Sweetie Got Hurt At Work And They Are Saying He Was Out Less Then 7 Days, So He Can't Get Paid For The Time He Was Out. He Went To Their Doctor The Other Day. He Cleared Him To Go Back To Work. So They Called Him Last Night And Asked Him To Come In To Work Today. Another Agency Called And Asked To Speak To Him, He Spoke To Them, Today And They Say Being That He Went Back To Work Today He Can Not Get Paid For The Time He Was Out, Cause He Was Not Out Of Work For More Then 7 Days. I Called The Person He Spoke To And To Straighten Out, So That I Would Understand It. But I Am Still P#ssed Off, Cause He Is Not Getting Paid For That Time. I Know To Some People I Should Be Glad That He Can Go Back To Work, And That He Still Has A Job, Don't Get Me Wrong, I Am Very Happy About All That. I Guess I Am Just Really P#ssed Off That, That Is Time He Won't Get Paid For. I Am Just Really Upset. Thanks For Lending Me An Ear.

That is just wrong. :mad: If he was off work because of an illness I could understand--most short term disability plans have a waiting period. But since this was work related I would think that workers comp should have to pay for lost time. Did he file an injury report at work? If so I don't see how they can get away without paying him. You might want to check into the workers compensation laws in your state. I know in here Oregon they would not be able to get away with that.

Seven days is short. Here its 10 working days.

I hope he gets lots of ot to make up some of the time he was off.

Here for worker's comp to kick in you have to be off 7 days in a row.

Sorry to hear that. My sister works for a large major "company" of appliances and she was hurt at work about 2 yrs ago and the damage to her knee caused her to have to miss months of work. She is still having trouble and has been going to all these different drs. that they want her to go to. One Dr said that there is still damage and doesn't want her to go back to work. She was getting workman's comp, but they quit paying her. Well this "company" decided that they weren't going to pay her anymore. She hired a lawyer and the judge said that the "company" had to pay her back wages and continue to pay her as long as she was employed there. Long story, but this "company" refuses to pay her and she has contacted everyone she can think of to get her pay. They say that since this "company" is self insured that they can't make them pay. My sister hasn't had an income in almost 6 months. She is now sueing them for her injury, but they said this can take months or years. She is very depressed and still has a ton of medical problems. I have decided not to buy anything that this company makes or sells. :( :mad:

Here in Illinois, in order to get workman's comp, you have to be off the job for more than 7 days. I think if you're working and you get hurt and have to see a dr, anything more than 24 hours should be applied to workmans comp.

ITA~With you lora. but they say they start paying after you have been out of work for 8 days, so on the 8th day they would pay 25% of what you were making. i said that would be better then nothing if they paid after the first day. and what would happen if he got hurt again????? well, i guess we would start the 8th day thing all over again. WTF, you can't do nothing right and expect somebody to do the right thing for you, now can you. damned if you do, and damned if you don't. and it is stafting to be dawnedifiknow.

I used to work for a BMW supplier. I had 2 workman's comp claims during the time I worked there. The first was for drilling my hand with a Dremmil tool, no biggie, but I spent most of the day in the Drs office and was paid as if I had worked my entire shift.
When I had carpal tunnel syndrome, I spent months going to Drs, therapy and finally a orthopedic surgeon. I was paid for every minute I spent at any Drs office on my weekly paycheck. When I had my surgeries, I didn't have any sort of a waiting period, I received a workman's comp check every week.
I would definitely check and see what the workman's comp laws in your state are, I believe every state is different.
Apparently it is, my workman's comp payment was 66% of my regualr pay, since it wasn't taxed, it ended up being almost the same as my weekly pay.

I don't blame you for being annoyed...When I worked at my last job, I got hurt(at home). I tried to find out the law and what I was entitled to...by asking the Personnel Dept...they lied and told me all the wrong information....so I didn't get squat..now thankfully we have the internet and more resources to find the truth.

If you look at your medical benefits booklet it generally has a statement in there about your Worker's Comp benefits. Generally speaking they don't kick in until you have been out of work for at least a week. With some policies it can be up to a month. The company is expected to pay vacation time or sick time for that period and basically what they are doing is making the employee use up the company benefits before Worker's Comp kicks in.

After that week then they start paying but it may only be a percentage of the salary for a certain period of weeks. When that time is up, if you have long term disability, it kicks in.

Worker's Comp does not have to start paying the day you get injured.

i have a friend that has a comp case and her's went from the day she was injured. that is why i don't understand this one. right now, i feel like A BIG DUMMY!!!!!! i feel really stupid cause i don't know anything about this. now, anything else and i have the brains to get it done and the know how. this just stumps me. oh well. THANKS FOR ALL THE FEEDBACK. I REALLY NEEDED HELP WITH THIS, CAUSE I DON'T KNOW. I am starting to feel depressed, cause i don't know what to do. and today i am having a real bad day. sorry and thanks. :confused: :(

It would largely depend on the company that his company carries their workman's comp insurance through. I was lucky enough to work for a comapny that offered fantasic benefits and had excellent insurance carriers.
None of the companies that supplied BMW had their contracts extended if they didn't offer employees similar benefits to what BMW offered their employees.......shame we didn't get a BMW after being employed a year like BMW employees get.

I know the regulations are different, I am a Canadian, and 7 years ago my hubby was in a major vehicle accident. broke his back, crushed his hip, broke every rib, severly puncturing his lungs, he had severe brain damage, was in a coma for 18 days and had 2 brain surgeries while out. I thought his company cared as 4 days after the accident they brought a WCB cheque to the hospital. I later found out they were saving their own butts, The operator of the truck had double the alcohol limit. my depositing that cheque too all rights from us, and WCB controlled us. we had years of brain injury rehabs, and still has major damage, any ways, sorry to drift off, at the 2 year mark, WCB decided to cut us off, against all his specialists reccomendations. I contacted my MP (member of parliment) within 3 weeks WCB appologised and gave us a cheque for 62,000 and my hubby is on monthly benefits of 2500 a month for life. it is all politics. Good luck, I know how stressful it can be

It depends in Ill. My d/h has to be off a week But where I work at 3 days and they count Sat. and Sun. I was hurt at work on a Thurs so Fri. Sat and Sun. was my 3 days. And with me my Dr. had me on lite duty but my job doesn't have lite duty so they had to pay comp for a year.

being a "victim" of the worker's comp. nightmare for more than 7 years now--i can tell you that ,if you need full info. of what you are entitled to--go to your state's dept. of labor or call them. they can tell you everything you need to know! and, you will get paid from the date of injury,but, state W.C. pays bi-weekly and they wait 2 weeks to send the first check!(most of the time--with us-it was a full month!!we are on federal comp.,tho' and get paid weekly.) you will receive up to 2/3 of your original,gross wages computed from 1 year back then averaged out to get the weekly total.at least,that's how ours works--state comp is probably less than that.

UPDATE: HIS JOB TOLD HIM TO GO HOME CAUSE HE COULDN'T DO THE WORK THEY WANTED HIM TO DO, CAUSE HIS BACK WOULD HURT. WELL, HE WENT BACK TO THE DOCTOR, AND THE DOCTOR, TOLD HIM TO GO GET X-RAYS OF HIS BACK AND IS SENDING HIM TO THE SPINE CENTER, AND FEW OTHER THINGS, THAT INCLUDE PYSICAL THEARPY, AND SOME PAIN MEDS.. AND WORKMEN COMP, SAYS THAT HE NOW HAS A CLAIM AND THEY ARE GOING TO PICK UP HIS CLAIM. AND FOR THAT I HAVE Y'ALL TO THANK, FOR HELPING ME, AND THANK HIS DOCTOR, AND WORKMENS COMP.. FIRST AND FOREMOST I THANK GOD.
