Recently I requested that my nephew have testing for learning disabilities and ADD but they the guidance counselor said he did not qualify, at least thats what they told my Mom who is his guardian. Well apparently this is incorrect and they got away with it due to the fact that I do not know the laws and apparently from what my daughter says (she used to work with hemophilia patients) a lot of schools use the fact that people don't know the laws about their rights and their children's rights to their advantage and so I am posting these two websites in the hopes that it might help someone else.

http://www.ed.gov/offices/OSERS/Policy/IDEA/index.html
and to help explain these laws here is another website

My 7 year daughter didn't "qualify" for testing this past school year, either. Luckily, we were aware of the laws in place, and persisted until she was tested. Turns out she does have a learning disability, and they do have to provide for her needs in the public school system.
You really have to be vigilant with your children when it comes to their education. Great post!

the school the boys were in last year were just the opposite, they wanted everyone tested for it, drove me nuts... all they want is to put the kid on riddlin(sp?) they already had so many on it , that its not funny, MY DOCTOR told me as long as the grades are good, He's not gonna drug up my child just to make the teachers job easier,

WOOOHOOOO, YOU GO DOC!!!!!!!!!

Thanks, my daughter needs to be tested for a couple things. I spoke to my aunt about it who's a school teacher and she told me they'll try and tell me that too.. so just tell them that I know my rights and I want her tested.

One of my 14 yr. old grandsons is ADHD. He started with Ritalin and then moved on to Adderol. I don't think he will be homeschooled anymore. My special DIL is going to put him in a private school that specializes in his needs. They are very difficult children to work with. Also they are very bright, intelligent kids. My son (the soldier) realy had a problem with one of his 'babies' being drugged. He saw many specialists, concelors, school officials and everyone is helping. You have to go for it and don't be pushed around by the system.
