DOCS MUST REPORT KID SEX: JUDGE

BRIDGEPORT, Conn. - A Superior Court judge yesterday refused to dismiss the case against two doctors charged with failing to report the pregnancy of an 11-year-old who allegedly had been sexually abused by a 75-year-old man.
Attorneys for Drs. Mukesh Shah and Ann Lule argued that a state law requiring doctors to report suspected child abuse was unconstitutionally vague. It does not give physicians adequate guidance detailing when they are required to file a report, the attorneys said.
The doctors, who each face a $500 fine, are the first in the state charged under the law.
The girl was examined by the doctors in March and was found to be pregnant. The doctors questioned her about her sexual history, but she denied ever having sex and was referred to a clinic.
Superior Court Judge Elizabeth Bozzuto said parties challenging the constitutionality of a law bear the "heavy burden" of proving the law unconstitutional beyond a reasonable doubt.
"The court concludes that the defendant has failed to meet that burden," Bozzuto wrote.
