You are having so much problems getting them to do anything now because of the few sick "mothers" out there who coach their daughters to make claims like this to cause problems for the ex.
The hymen can be torn at anytime with out there being molestation. For instance from an accident like on a bike ect. If this happens again, you need to take her immediately to the emergency room, to hell with the cost, and have them check her for rape. This is what it is. If he has done anything to her, there should be bruises or some sort of injury regardless.
I would be pushing for supervised visitation if any visitation at all with this monster.

One of those Lifetime movies I watched a few years ago is about a woman who went " underground" ( there are organizations for this) and they ended up finding the mom but not the daughter. She sat in jail and they wouldnt let her out til she told where her daughter was. She refused and stayed in jail. I dont remember how long she did, but the media was all over it... based on a true story. I personally would give him some country justice... the " dad" would be wearing cement shoes taking a swim at the lake , kwim?

I can't believe everyone is saying pack up and leave... I know that I personally don't have the money to leave my home and run from someone that is in the wrong. I say stand your ground and fight!
I'm also thinking something just doesn't sound right... why is she still visiting him and why hasn't he been arrested for this? I know people that have paddled their kids and sat in jail for 30 days. You need to start making some phone calls and take care of it. My daughter's father took her to a bar while he had her and that was the end of his visitation rights... and it was very easy to do.

They are telling her what they would do in her circumstances. Did you read all the official channels that she has been trying to go thru? They aren't working. She could deny him his court ordered visitation but then she may land in jail and he'd have the child full time How would that be better? Standing your ground and fighting is one thing but NOT at the expense of further abuse to her child. Just because it was easy for you to get your ex's rights terminated doesn't mean it is that way everywhere and face it kids fall through the cracks of our imperfect system all the time a lot of the time it results in death or a life of misery.

Update!!
For all those that took the time to read about my problem, post encouraging comments, and actually send up those good thoughts/vibes and prayers, I should have updated sooner. We went to court on the 19th and, after four hours in the courthouse and actually talking to the judge SEVERAL times that day, I actually got a 6mo DVO signed. The judge did tell me that I needed to file a motion to amend custody and visitation in our divorce action. I'm planning on asking for sole custody and I'll offer supervised visitation, nothing more. So far, I have heard nothing more from CPS or the investigating detective, I'm just not sure if "No news is good news" applies in this situation.
