in-laws (update & new whine) lol
Ok...this is sort of an ad-on whine to a previous post I made here :

anyway....its been 6 months & they are still here....still without jobs....well wednesday bil started in on hubby and a fight broke out...me & kids were hiding locked in our room...we had to call the cops to have them removed...knowing how my bil is...apparently they couldn't find anyone else to take them in, so thursday my mil says he contacted a lawyer & said that since they have established residency here...gets mail here etc...not that the pay us anything mind u....but legally we cannot kick them out without 30 days notice...so guess who came back? I told my hubby that there is NO WAY in hell that I am staying in this house by myself all day with them for the next 30 days...with him at work & my kids at school....so my mil moved in so I wouldn't have to be alone...bil has a major temper and he scares me...no foolin...hubby's gonna move the puter in my room so that I can stay in there all day til he gets home...seriously I feel like a prisoner here. Besides, bil blames this whole thing on me...calling me names & screamin....ugh...
Does anyone know if what he says is true? About the residency thing? Because I cannot imagine living the next 30 days of my life hiding in my room...

I don't think that is true. I would go get a PFA on him & they would remove his butt for you. It happens everday when a couple is splitting up, someone always has to leave.

I do think that's true. I have actually seen this on COPS, believe it or noot. Laws may vary by state, though.
I would serve them with an eviction ntice TODAY and have a police officer witness it if you can.

Actually, I think Jkat is right. But maybe you could get an order of protection against your bil? You know, you're afraid of him and he has to stay so many feet away from you. Don't think he'd be able to live in the same house then. Get the eviction notice today then consult with a lawyer on the best way to handle this.

I think I would call the cops and ask them if what he says is true. Maybe they can tell you what to do if it is true. Now thats low class to move in with someone and then do them like that. I guarantee when I got him out he'd never come back again. I'm sorry for what he's putting you through.

Bless your heart! What a mess that sounds like. I would go to the local police department and ask them that same question. If they do say that is the case, then I would go to the local magistrates office and file an eviction notice and have it served on his behind. It may cost $50 to have it filed/served, i'm really not sure. I would guess it would be well worth that though. If your lucky he will take great offense to that, get ticked off and never bother you again. Good luck to you and please let us know how it goes.

I live in Ohio and I have always heard that that is true. I would consult a lawyer though if I was you. We had a good friend who was a cop (miss you Greg) and he always said that he would not give out advice on civil law, which I think that would be.
Edited to add that I would think you could get a restraining order on your BIL and he would have to leave the house. Maybe if he has to go, the rest of them will go too.

I am not familiar with Ohio laws, but I do know in the state of Michigan, they have to be served with a 30 day notice, then if they don't move on the 30th day, you have to take them to court, then the court allows them 10 days to move, if they don't move, the sheriff can remove them on the 11th day, but this is not a speedy process at all.
I would definately suggest getting a personal protection order against him, that way you don't have to mess with the whole court process.

Did the "lawyer" serve you with papers to let him back in? Or did MIL just say this?
I would have told his ass to serve you to be let back in, then in the mean time filed for eviction. There is no way I would stay there, whether MIL was there or not.
You have been putting up with this crap for way too long.
