PPL From N. Carolina!!!

Ok I need some help here this might be a bit long but bear with me. My BIL is in North Carolina right now going to college. He's legally a resident in Michigan but lives in N. Carolina full time right now. Ok so he had a capital one card that he hasnt been able to pay on for over a year (He has called them and tried to work with them before like lowering the minimum payment, decreasing the finance charges, ect and they wouldnt work with him on it even though he is a full time college student and has proof of that) so now they have sent this debt to a Lawyer. The Lawyer says they want to take him to court right now and settle this debt. He owes 6,000 some and the lawyer says they'll prolly settle for like 4,500 but he has no way of coming up with that kind of money. So Question #1 for you guys from me is Why didnt Capital One send this debt to a collection agency?? and Question #2 is Whats going to happen if he goes to court for this? Do they do payment plans?? We dont have the money to borrow to him to pay for this and he can seriously only swing 20 or 30 bucks a month for this. Any input would be greatly seriously appreciated please please!! He's gonna call back here around 6 pm tonight and I told him hopefully i'll have some answers! Sorry its so long!

The "lawyer" is the collection agency. He can either stop taking their calls and not pay it or he can tell them he will send what he can. I think he might want to go to a debt counselor so they can get capital one to stop the finance charges and set up a payment plan. JMO

I would be calling capital one and asking them your questions...can't squeeze blood out of a turnip!

That'ls what I would do but I don't have credit cards at all. Good luck to your BIL. Where is he going to college??

He's going to Nascar Technical Institute in Mooresville.
