Okay as I said this kid hit me in the bowling alley parking lot and would not give me his insurance is there any way that I can get this information with out him giving it to me I called them agian tonight and the dad was going to give it to me but the mom got on the phone and said there is no way you are getting that information take us to court. Well I would but I don't have the money to file it with the court. I just want to get the insurance so that I can file it and get my car fixed is that to much to ask. The kid was at fault I was not even in my car when he hit my car please I am so upset and have not had a good night's sleep because of this. I have been crying all night because of it. If any one know's of a way to get this information with out it costing me any thing please let me know

I had damage to my vehicle last Xmas season in a mall parking lot. I'd call your insurance co. w/what info you have. Maybe they can help you. I'd file a police report too. Just to back you up.

do you know anyone who is an attorney who can call them & put the heat on them to tell you who their insurer is?
you may have to file a claim and let your ins co subrogate the claim if they won't say
what happens on subrogration is, your coverage pays out but your insurer gets their attorneys on the other party to pay them back
OR i just hought of this
it is against the law for them not to tell you. if there's a police report call the officer who took the report to get involved.

captorquewrench is EXACTLY right, that way you don't have to deal with these people and you do not have to hire an attorney.
also... what county are you in? there are some counties in oklahoma that you can go to the DMV and get the insurance information IF you have the accident report... sometimes you can get it without, but it can't hurt to call them.

Okay I went to the police and they will not file a report because it was on private property and they cosider it a cival matter. I have only his name and phone number and address and my insurance company called them and asked them for the info and they would not give it to him either they said sue us. Now there is only one reason that a person would want to be sued in a case like this and that is so they can drag it out as long as they can to pay it mean while her I will be on foot soon because I can not get the hood open to check the antifreeze or oil or anything else. I asked for the insurance when he hit me and he would not give it to me. It is not right that he does this to me I didn't cause the accident he did.

call your insurance agent and see what they say to do. don't put it off. they may be able to have their claims office call and your agent or an adjuster might be able to get it out of them.

my insurance company can not do anything because I only have liability if I had full coverage they could fix it for me they have been very nice and tried to do what they can. My husband just happens to be good friends with the guy at the dmv here in town so I just might be able to get it that way. Does any one know if you can call the insurance company's in this area and ask them if they have that person with there company?

I had never had to deal with anything like this at all until now and if it is on private property unless it is a major accident they will not go on the property you are on your own.

Betcha he doesn't even HAVE insurance. That's what happened to us, and we only had liability insurance on our car. It was the other driver's fault but we got NOTHING because she was uninsured. We had to buy a new car, ours was completely totalled. If we want anything from her we will have to sue her, and I honestly don't think she has anything to give, even if we won. Good luck to you, I hope you fare better than we did.

Maybe they don't want to give you the information because he may lose his licence. I found This info on a auto insurance law site. Under Oklahoma auto insurance law, the Department of Public Safety will suspend the driver license of the uninsured driver and/or owner of a vehicle involved in a collision where there is any injury or property damage of $300 or more. As far as finding info on him you would probably have to pay.

I think probably small claims court is your answer. The cost to file is minimal (seems like it cost us about $30 4 years ago) and you should be able to get what you want. If this person has no auto insurence, chances are that once you put the pressure on, and they're served the papers, they may want to settle out of court, rather than to risk getting in trouble with the law.
The great thing about small claims court is you represent yourself. There's no attorney. You just stand up and tell your side of the story, and they tell theirs, then a decision is handed down. Simple and effective.

If you are in Tulsa county, it was only $25 to file last year. I would certainly follow up on this. If you pm me I can find out if hes been involved in any other vehicle accidents in Oklahoma. :D
Don't forget... most people who say "sue me" do not expect that you will do so. Do you have their address? I would write them a formal letter asking for the information. Send it using delivery confirmation. If you send it certified, they have the option to refuse it. If you send it with delivery confirmation, you will be able to print out that they have received the letter. ALSO at the bottom of your letter make sure you put "cc: "lawyer name here" Attorney at Law. That way they will at the very least think that you have an attorney and they might give you the info if they know you mean business. I've done that before and it worked very well LOL

My son had a very small fender bender in white hen parking lot and the police did a report. GO to small claims. it is very easy the people will help you though the paper work. I live in IL.

You have a phone number so it can't be that hard to get an address. Drive by and get the license plate number off the car. Give that information to the police and your insurance company. Someone can look up the plate through the DMV and get the insurance information. Your insurance company may be able to do that for you.
