't be anywhere but your garage.
I worked for a repo company... the repo men aren't supposed to leave without all the money or the car. I can't believe they would've let him keep it.

ITA! If it's in your hubby's name, then he can report it as stolen and maybe that way you can get it back. Good luck!

i know for a fact as long as it is in your dh 's name he can go take it anytime he wants to,and that is what i would do,take an officer with you.

ITA with the above posters if it is in you DH name and the BIL is refusing to cooperate then I would report it as stolen or get the police to come with you to get it. Good luck I hope it all works out for you.
