WTF!! Exactly 3yrs ago this month, I was involved in an 8 car pileup going back to work from lunch. I was the 4th car in. Now, today, I receive a summons and complaint from the passenger of the second car. He is even suing the driver of the car he was in!!! LOL Gotta be family, cuz the last names are the same. Why the hell are ppl so f'n sue crazy? The guy's looking for 25K in damages. Suing all parties involved. I don't have the f'n funds for a lawyer. chit. WTF.

There was very little damage to my front end, I was actually pushed by the lady behind me into some guy that had a new car only 15days old. My vehicle only had 609 miles on it and was only 3mos old. This sux. I don't need this now. Thanx for letting me vent.

Now that I think of it, I think it was the driver of the second car (the car this guy was in) was the one ticketed.

You are not responsible for this accident then you shouldn't have to worry about being sued. Why did this person wait 8 years to sue? I thought there was a time period that would expire on lawsuits for accidents. I would contact your insurance company and tell them what is going on. There are attorney's that you can get through legal aid that shouldn't cost anything. I would get one though. I hope this goes away soon.

hugs. I know that my car insurance company will provide you with an attorney. You might want to check and see if your insurance company provides this.

I can feel for ya. We have two lawsuits going on against us for traffic accidents. Neither hubby nor I was driving. But it was our "drivers'" fault both times. Anyhow, I hope the insurance company can take care of us. But it really pisses me off that people are so sue happy.

Well, from what I'm reading in this thread, I'm gonna contact my insurance. I really didn't know who to call at first. I didn't think of them really cuz this dude is suing me, not my ins. Thanx for the idea.

call your insurance and they should be able to tell you also when the statue of limitations runs out on this accident, hubby received a paper from his insurance and the lady had to a certain date to file a suit after that date she can not do anything, the date has past we never heard anything about it, too late for her to come back now.

This is too funny. I am sure that as the passenger in the car his medical bills were covered by the driver's insurance. He's probably going to go for pain and suffering which is almost impossible to really collect unless you loose a limb or have major medical damage and if that is the case $25,000 isn't enough.

Your insurance company will know how to handle this. It's almost too funny to be taken seriously.

Just got back from ins. co. They're taking care of it. Apparently, this guy suing me had the same ins agent at the time, and since has gone elsewhere cuz their dd had probs with her driving record. But my ins said that their claims ofc will contact me, I have to do nothing more!!! Thanx u guys! Yay! No lawyer fees!

Well, speaking as a paralegal for a plaintiff's firm (ok don't hate me) I don't think this guy has a leg to stand on. There has to be some proof there that YOU caused the damage to his car. Also, most states that I know of have a 2 year statute of limitations on personal injury type lawsuits.

Everyone is sue crazy these days. That's why our insurance rates keep going up!

Over a year ago, my hubby & I were in an auto accident. This lady ran a red light & hit my car (I was driving). We got a lawyer only because Steve was hurt. Had it not been that he was injured, we would have settled with her insurance company to fix my car.

((((twinkiesmom)))) You need to talk to your insurance agent. Good luck & let us know how things are going.

Good luck. I got sued a couple years ago because a drunk chick was in the back of a convertible (sittin like they do in parade) I was driving and fell out (I was 19 at the time, she was almost 30. Think she would know better???) They tried to get over 25K out of me. Insurance company got a lawyer for me, I told the lawyer these people called their attorney on a weekly basis (no lie!) to see if they could sue for this and that. People are scared to fart sideways around these people! They also said she couldn't "perform her wifely duties" I told the lawyer she couldn't because she was having an affair on her husband. I was soooo willing to go to court;) but they settled for 3 grand that the insurance company paid (but my insurance went up a bit). and as someone else said, statue of limitations is usually 2 years. It is in Ohio and they waited RIGHT before it was up to sue me. Good luck though. Sounds like you'll be ok on this one!:)

I know this is basically true, the majority of the country is sue happy, but I would hope more ppl are like me... a kid crossed 4 lanes of traffic in front of me... this was the first injury to my back, I never sued... 3 months later I fell on a wet floor at a restaraunt... there was no 'caution' sign and I ended up in physical therapy for 4 months and usually have to go 2 months a year cause I 'throw' it out... I could and SHOULD have sued this man, but he was a new business owner and I did not want to be the reason he lost insurance coverage (altho I doubt he would have, but I was worried about it). My husband thinks I need to sue for alot of money to cover all future surgeries and such, but the statute of limitations is up now so it's pointless... at any rate, we aren't *all* sue happy, I personally hate the legal system and unless I absolutely had to, would rather go get my insurance covered massages from the PT than step foot in a court room.

In January of 2001 my DH was in an accident involving him and a semi truck. It was 4am and icy roads. Dh was on his way to work...going up hill at about 10-15mph...semi coming other direction, just took off from sitting at red light going about 10mph. Dh hits patch of ice and slides into path of semi...semi trys to pull to shoulder of road as far as he can and is putting on brakes so now he is only going about 5mph. DH hits drivers side front panel on semi (Hubby in chevy s10 truck). Dh truck is totaled minor damage to semi. Hubby literally walks away (by grace of GOD). 1&1/2 yrs later get letter we are being sued cuz semi driver hurt in accident! OMG! Says severe back injury and has been out of work! Gimme a break, he was in big ole truck and DH in little s10! Hubby ok but semi driver not? I don't think so! I think he just too lazy to work...tried work comp first and denied so decided to sue. Turned info over to insurance company and never heard another thing of it. People are sue crazy these days!

LOL. In one of the lawsuits against us, they also used "couldn't perform his duties as a husband." Please, I don't even want to know.
