Angry So angry I'm shaking....

Sorry, super long vent...

Ok, back in june my kids were taking our jack russel for a walk on his leash in our back yard. We have a large yard, and haven't been able to afford to put in a fence, and I don't let my dogs just run around. (We are in a VERY rural, btw) Well, my neighbors two houses down have a rottweiler, and although they do have a chain link fence, she has a history of getting out. They know this, well she gets out, runs to my yard and proceeds to attack my dog with my children right there. My daughter is 10 and my son is 8. My daughter was holding the leash, and the only reason my dog, Snickers, survived was because my dd tried to pull him out of the way so the rott was only able to attack his back half. He ended up needing surgery, $3000 worth. Well my neighbor says i'm sorry we can' afford it. We managed to get financing for his surgery and I'm glad to say he is back to 100%. I told them the dog had to go, one way or another. He took her up to his moms house, and I didn't sue for the vet bills because, well to be honest I clearly let people walk all over me.
So, a month after this he says that he's bringing the dog back because she is allergic to something at his mom's house. But he promises this time he'll fix the fence so she can't get out. UGH Again...let people walk all over me.
Fast forward to today, I go to get the mail, and that dog is out running around the neighborhood! They aren't home, so I put a note in their mailbox telling them that the dog needs to go now. I'm giving them a week to get her out of here or I'm calling a lawyer.

If you made it through all that thanks for listening! I just really needed to vent about this!

Do you have leash laws where you live? If so, I'd call animal control. I wouldn't hesitate to call a lawyer. Their dog inflicted major injury to your dog and major financial costs to you. Too bad that they can't afford the $3000. Neither can you. Go to small claims court and let the judge set up a payment plan for them. Their animal went onto your private property, not the other way around. It could have been one of your children that got the brunt of it.

If this dog has a history of getting out then you need to call your local animal control and make reports.. Plus I wouldn't give an eff if they cannot afford it.. Call your lawyer and sue the bastages. Why should you have to pay for something you didn't do? Why even give them a week? You cannot impose stuff like that on them since you are not the law.. They don't have to listen to your letter... They were the ones breaking the law even if you live in a very rural area...

u know if they dont remove the dog then u do need to go and have something done about it. because maybe next time it wont be the dog it my be your kids or somone elses kids. once a dog like that has a taste for blood then it wont stop until it can get some more.

the dog attacked the dog, not the kids...

yes, living in the country is another sweet thing, if you have a gun, use it.
I would get out your vet bills, and take them to a lawyer and see about what you can do, but I would do it now, it's been almost 4 months since it happened. Get your neighbors phone number, call them every time you see their dog out, better yet, go to there house and tell them, every single time.

make the calls; local police, sherriff, whatever....
you need to have documentation for if you need to go court (small claims; maybe judge judy)
sue for not only the vet bills but also for what your kids had to witness and for the possibility of getting mauled themselves.
