Killer on Probation Fingered in Robbery
PEMBROKE PARK, Fla. (AP) -- Lionel Tate, the youngest person in modern U.S. history to be sentenced to life in prison, has been arrested after pulling a gun on a pizza delivery man at a friend's apartment and beating up the friend, investigators said.
Tate, now 18, was being held early Tuesday at the Broward County Jail on charges of armed robbery of the driver, armed burglary with battery on the boy and probation violation.
He was serving probation following his release on a guilty plea to second-degree murder in the beating death of a 6-year-old family friend when he was 12. Tate was expected to make his first court appearance Tuesday. A probation violation normally allows no bail.
Tate called in a pizza order Monday from the friend's apartment and pointed a gun at the delivery man when he arrived, said Broward sheriff's spokeswoman Elizabeth Calzadilla-Fiallo. The man dropped the four pizzas and called police after returning to the restaurant.

Tate left the
12-year-old friend's apartment while waiting for the pizza, forced his way back in when the boy resisted and repeatedly hit him before the delivery man arrived in this Fort Lauderdale suburb, said Calzadilla-Fiallo.
The delivery man returned to the apartment complex with deputies, saw Tate in the area and identified him as the suspect, said Calzadilla-Fiallo. No gun was recovered.
Attorney Richard Rosenbaum, who has represented Tate, told The Associated Press that Tate and his mother called him as he was being arrested. "I heard he jacked a pizza delivery guy, which I can't believe happened," Rosenbaum said. "I'm shocked and appalled."
Tate made headlines when he was charged with first-degree murder in the killing of Tiffany Eunick. He was convicted in 1999 and sent to prison for life without chance of parole. He won a new trial on appeal and went free in January 2004 under a deal that placed him under house arrest for a year followed by probation for 10 years.
Tate first claimed Tiffany was injured whey he imitated wrestling moves that he saw on television. He changed his story years later and said he accidentally killed Tiffany when he jumped on her from a staircase while his mother was baby-sitting the girl. Tate weighed 160 pounds; Tiffany weighed about 50.
He was arrested in September for violating probation by being out of his home overnight after an argument with his mother. A judge added another five years to the 10 years Tate had left on the original probation.

Why would they let him out? He committed MURDER, oh and they slapped him on the wrist with more probation. Lock him up, get him off the streets.

Could you imagine being 56 years old in prison for killing some one when your were twelve? How long does a person have to pay a debt to society?
I hope Bronson makes it 5-0 on Thursday.

For murder? I would think that debt is not repayable. Especially the murder of a child. It is precisely the mentality that a debt of murder or rape or sexual assualt on a child can be repayed that continually allows violent and habitual criminals back on the streets. As Florida now, how should that debt be paid? With the life of your child when that depraved individual strikes your child.

Re: remember the fla boy who killed the little girl with his "wrestling" moves, well.....
Well it is obvious that whatever counceling he needs wasn't supported after his release. Plus I don;t know the circumstances of the case other than a child died. If the two were wrestling then it is hard to say. What happens when two brothers wrestle and one is accidentally killed? The thought is the same. If a twelve year old killed my child I would react a lot differently than if an adult did it. Some children have a hard time understanding th consquences of their actions especially involving death. Some children get it some don't. Remember we aren't talking about premeditated stalking of a victim we are talking about to children wrestling.
The actions he takes after the fact are unfortunate, it seems to me like he fell into a bad crowd. The coractional institution is designed to rehabilitate people. If you lock up every Tom, Dick and Harry for life sentences starting from age twelve to eighteen there wouild be a lot of children in jail. I don't have the stats at hand to show how many child related deaths occured over the last 10 years. I would imagine it is a lot. Accident or not.
It must be really hard being a on a parole board and deciding through interviews what the best possible course would be in deciding someones fate. Will they kill again, what are their coping skills, what are their job skills, will they intergrate into society agian, do they even want to? There are so many questions to ask.

I think what Adam means is that the kid was 12. Most people would give him another chance, especially if they thought that what happened was an accident. Most people would not expect a 12 year old boy to serve life in prison for an accident (if it was one). I'm sure this kid just had a lot of people fooled. He's evil at the core, but that probably wasn't known to most people.

Re: remember the fla boy who killed the little girl with his "wrestling" moves, well.....
In January of 2001 a jury convicted Lionel Tate of first- degree murder for battering Tiffany Eunick to death on July 28, 1999 in the home of his mother, Ms. Grossett- Tate, a Florida state trooper, who was baby-sitting the girl.
Lionel testified that his mother was asleep in another room while he was playing a game with Tiffany in which he emulated the professional wrestlers he regarded as heroes. He stated that he body-slammed, kicked, and knee-dropped Tiffany and that he learned all of these moves from watching wrestling on television. Prosecutors said the girl's injuries — including a fractured skull, lacerated liver, fractured rib and swollen brain — indicated that the attack was extensive.
