You guys are great!! I was really worried that I was the only one thinking that way. I will definately return the box and NOT refund his money. I did save all his emails including the one where he explained to me how "MY" car was broken and in the same way his was.I told my hubby about this and he said the same thing as everyone else. This was my very first thing I have sold on Ebay and boy what an eye opener this guy was. He keeps emailing me with when am I gonna refund his $56, how about NEVER BOZO!! LOL

I think that this is the very reason that a lot of people are suggesting insurance as an option on their auctions and saying something to the effect of "not being responsible once it has left my hands." I suspect that this kind of thing happens a lot on eBay and I would not refund his money either. If he leaves a neg, just respond:
"Did not purchase insurance, I am not responsible."

I just thought of something else, if it went to him through UPS you might want to call them and ask if there was any insurance on it. I know that when you mail through the UPS store they automatically insure packages for $100. The last time I mailed a package through them, the cashier told me about that and asked me if I needed a higher amount of insurance added. If they tell you that it was insured, then tell him to file a insurance claim through UPS. All he would need to do is give them a copy of the auction listing and show his payment.

How could he determine that your NEW car is broke the same way unless he took yours apart as well? And since we can assume that he took yours apart since he knows yours is "broke" the same way as his, then ask him how are you to know that he didn't "break" yours while taking it apart I agree with everyone else, sounds like he is trying to pull a fast one. UPS automatically covers all pkgs for $100 replacement value( and replacement value of the merchandise is all they will pay). The guy who bought it can file a damage claim, but they wouldn't pay him if they approved the claim, they would either pay gobs if she shipped from a UPS counter or if she shipped from a UPS store,UPS would consider the store the shipper and they would get the refund. It would then be up to the store to pay her.

For UPS to approve a damage claim, you have to have the merchandise, the original box and all packaging material....if any of those are missing, they usually deny the claim. On merchandise with a value of less than $100, UPS usually won't even inspect the package, but they reserve the right to do so...

UPS wouldn't nessecarily pay what he paid in the auction, they'd pay the amount of the cheapest replacement available.

Okay thanks fatesfaery, I was not exactly sure of how it worked. I have never needed to file a claim through them. But since the seller would have to be in posession of the item and all of the packaging material, maybe the best thing for her to do afterall, is to tell him to take his set back to where ever he purchased it and insist that she is not responsible for damages in shipping. Filing a claim herself just seems like alot of hassle, considering that it is pretty obvious that he was trying to dupe her from the start. If he had been honest with her and the item had really been damaged in shipping, then maybe it would have been worth the effort to file a claim for it on his behalf.
