What do I do??
Yesterday, my phone rang while I was getting dressed to go to my grandmother's house. Before I left town, I listened to the voicemail and it was a police detective asking me to call him back. I figured my ex-husband was trying to start something, so I called him back. Apparently, my daughter went forward on Wednesday to school officials saying her daddy was "bad-touching" her as recently as last week. Of course, Child Protective Services were called and when she was interviewed yesterday morning by a case worker and the police detective, she told them that last Wednesday night, while her step-mother was at the grocery, her father took her in the bedroom and proceeded to touch her (I won't go into detail about it because it can be disturbing). I was told that the police and CPS were going to investigate the claim. Another call from the detective yesterday afternoon told me that the ex is "unwilling to suspend visitation" during the investigation and the family court judge recommended that I go file an EPO against him to keep the kids away from him at least for a while. She signed the EPO into effect yesterday afternoon for me and we have a DVO hearing on the 19th in front of this same judge. My main issue is that this is the THIRD time she has claimed he was molesting her and the third time they have investigated him. During the second investigation, they found physical evidence that she had been molested, but said they didn't have any DNA evidence to link it to him, so they couldn't do anything. He also passed a polygraph test, so they said it was her word against his. They told me yesterday that this was a hard type of case to prove and they weren't sure they could do anything more than they have done in the past. And when my lawyer tried to get the police to reinvestigate back in February of this year, they told him that "not enough has happened" for them to take it any further. HELLO?!?!?!? What exactly has to happen for them to take my daughter seriously??? A 5/6 year old goes into details about things NO child that young should know about and says for over a year that HE is the one doing it to her, why can they not believe her??
I know that I've done everything I can legally, and done more than I should (legally) because I refused him visitation after they closed the second investigation back in December (was looking at nine counts of contempt of court before I finally let visitation resume). My question is, when it looks like EVERYTHING is against her, what do I do??
I'm sorry this post is so long. And I truly appreciate it if you read through it and made it this far. I just needed to get it off my chest so maybe I can think through it a little clearer.

OMG, I'm so sorry about all of this! This is exactly why I stated I do NOT trust CPS!! This is insane that they're allowing him to continually abuse your daughter. I wish I knew what to tell you

omg.. I am so sorry your dd and your family are going thru this.. I don't really have any advice.. except keep doing what you are doing.. and I wonder.. would a little local media attention help the law enforcement take this a little more seriously?

 I'm so sorry. Your poor baby.  Check into getting a spy cam or something. Maybe you can send her with a teddy bear that's really a nanny cam. Has she been examined by a doctor? That should give them evidence.

Honestly, after the last episode with CPS doing nothing, I emailed Dr Phil while he was on his kick about protecting children. I never got a response. I'm not sure the local media would do anything about it...

She hasn't been examined this time, I'm not sure if she will be. She was examined the first two times, the second exam revealing a torn hymen. But, they said with no DNA evidence (they waited 9 days after the inital reporting to have her examined - another of my big issues) to link it to him.

Are you able to petition the courts for supervised only visitations? After all is said and done that's all I'd be willing to give him...and that's stretching it!
Take her to the ER and have her examined yourself, screw waiting on the police to do it!

For the 2nd investigation, I took her to the ER. Because of her age, the local ER refuses to examine her. They send her to Hopkinsville (which is 30mins away). Back in September (2nd case), she had an appointment the following morning and the caseworker called right before we left and told me not to take her, she had changed the appointment to the following week. I have gone to the courts before to try and get supervised visitation and the judge shot me down. Said there wasn't enough evidence. Honestly, I don't know what else I can do.

Drive her to Hopkinsville and have her examined. You're a better person than I am by now I think I'd be in jail for killing the ex!

Hopkinsville won't allow me to walk in off the street and have her examined. It's a state children's advocacy center that does the exams and they have to have CPS or the ER schedule the appointment. I'm screwed there. Because even if they find more evidence of it, it's too late to find DNA evidence seeing as how it happened on September 30th.
