Please call your congressman and put him to work for you, even though they have not cashed the check they are holding the check, can they do that, to me it seems that they should not be able to do this, that check is the same as money and it is an attempt by you to pay the payment and if they have no intention of accepting it then they should not be able to hold it, as long as they have that check then you may have them, call your congressman's office and talk to his staff about this, someone there will be glad to look into this situation for you. Make sure they know you are disabled and have an underage child at home. Perhaps there are some programs in place to assist the disabled in this type of situation. Your Congressman should have a number in the phone book under government offices and in my phone book he also has his number listed under his name in the white pages. What county in Va. do you live in if you can't find the number I will look for it for you, just let me know I will be happy to find it for you if you need me too.

SFW I don't know if this will help but have you contacted the Salvation Army? They work with the homeless — in fact, many organizations do — and it could be a constructive start, placing you on a path that you might not previously have envisioned.
This is the curse of depression friends: It robs you of your ability to see options. But SFW you do have options and if you can be patient they will reveal themselves to you, but only when you are ready. The only constant in the universe is change, but what if you were to choose the next road you travel down — not the bank? Just think about it. Let it percolate. Life places us on the most precarious paths, doesn't it? And oh! to be a happy-go-lucky soul! I am not. But I have learned with age to turn adversity on its head and instead of seeing the terrifying unknown, wonder instead at the adventure that awaits . . .

Along with calling your congressman, go to your local newspaper or television station. Some of them have troubleshooters who will help you resolve your problems. I'm sure that if the public were made aware that your mortgage company was about to evict a disabled woman and her son after you sent a check, public opinion of the bank would change. I see stories simlilar yours on the local news often. After the story becomes public knowledge, the bank may work with you. I hope everything works out for you.

Hello,I'm new I just read your post. Sorry to hear about it. I went threw this about 5 years ago. The bank also told me there was nothing they could do at this point. (Blah to them)! I contacted a lawyer got an appointment with in two days, and told her my story, She (laywer)called the bank personaly while I was still there.Got the loan officer to add the late fees and the banks attonery fees to the end of my mortgage payoff. Well now 4 years later I sold my house and paid the bank of in full. I know times are tough but you will get threw this. Good Luck.

Welcome to BBS lilbugger! This is a great idea I never even thought of that one, maybe the bank will roll the payment for those extra charges to the end of the loan, also since you are disabled and getting a check perhaps you could agree to allow them to take their payment out of your account, that might also make them stop the forelosure, hows it going, have you heard anything? Did you ever call your Congressman these people can help more than you realize, if you have not called them yet please do so. Keeping my fingers crossed for you.

We have got many letters stating that we are going to be put in forclosure if you don't get payed up to date. I always make one months payment and they back off until next month. If they keep your check then it sounds like they took your payment. This is the first time that I ever heard of a mortgage co. not trying to work to help you keep your house. I know some people who hadn't made their house payment in over six months then they were applying for SS after they got behind. They ended up working things out where the payments were rolled to the back of the loan and they refinaced the loan so the payment were lower. Please take Mesue's advice and call your congressman they will help you Don't let this company take your house away from you. Also call your local TV station like other have suggested. They will help you get the bank to back off and help you. Welcome to BBS lilbugger.

they finally sent my check back and they lied to me about when they got it. They told me they received it on the 17th but on the check was written 2/10 and stamped 2/14. So either way they lied.
today I got a letter from legal aid telling me they had sent them a letter requesting some info but that he didnt think there was anything he could do for me and he suggested I find another place to live. Easier said than done.
Also today got a letter from their attorney saying my home is being sold on the 21st of this month  . That gives me 2 weeks to find somewhere to go. I dont know what I am going to do. I have no where to go.
