A woman I work with fell Friday morning at a local Burger King. She broke her arm in the fall and arrived at work with a cast on her right arm.
I spent some time talking to her about having a broken arm since I have done this a few times myself and told her that it takes a few days to adjust to but it gets easier to work with. She then decided to see the ambulance chasing lawyer across the hall just to be sure that her medical bills would be paid (as if Burger King had not already told her that they would pay for everything). And she signed a contract with him (and I am sure that she is looking to see how much she will collect for her pain and suffering).
So now to today. She arrives at work and she doesn't have the cast on her arm. She's wearing on of those wrist braces that you can buy at any pharmacy. She decided that she couldn't work with the cast and went home and cut it off. Now she has a case against Burger King and she was concerned about any long term damage to her arm, but if she cuts off the cast it would seem to me that she's asking for long term damage. And she won't call the orthopedist even though her muscles in her hand are hurting.
I can see a kid doing this but an adult who knows better??? What was she thinking at the time?? It's not as if she would loose her job if she had to work slower because of the case or that she couldn't call the orthopedist and ask for help. I just don't understand this at all.

she sure aint helping her case at all if there is one. How the heck can BK be liable if she isn't seeking the correct treatment and sticking w/the program? dimwit.

My thoughts exactly!! I would think she just negated any suit she would have had with Burger King!!

I just don't understand an adult ripping off a cast knowing that their arm is broken. It just doesn't make any sense.

well looks like they will have to pay the emergency room bills, but anything after she took the cast off is her problem now. and she's probably gonna get stuck with the lawyer fees too now

Did you mean you have broken your arm a few times or you have talked about broken arms before? If you have broken your arm before, with your experience, you could tell her that her arm won't heal right. I wonder if it's worth it for her to be in pain and possibly be deformed so she can try and pull one over on Buger King. Older peoples bones don't heal quickly, hopefully she will come to her senses.

I've only broken my collar bone and shoulder once. W/collar bone I had to wear a harness for almost 5 months...w/shoulder a cast for 6 weeks.
I've also been thru a pi case (personal injury)and it was a long one, too.
In order for her to collect anything lawyers look at medical records both hers/and her works attorney's.
If they find anything that she has done against ama (against medical advice) they will tell her it's her fault for further damages she's incured. I.E. tendonitis, arthritis, stiff joints, aches, pains, dislocation, another breakage.
Also they look at the meds. that are given if she's not taking those either...that's ama.
Plus........I know from experience years down the road she'll regret it. Her injury will not heal properly and it will cause her problems later in life. No matter what she does to protect it. They put the cast on to keep her arm stationary.....there's a reason for it.
I made the mistake of not taking p/t after I broke my collar bone...(didn't think I needed it). Here it is almost 25 years later and I have arthritis in that shoulder.
I would highly advise she get another cast put on or at least put her arm in a sling.....She'll pay for further down the road. Plus, employer will not pay as much she's expecting.
Hate to say it but for that kind of injury she'll be lucky if all her medical bills are paid (after she's taken off cast) along w/maybe $15,000 settlement which in our state my lawyer received 33.3% of my total judgement. Believe me they charge you for every little thing as well.....
Making calls, copies, filing lawsuit, when they speak to you on phone, any personal pay out that they make to you, drs. her attorney will send her to for further treatment.
When all is said and done she'll pay for it ALL out of that $15,000. (just an example).
Just a heads up...I hope it all works out for her in the end. She should of NEVER taken the cast off....that's the worst thing she could of done....will cause/create more damage later down the road for her.

I think someone should contact Burger King and tell them what she has done.;) Maybe she took the cast off to prolong her injury in hopes to get more money.

Thanks for the info. I knew as soon as I saw her without the cast that this was not good. She's a lunatic.

I also agree with this. But, HOW do you cut off a cast at home esp with only one hand. What if she'd have cut the arm or something!1 Few screws loose there, I'd say.

:O I could not believe that she cut her cast off, that just blew my mind. You guys are right she will pay for it down the road, since she went ama she will prob. get nothing, and will end up not healing right/deformed. I ripped a tendon in my left knee and never got it treated because of $ reasons, I am under 30 and I have arthritis and am constantily hurting, I wish I wouldnt have been so cheap and gotten it taken care of when it happened, in the long run it would have been better.

JMO...I think she'll get something for her injury since it did happen on work property....SHE WILL NOT get anything close to what she's expecting. When she took off that cast she was not only hurting herself but her case as well.
You never know but they (Burger King) could have hired private dectectives thru their attorney to follow her around...when they get wind that she's filed suit. It happened to me.
They (private investigators) watch you like a hawk, take video's, photo's.....and anything else they can think of. I forgot to mention that if she takes time off from work they (emp. attorney's) look at that as well.
At my trial they had photo's of me getting into cars (I was going to drs. appts.), going to pharmacy, going to see my attorney. All of which they stated in court that if I was as bad off as I'd stated in my suit I wouldn't of gone. I had saved EVERY receipt from attorney's visits, pharmacy, had a detailed list of dates, times of all drs. appts. Other than that I didn't leave the house...literally.
I'm sorry she's done this to herself. She has no one to blame but herself and she's losing in the long run.

My guess is the arm wasn't broken to begin with.
And she just lost her case. BK is not obligated to pay anything towards her medical costs.

It is broken. She actually went to the emergency room and I saw the fiber glass cast.
She's wearing the brace but I know that she's probably doing damage to that arm. And she cut it off with some sort of saw that she uses for her art work.
I am still flabergasted that someone would cut a cast off a broken arm.
