    Exclamation So Sad/ Mad I can spit nails!

    PLEASE DONT FLAME ME FOR SKIPPING INFO OR MISS SPELLING OK, IM HIGHLY UPSET AND DONT KNOW WHERE ELSE TO TURN TO!

    OK, so I move here to Illinois and bring my 3 kids with me, to try and better the life of the kids, we live with sis and bro in law this starts in August, I look for job, finally found on 3 weeks ago, make good money, Give boss lowdown here so that there is no suprises later on ( hes real nice he dont deserve to be left in cold without secretary ) He sais OK, and I continue to work untill I tell him broNlaw wants to kick us out...so loose job because BroNlaw will not give me enough time to save up for place of my own.
    Sis & broNlaw talk about divorce ( of course broNlaw thinks im to blame ), Sis has been wanting for years. Today they went and got it finalized, BroN law gets wild hair up his rear and tells me we have a week to get out. is this doable? I aint got but $50 to my name how am I supposed to get out? he said if I dont he will have sherrif escort me out....he got house in divorce...doesnt residency mean anything? I was planning on moving ut anyway about 2nd week in april, but hes not even waiting that long, said will throw out crap out in dumpster, and buy us tickets for bus, cant leave my kids htings here its all they got from my divorce in first place! it aint much but crap give me some friggin time!
    To top it all off he calls my sister all sorts of names because he heard from someone else that she is sleeping around ( which shes not ) ... his family dont even get me started on them!....unknown to everyone else but me and my sis he is talking on internet to Russian gal, wants to meet her, has been for about a year.......im getting off track,.... is he able to just kick us out like that???? what about my kids and their school? I dont know what to do

    wow, wish i knew what to tell you. are there shelters in the area you can go to until you can get a place? hope you get it figured out soon. btw how old are your kids? maybe they could stay with a friend until you get this sorted out?

    yes, he is. if you don't have a written contract or whatever saying you can live there until whenever, he can make you leave. especially if you aren't paying rent or anything. (i'm not saying you don't, but i didn't see it in your post so i mentioned it.) even then, like i said, he can make you leave unless you have a contract. i know he doesn't rent because you said he got the house in the divorce settlement. i'm not 100% sure, but i think he can also throw your stuff out or sale it if you don't take it with you.

    Awhile back I let someone come live with us which turned out to be a horrible mistake.     I think this is true. I saw an episode of Judge Joe and it was a similar situation. A guy had let one of his friends move in with him and then they ended up in a fight over a girl and the guy wanted to kick his friend out but Judge Joe said he couldn't do that. I believe that once you've been living somewhere for a certain amount of time that you become a legal tenant whether or not you pay rent or are on the lease.

    yes he can kick you out because you don't have your name on the house. the only way he couldn't is if your kids were his. Where did your sister move to? Can you stay with her?

    I don't think he could here in Ohio, at least not at one point. My hubbys sis in law wanted to move in with us with her two kids. We were told that we had better not let her because a whole new set of rules kicked in when children were involved. It didn't make any difference if she paid rent or not, we would still have to go to court to get her and the kids out of here and that could take awhile.

    If I was you, I would check around for a womans shelter. There is no way I would want to leave my kids at that house while I was working.

    He has to have you evicted. If he throws your stuff away, you can sue him for damages. Call your local legal aid and find out your rights.

    Yes... he has to go to court and have you evicted. It does not matter if you have a contract (verbal or written) as long as you have been living there he can not throw you out on the street. Since you have been living there several months, its what is called an "implied contract" That also means, he can not change the locks on you while you are gone. Make sure you look up lanlord tennant laws in your area and make it known to him that you know your rights and aren't about to be bullied by him.
