Homeless..
Looks like thats what Im going to be.  I got behind on my house payments but sent them a payment for the total amt I was behind on 2/5, a personal check, how I always pay my mortgage. I get a letter from the mortgage co as well as two letters from a lawyers office today saying I am in forclosure.  I called them. They said they didnt get my check until the 17th of feb.  I cant beleive it took that long to get there. And I was already in forclosure so they couldnt accept anything but certified funds. I told them I called and told them that I had mailed out the check for the total amt due and was told it was ok. This person said there was no notation to that fact.
They say there is nothing they can do for me. Now they want me to pay the lawyers fees and reinstatement fees totaling @ $1000.00  I dont have it. I am on SSI, I only make $423.oo a month. Its all I can do to pay the payment. I dont know what I am going to do now. Looks like Im going to loose my home. And I and my son will be out on the streets. I have no where else to go. I am so upset I just cant stop crying.

never returned the check. I dont know if they cashed it or not going to check at the bank tomorrow. I cant even pay this lawyer dont know how I would pay another one.

If they cashed it or deposited it..then they ACCEPTED it as payment..FIGHT THIS!!

Contact your local department of Social Services. They may be able to help. There can be emergency funds available. It's certainly worth a shot, just do it right away so there is time. Good Luck and keep us posted.

I don't know what the law is in your state, but here, it's illegal to foreclose until the payment is 90 days overdue.
That's just so not fair. I'm so sorry

It was 81 days past due is what she told me today. I sent the check on the 5th of feb .. have a grace period until the 15th for my payment.. but she said that didnt count. the grace period was only for avoiding the late fees.

Oh gosh, I feel really bad for you. I wish I had some advice but I don't. I'm sure there are people here that do though. Just try to hang in there. There has to be a way to work through this, especially since you did mail in the payment.

{{{{{scifiwoman**********, I am so sorry, please check with your Social Services, they do have a fund called diversonary fund that can help you catch up on your bills. I found this out after having to get some help myself because of hubby being off work for almost a month due to weather. Also try Community Action, United Way local churches or whatever. Fight for your home, it is crappy the way these mortgage co's do, my hubby talked to one about ours and she did not make any notations either. We have been close to foreclosure lately because of my hubby's work situation. I feel so bad for you, I hope that you can get this straightened out. Also try Legal Aide for attorney help.

Is there a legal aid in your area also call your congressman about this and have them check into this on your behalf all you have to do is sign a consent form for them to do so, if you can't get out to do this call and have them mail you the form and then you can mail it back, I know your tired of fighting and yo have had a terrible time this winter but you must fight this but don't try and do it alone call the congressman and the senator if necessary thats what they and their staff are there for, are there for. Also call your local disabilities offices look them up on the computer if you don't have their numbers and get help. Good Luck! Also you should have received several letters warning you of the foreclosure and the date that it would be started if you did not then hit them with that.

Scifi,
Try to contact your local County Bar Association. They will be able to guide you to someone who will be able to help you.
Also, be sure to get with your bank to determine if the check was cashed. If it was, then they really have no grounds to stand on as they told you they would only accept a certified check.
Another thing, they cant throw you out of your house just because they say you are in foreclosure. First of all they would have had to have sent you certified letters telling you the property was going into foreclosure and how you needed to take care of the situation. Second, once a property is in foreclosure, the county has to be notified and this procedure can take several months. After that, the property is usually auctioned off and depending on how much of the homes value they bank/mortgage company wants, determines the opening bid. Until another person has bought the property, you dont have to move. In the mean time, you dont have to make a payment either.
