    DUI question

    I was pulled over thursday/friday at 2:45am and was taken in for operating while intoxicated.
    The officer said I didn't stop at a stop sign. At first he said an intersection where there isn't a stop sign and I told him that there is not a stop sign there, he then said he mixed up the street names. He then asked if I had been drinking because he could smell alcohol I admitted yes I had 3 beers. He gave the abc's test and so on and then had me take a breathalyzer (not sure how to spell it). He then asked if someone could come get my car. He let my friends come get my car. He searched my car (with my permission) before he looked in I told him I did have an open beverage. I was not drinking it and the only reason I had it was because I left the house I was at when the couple I was hanging out with started fighting. My friends husband was choking her and I broke up the fight. He went to their bedroom and I tried to get her to leave with me but she would not and I told her I was worried for her saftey and did not want to stay and just went to my car. I had forgotten all about it worrying about her. I was not drinking it while I was driving but I am sure it doesn't really matter it was still open.
    Anyway her house is about 4 miles from mine and I was pulled over exactly 1 and 1/10 mile from my home. My breath test was a .08 both times. I had to stay in jail for 6 hours and post $100 to bail out. I live in Michigan and was pulled over by a State policeman. I have to go to court on Thursday. Does anyone have any idea about what will happen to me? Like how much are fines,fees? will I have to do community service? How long will I lose my license for? Will I have to go to jail?

    Get a lawyer who can best advise you on your situation. I have been to court recently as a witness and there were several DUI cases on the docket, none of them went to jail. I'm sure it depends on the judge, your prior record, and your specific circumstances.

    you won't go to jail, is this your first time?
    You will however, pay some pretty nice tickets and fines $$$$$$$$$$$$
    And you may/probably have to go to DUI classes, which will cost you $$$ also, you may have your license suspended untill you finish the classes. And of course, if you don't have a lawyer/or can't afford one, you can get one appointed to you when you go to court.
    Do ask for a deferred sentence, meaning that when this is all over with, it will not be on your public record.
    There's a lot of maybes and if's about it........ you will just have to wait and see when you go to court, just hope the judge is in a good mood. Do go dressed nicely (it shows the court and judge respect).

    .08 is considered legally intoxicated in most states and having an open container in your car doesn't help. If this is your first offense you shouldn't get any jail time but you'll probably get a hefty fine and possibly a license suspension and community service. And the police never believe the 2-3 beer thing and Breathalyzer's don't lie. Anyway, good luck in court.

    It is the first time I have been in trouble. I know they never believe the amount a person says they drank but I really did only have the 3 drinks. I don't know maybe it put me over the limit because I don't drink all that often, but thank you for the good luck.

    This might help you some. Aggie's from Michigan too. Sorry, I'm not sure about fines, community service. I've never been arrested or detained.

    You might want to call the state DMV and see if your license has already been suspended. When you are taken in for a DUI in Florida your license is automatically suspended. I have served a couple of times on jury duty for DUI's - GET AN ATTORNEY. Like someone mentioned above - dress very professionally it does make a difference to the judges.

    I know I should not type this but YOU SHOULD NOT HAVE BEEN BEHIND THE WHEEL OF THE CAR TO BEGIN WITH. YOU WHERE LEGALY DRUNK AND THANK GOD YOU DID NOT HURT ANYONE. SOMEONES MOTHER FATHER SISTER BROTHER OR CHILD WAS IN DANGER BECAUSE YOU GOT BEHIND THE WHEEL OF THE CAR. PEOPLE WHO DRINK AND DRIVE RISK NOT ONLY THEIR LIFES BUT THE LIFES OF OTHER PEOPLE ON THE ROAD. I DON'T CARE WHO GETS MAD AT THIS BUT YOU WERE WRONG WRONG WRONG. NO MATTER WHAT YOUR EXCUSES ARE. PLUS IF YOU WHERE SO WORRIED ABOUT YOUR FRIEND YOU COULD HAVE DIALED 911 AND YOU WOULD NOT HAVE HAD TO WORRY ABOUT YOUR FRIEND AT ALL THAT NIGHT.
