i had to give my first eviction notice...
well, the time had finally come. we have been landlords for 7 of the 8 years we have been married. (btw, tomorrow 4.9 is our 8th anniversary!) we have 11 houses we own that we rent out. this is the first time we have actually had to evict someone. she owes us $1125 in back rent and has moved in two people into the house that we did not approve of. The lease states that the people that rent it may not let anyone else live in the house without our written permission, and she never asked and moved in her great aunt and her brother. this is a three bedroom house with four adults and two children. on the sly last fall she moved in her great aunt and within the past two weeks she has moved in her brother. the initial tenants are the woman, her two kids and her mother, those are the only ones on the lease. so she broke her lease when she moved in her great aunt last fall, then, in january her rent checks started to bounce. nothing but trouble since then. we can never get ahold of her, she doesnt answer her phone. whenever we stop by, she's not there, but other people are. today was the straw that broke the camels back. i got a call from a rental agency here in town that she had called and asked them for a house to rent. Thank GOD they check references! she claimed we raised her rent $250 since her brother moved in (which we just found out about LAST WEEK that he moved in just by chance my dh stopped by to get some rent money and she wasnt there... ) which is a TOTAL LIE!! and also, they asked her if she was in a lease and she said yes, but they will let us out of it if we just pay this months rent, which also is a TOTAL LIE!! we have a one year lease with them which will expire July 15th. to me, the best part is that the rental agency who called me today knows hubby and i very well from church! they *love* bella and know exactly who we are and where we sit at church. so basically what i'm saying is that they know we are upstanding, good citizens and good landlords. ya know, we try to help any of our tenants when things go bad, we dont mind breaking up payments or paying late... IF you call and be honest and explain your situation to us. we are human too, we are also having troubles. BUT... this is one of our more expensive houses and we cannot afford to carry her with the rent, especially since she wont communicate with us or let us know she's having problems. we have bills too that are due the same time every month, just as her rent is. if she moves out on the timeline she is asked, we will still have to sue her for unpaid bills (water, etc.) and unpaid rent and any damage left to the house. all we asked her to do was to be honest... but i guess she couldnt be...

With the extra adults in the house, you would think she could at least come up with some of the money Sounds to me like she is trying to save up for the move. Is her deposit enough to cover any of what she owes?

I am sure that OP knows you can't take security deposit for part of the rent - big NO NO. Sorry you have had to deal with a bad tenant. At least you found out what her game was. Good luck the eviction process is definitely in her favor not the landlord's.

I'd hate to be in your position today, as a landlord.
Is there a timeline you must follow to start the eviction?
If not, I'd do it now.
Take the rental agency to the hearing as a witness; to prove the lies she has told

edit- duh it says so in your thread title..... that's pretty good though for that long and that many properties

Dont know where you are, but if you are in KY, I hope they dont have small children. My cousin just bought some property with a rental house on it and is not allowed to evict the tenant because her grandchildren live with her...No matter HOW far behind she gets.

I would bet they are considered foster children which does make it nearly impossible to get rid of them. You can evict them but you have to go to court to get the eviction order from a Judge and they get a lot of extra time since they are foster parents. But your Cousin needs to call a real estate attorney and I bet he could get the process started it might cost her legal fees but that would be better than not getting rent.
