    Sen. Cornyn: Holder’s ‘arrogance knows no bounds’; Obama should force him to comply with Fast and Furious subpoena

    Texas Republican Sen. John Cornyn told The Daily Caller on Wednesday that he thinks Attorney General Eric Holder needs to comply with the congressional subpoena demanding documents relating to Operation Fast and Furious.

    Cornyn also said he thinks Holder’s demonstrable failure to comply with House oversight committee chairman Rep. Darrell Issa’s subpoena for Fast and Furious documents is an indicator of his overall disregard for congressional oversight.

    “It’s abundantly clear that when it comes to cooperating with Congress, the Attorney General’s arrogance knows no bounds,” Cornyn told TheDC.

    President Barack Obama now has a responsibility to step forward and make Holder comply with the subpoena, Cornyn added. He said Obama and Holder owe it the family of Border Patrol agent Brian Terry, who was murdered more than a year ago with Fast and Furious weapons the Obama administration allowed to get into the hands of Mexican drug cartels.

    “President Obama should show leadership and direct the Attorney General to provide the Terry family with answers,” Cornyn said.

    Issa served Holder with a subpoena on Oct. 12, 2011. The Attorney General has so far failed to comply with all 22 categories of the subpoena that requires him to provide Congress with documents relating to Fast and Furious. With 13 of the categories, Holder has provided no documents. When it comes to the other nine subpoena categories, Holder is still far from compliant, as TheDC reported late last week.

    Contempt of Congress proceedings for Holder appear to be on the immediate horizon if he continues failing to comply with the subpoena.

    It’s unclear if Obama will end up directing Holder to give up the documents. White House spokesman Eric Schultz didn’t respond when The Daily Caller asked if Obama will continue to allow Holder to not comply with the subpoena even in Congress moves forward with contempt proceedings.

    Cornyn’s fellow Republican Sen. Chuck Grassley, the ranking member of the Senate Judiciary Committee, said last week that Holder can either comply with the subpoena from the House, or he can force Congress to fight the administration.

    “The Attorney General is facing a real test of leadership here,” Grassley said. “He has a choice to make. He can force the department to come clean, or he can force a high-stakes political conflict between the legislative and executive branches. It’s past time to hold accountable those public officials responsible for our own government’s role in walking guns into the hands of criminals. The family of Agent Terry deserves more than what they’re getting from this administration.”

    Holder May Be Slapped In Gunwalking Scandal

    The Chairman of the House Oversight and Government Reform Committee announced Monday morning the committee will consider holding Attorney General Eric Holder in contempt of Congress on June 20 relating to the ongoing Fast and Furious ATF gun trafficking scandal. Chairman Rep. Darrell Issa (R-Calif.) has alleged that the Justice Department has not responded to the Committee’s subpoena seeking internal DOJ documents following the drafting of a February 4, 2011 letter that contained inaccurate information about ATF’s operations.

    “The Justice Department has refused to turn over critical documents on the grounds that they show internal Department deliberations and were created after February 4, 2011 – the date Justice issued a false denial to Congress. Contempt will focus on the failure to provide these post-February 4th documents.” Chairman Issa said in a statement.

    The House Oversight and Government Reform Committee and Sen. Charles Grassley (R-Iowa) have been investigating the actions of ATF and Justice Department officials involving the gun trafficking case that resulted in about 2,000 guns going to drug cartels and criminal groups in Mexico.

    The ATF’s flawed “Fast and Furious” operations allowed firearms to “walk” across the U.S. border into Mexico in hopes of tracing the guns and locating major weapons traffickers. ATF devised the program in 2009 to try to track straw purchases of firearms where a gun is legally bought but then illegally sold to another individual. The operation took a tragic turn when two weapons found in December 2010 at the scene of murdered U.S. Border Patrol Brian Terry were found to be linked to Fast and Furious.

    Issa takes issue with what he claims is the Justice Department’s efforts to not turn over documents to Congress following the drafting of a February 4, 2011 letter.

    That letter, sent to Sen. Grassley and his staff from Assistant Attorney General Ronald Weich, included the line, “ATF makes every effort to interdict weapons that have been purchased illegally and prevent their transportation to Mexico.”

    DOJ later retracted the letter and revised it and communications showing how it was drafted. According to documents released by the Justice Department, then U.S. Attorney in Arizona, Dennis Burke, wrote on January 31, 2011 to DOJ officials working on the response letter: “Grassley’s assertions regarding the Arizona investigation and the weapons recovered at the BP Agent Terry murder scene are based on categorical falsehoods.”

    It is unclear, based on the documents released who was providing inaccurate information to Burke about ATF’s role in Fast and Furious and the determination that the guns were linked to the horribly run gun smuggling operation. Burke resigned his post as U.S. Attorney last year as the scandal unfolded.

    Last Thursday Rep. Issa clashed with Attorney General Holder at a House Judiciary Committee oversight hearing.

    “I want to ask you, first of all, today, have you and your attorneys produced internally the materials responsive to the subpoenas?” Issa asked.

    “We believe that we have responded to the subpoenas.” Holder said.

    Issa snapped, “No, Mr. Attorney General, you’re not a good witness. A good witness answers the question asked. So let’s go back again: Have you and your attorneys produced internally the materials response? In other words, have you taken the time to look up our subpoena and find out what material you have responsive to it, or have you simply invented a privilege that doesn’t exist?”

    Holder testified that the Justice Department has processed millions of electronic records, and reviewed over 140,000 documents and produced 7,600 document to Issa’s subpoenas.

    The Justice Department’s Inspector General is conducting a wide ranging review of Fast and Furious and another botched ATF gun trafficking operation dubbed Wide Receiver. Unlike the congressional investigation the Department’s Inspector General has access to all Justice Department documents including secret grand jury materials.

    Rep. Issa and his investigators have found new legs in their investigation by obtaining a series of court sealed ATF wiretaps that were provided by whistleblowers.

    “[The wiretap applications] indicate that a number of key individuals in your administration in fact were responsible for information contained in here that clearly shows that the tactics of Fast and Furious were known. They were known and are contained in these wiretaps,” Issa told Holder at last weeks hearing.

    “I have read them, and I disagree with the conclusion you’ve just reached,” Holder rebutted about the wiretaps. During the hearing Holder testified that the deputy assistant attorney general at the Justice Department who reviewed the applications, did not review all the paperwork associated with the wiretap request but relied on a summary of the wiretap application.

    “While the Justice Department can still stop the process of contempt, this will only occur through the delivery of the post February 4, 2011, documents related to Operation Fast and Furious and whistleblower accusations subpoenaed by the Committee. If the Attorney General decides to produce these subpoenaed documents, I am confident we can reach agreement on other materials and render the process of contempt unnecessary.” Issa said in a statement Monday.

    The committee’s vote is scheduled for June 20. The action will be only the fourth time in 30 years that Congress has held a vote to hold an executive branch member in contempt.

    “The Justice Department is out of excuses,” House Speak John Boehner said in a statement. “Congress has given Attorney General Holder more than enough time to fully cooperate with its investigation into ‘Fast and Furious,’ and to help uncover the circumstances regarding the death of Border Agent Brian Terry. Agent Terry’s family, the whistleblowers who brought this issue to light, and the American people deserve answers. Either the Justice Department turns over the information requested, or Congress will have no choice but to move forward with holding the Attorney General in contempt for obstructing an ongoing investigation.”

    The Justice Department reacted strongly to the calls for a contempt hearing. “From the beginning, Chairman Issa has distorted the facts, ignored testimony and flung inaccurate accusations at the Attorney General and others, and this latest move fits within that tired political playbook that has so many Americans disillusioned with Washington,” said Justice Department Spokeswoman Tracy Schmaler in a statement.

    ”The Committee has ignored the fundamental – and undeniable – facts that this Attorney General put a stop to the misguided tactics, called for an investigation of this flawed operation and instituted reforms to prevent this from happening again. As recently as a few days ago, the Department staff and Committee staff were discussing a way toward a resolution of this matter,” Schmaler said.

    Report: 1 Maybe 2 More DOJ Whistleblowers “With Knowledge of Eric Holder’s Actions” Have Approached Issa Committee

    Mike Vanderboegh, the blogger who broke the Fast and Furious story in December of 2010, is reporting that sources “close to the Gunwalker investigation” are claiming “one and perhaps two sources within the Department of Justice headquarters” have approached Chairman Issa seeking whistleblower status.

    One source, who reported that there were at least two of Eric Holder’s subordinates who “came in from the cold,” characterized them as “high-level” DOJ employees “with knowledge of Eric Holder’s actions before and after” the 4 February 2011 DOJ letter denying that the DOJ and its subordinate agencies knew about “gunwalking.” That letter has since been admitted by DOJ to have been a lie. If true, one or both of these whistleblowers may be the so-called “mole” — a source within DOJ said to have been leaking documents, including the wiretap affidavits, to the House Oversight and Government Reform Committee.

    What they bring with them from the cold, according to one source, is “the keys to the kingdom as far as Holder is concerned,” adding “if this comes out before the (contempt) vote (on 20 June), then Holder is toast.”
    Vanderboegh reports that this development “has re-energized the investigation staff, which was widely rumored to be floundering after the reluctance, not to say opposition, of the GOP leadership became known some months ago.”

    He notes that other reporters are hot on this same trail, so expect to be hearing more on this “sooner rather than later.”

    House Oversight Committee Chairman Darrell Issa told the nation’s top law officer he wants to meet him to discuss ways around the impasse caused by Holder’s refusal to produce documents related to the Fast and Furious gunrunning scheme. “Let me be clear – if the Department of Justice submits a serious proposal for how it intends to alter its refusal to produce critical documents subpoenaed by the Committee, I am ready and willing to meet to discuss your proposal,” the California congressman wrote in a letter sent on Wednesday.

    The move could indicate that Republicans are softening their stance on Holder, after more than 100 called on him to quit — the most recent being veteran Utah Sen. Orrin Hatch on Wednesday.

    It came after Issa’s Senate counterpart, Sen. Chuck Grassley of Iowa, gave a similar message in an interview with Fox News’ Greta van Susteren.
    If Vanderboegh’s report is correct, I would submit that it is highly unlikely that “Republicans are softening their stance on Holder”. It’s more like - Produce the documents, or else.


    As one of Vanderboegh’s sources said of Issa:

    The left desperately wants to ironize this whole thing away — Maher and Maddow strain so hard minimize and deflect that it’s shocking neither of them pinched off a log right there on set — and frankly, they’ll find some support for their position on the timorous right from those who will declare it a bit kooky to suggest that at least one of the ideological motives animating Fast and Furious is anything so nefarious as hoping to shape domestic gun control policy.

    But most of us, we’re not going to be shamed. Not this time.

    We know what’s going on because we know who these people are. Always have, in fact. And had more people listened to our concerns instead of rushing to accommodate the articulate, world-healing pragmatist with the perfect trouser crease, we might not today be living in such a blatantly post-constitutional country, with a thin-skinned despot and a bunch of movement leftist czars attempting a soft coup right under our “historic!”/ racist noses.

    I went back yesterday to watch a couple of the archived C-Span tapings of the House Government Oversight Committee hearings touching on Fast and Furious of last year. (Just because I felt like making myself sick to my stomach, y’see.)

    The first (June 15, 2011 http://www.c-span.org/Events/quotFas...t/10737422274/ ) I saw was very interesting in light of the latest news driving events on the contempt of Congress votes. The hearing, while occasioned by the even then looming standoff over Fast and Furious, was specific to the wide oversight powers of Congress and the procedures available to Congress to enforce those powers (invitation to testify, subpoena to testify, contempt for failure to testify, court case to enforce contempt).

    The witnesses were uniformly experts on the laws and cases dealing with these powers, the history of their implementation, the alterations and modifications of the doctrine over time and so on. Most if not all of these men work or worked in the Congressional Research Service, and a few served as counsels to Congressional Committees involved in investigations like Watergate, Iran-Contra, the Bush DA firings etc. Not a one of them seemed to me to have any partisan ax to grind, but were there to inform and shed light on the murkier aspects of the law.

    If you’ve got an hour and a half or so to spare, it’s well worth the time to listen.

    Obama and the Kingdom of the Concrete Skull

    My friend Jane Woodworth looked over her newspaper, put down her coffee mug, and said , " Imagine being so down and out that you have to deter people from talking about the economy with the news that you are an accessory to murder." Nothing better summed up a week where the economy continued its tumble, the presidential approval rate continued its downward slide, and the President invoked executive privilege with respect to the government gun running operation which resulted in the deaths of hundreds of people including our own border agent, Brian Terry, and perhaps an ICE agent of ours as well.

    There was only one thing left for the failing president to do. Make a claim of executive privilege, make it late in the game, after months of his Attorney General Eric Holder's dissembling before Congress under oath, after repeated retractions of Holder statements which were proven false, a claim so weak that all it did was distract attention from the financial news and suggest to even the dimmest wit that the president himself was an accessory to murder.     While Jane picked up the tab, my friend Surfer Doc handed me this brilliant piece by Matthew Continetti in the Washington Free Beacon, and the mystery of the preposterous presidential move was solved in my mind. You see, as soon as Jim Messina was named Obama's campaign manager he headed out to Hollywood where, as everyone knows the rich stars live. Very rich stars who one imagines have their fingers firmly on the pulse of what the ordinary voters believe and want: Stuff like free contraception, no actual energy just imaginary green stuff, open borders, gay marriage and warmer relations with leftist dictators. One of Messina's top advisers from then on was Steven Spielberg and darn if this campaign -- indeed the remaining days of this presidency -- wasn't a brilliant screen play in the making: Obama and the Kingdom of the Concrete Skull.

    To start with the plan was to psych out the Republican nominee -- whoever he was -- by building up a giant staff operating out of Chicago and to loudly boast that he planned to build up a billion dollar war chest. (Messina shared this "you have no chance" strategy with Rich Trumka, who unfortunately found it didn't work for him in Wisconsin no matter how many busloads of make believe Wisconsin residents he rounded up on election day in Chicago and bussed north.)

    It didn't seem effective for Obama either, when despite The New York fashionistas' and Hollywood's best efforts, the fund raising fell far short of the goal. The giant staff in Chicago proved an enormous python that is eating up more than the fundraisers can herd into its maw, even given the Administration's well-documented pay to play style. Meanwhile the Obamas' constant flights from coast to coast begging for money to feed the beast are more frequent than the regular United Airlines flights from DC to San Francisco and Los Angeles. In fly-over country, the unemployed amuse themselves making bets on which plane will fly over more often each day -- Air Force One or Air Force Two. It also seems they are making very rude gestures whichever of the two planes are overhead.

    Secondly, the very things the coastal contributors said the people wanted, they actually didn't care that much about. Those little people really just wanted jobs; wanted to keep their homes; wanted to be able to afford food, clothing and education and energy; wanted a thriving economy, in short. That's how simple-minded and narrow they are. This the Hollywood geniuses couldn't help with. Neither could the fashionistas who head up and flog for the schmata business. Neither, in fact, could the President's most ardent supporters at the rapidly failing MSNBC, New York Times and Washington Post.

    How bad was this vision of what the re-election campaign should look like?

    Even Democratic officials are running away from Obama. Michelle Malkin writes:

    By The Daily.com's count, at least seven Democratic officials will skip Obama-palooza: New York Democratic Reps. Bill Owens and Kathy Hochul; Pennsylvania Democratic Rep. Mark Critz; three endangered Democratic politicians from West Virginia, Gov. Earl Ray Tomblin, Sen. Joe Manchin, and Rep. Nick Rahall; and Utah Democratic Rep. Jim Matheson.

    The Democratic boycotters have dinged Obama on everything from his election-year illegal alien amnesty power grab to his failed jobs programs to his destructive war on coal. While "Forward!" may be the official Obama campaign slogan, "Back Away!" is quickly becoming the dissenting Democrats' rallying cry.
    It's not just fly-over country that's hurting. Black voters, Obama's most ardent supporters, are suffering the most from his economic policies -- even in New York Walter Russell Mead:

    The New York Times is reporting that more than half of all black New Yorkers are now unemployed, and that they remain unemployed for a year on average after losing their jobs. Meanwhile, the number of "discouraged workers"-people who give up looking for work after a long period of unemployment-has risen to 40,000 among blacks, much higher than it stood at the beginning of the recession and nearly twice the rate for whites.

    Numerous businesses have reported payroll increases, and important professional industries like law and accounting are beginning to recover. Blacks, however, have been largely left out of this recovery-including college-educated blacks, who in many cases have been forced to settle for jobs well below their qualifications.
    The screen play plot is so full of holes that even the little people are noticing. What is it about the scheme to let thousands of guns walk across to the border to drug cartels that involves the executive? It is not any discussions with the Mexican government and, therefore, there can be no national security claim. The facts are clear -- no Mexican officials were informed of this hare-brained scheme, (The President himself, before his first run for office was critical of executive privilege claims not made on a national security basis.)

    As the week drew to a close, CBS's Sheryl Attkisson, a media hero for her work which alone of all the thousands of Journalists covering national affairs, kept exposing this scandal, reported even more damaging information for Holder -- who certainly is about to go under the Obama bus -- and the President:

    Documents obtained by CBS News show that the Bureau of Alcohol Tobacco, Firearms and Explosives (ATF) discussed using their covert operation "Fast and Furious" to argue for controversial new rules about gun sales.

    In Fast and Furious, ATF secretly encouraged gun dealers to sell to suspected traffickers for Mexican drug cartels to go after the "big fish." But ATF whistleblowers told CBS News and Congress it was a dangerous practice called "gunwalking," and it put thousands of weapons on the street. Many were used in violent crimes in Mexico. Two were found at the murder scene of a U.S. Border Patrol agent.

    ATF officials didn't intend to publicly disclose their own role in letting Mexican cartels obtain the weapons, but emails show they discussed using the sales, including sales encouraged by ATF, to justify a new gun regulation called "Demand Letter 3". That would require some U.S. gun shops to report the sale of multiple rifles or "long guns." Demand Letter 3 was so named because it would be the third ATF program demanding gun dealers report tracing information.
    If this account is true, we have an Administration which ran an illegal operation designed to further regulate and therefore diminish American citizens' constitutional right to bear arms ; when the scheme resulted in the death of 200 Mexicans and at least one and possibly two U.S. agents, it lied repeatedly under oath about it; and the White House was involved in the efforts illegally to cover it up.

    No one who objectively scrutinized the actual resume of Barry Soetoro, in contrast to the blank slate upon which you project your hopes and dreams, should be one bit surprised by the situation in Washington right now. It was inevitable.

    Barry is not our president, he is a liar, a fraud, a Marxist, and now we suspect him to be a felon.

    Fast & Furious is perfectly in congruity with tactics he has used his entire public life.

    The Bill Whittle Afterburner piece is absolutely brilliant - it ties the entire escapade up and puts a pretty bow on top. This operation is an attempt by Obama (not Holder) to attack our Second Amendment right to keep and bear arms.

    Remember the reason that this right exists: to protect you from tyranny. It is not so that you can walk down the street with a Colt strapped to your belt, although that is a nice side benefit. It is the response, it is the residue, of the Boston Massacre and the Battle of Lexington and Concord where the King's Militia were either shooting at British subjects or attempting to deprive British subjects of arms they deemed necessary to thwart the tyranny of the Crown.

    A citizenry deprived of arms is powerless to defend itself when governments go bad.

    The resultant and nascent American government sought to ensure that in the future no government on American soil would have that advantage over its citizens. They knew that government was a necessary evil and that it needed to be limited in many different ways from the tyranny of the majority. That is the reason for freedom of speech, assembly, petition of grievances. That is the reason for checks and balances, that is the reason for a separate and impartial judiciary.

    The Declaration of Independence and the Constitution of the United States are two of the most important and significant documents ever written in the history of mankind as they seek to empower individuals with ownership of their government supported by inalienable rights that come to us from God, not from government.

    Barry Soetoro thinks that they are just the opposite of what the authors of the documents intended. Barry Soetoro thinks that just because he is a Harvard trained lawyer that he can tip his head back and ignore the pleas of those whom he was elected to represent.

A close examination of his life and his curriculum vitae by ANYONE who is even remotely fair minded would show a man woefully unfit to hold almost any office of government, let alone, the presidency of this nation. To my enduring amazement, people with both education and intelligence continue to support him in the face of the most obvious of incontrovertible proofs that he is a charlatan, a phony.

    Darrell Issa: President's Executive Privilege Claims 'Simply Wrong'


    Rep. Darrell Issa, R-Calif. said this morning on "This Week" that he will send a letter to President Obama today or tomorrow that "breaks down the points" of why the president's executive privilege claims are "overbroad" or "simply wrong" concerning documents related to the botched "Fast and Furious" operation.

    "There cannot be executive privilege over criminal cover-up or cover-up of crime. Lying to Congress is a crime. We have every right to see documents to say, 'did you know, when did you know, what did you know,' including even the president," said Issa, who heads the House Oversight and Government Reform Committee.

    Issa outlined this morning that before the House committee he leads voted to hold Attorney General Eric Holder in contempt, he tried to reach an agreement with Holder.

    "They came with nothing. Not even an offer in a form of a piece of paper. What they said orally was 'we will brief you. We will then give you the information we believe supports that briefing, but you have to first agree to dismiss your subpoenas and your contempt," said Issa. "You can't play liar's poker when you're looking for who killed somebody, when you're looking into this kind of a crime, and when you're looking into the cover-up. Remember, it was deny, delay, and recuse."

    Issa said he is specifically seeking access to a memo or email produced by Jason Weinstein, Deputy Assistant Attorney General at the Justice Department. The memo, confirmed to exist, is an evaluation of what happened during the "Fast and Furious" operation and, according to Issa, could answer crucial questions relating to his investigation.

    On Wednesday, President Obama invoked executive privilege for the first time during his term in office just before a House committee headed by Issa voted to hold Attorney General Eric Holder in contempt of Congress for failing to provide documents related to the failed "Fast and Furious" operation that were subpoenaed more than 8 months ago. The use of executive privilege, while a rarity for the Obama administration, was used 14 times by Bill Clinton and six times by George W. Bush.

    Holder is the first Obama administration official to be held in contempt of Congress. For his part, Holder called the contempt vote "extraordinary, unprecedented and entirely unnecessary." The full House of Representatives plans to vote on whether to hold Holder in contempt of Congress in coming days. If the full House finds Holder in contempt, the matter would be handed over to the Justice Department and Holder could eventually be prosecuted.

    Guns lost in the "Fast and Furious," operation, which was originally meant to track the flow of firearms between the United States and Mexican drug cartels, were found near the scene of Border Patrol Agent Brian Terry's killing in 2010, which sparked outrage.

    A clear majority of likely voters believes President Obama has exercised his executive power inappropriately — particularly in blocking the release of documents relating to Operation Fast and Furious, according to a new poll for The Hill. …

    The Hill Poll found that likely voters disapproved by an almost 2-to-1 margin of Obama’s assertion of presidential power in the case. Overall, 56 percent of voters disapproved of his action, while only 29 percent approved.
    The news is even worse among independents, and it’s not exactly a slam-dunk among Obama’s base, either:

    The defense is not proving an easy sell with voters, particularly independents.

    Sixty-one percent of independents said they disapproved of the president’s actions, and just 25 percent approved. Among Republicans, opposition to the president’s use of executive privilege was more entrenched at 78 percent.

    Even 28 percent of Democrats, and 30 percent of self-identified liberals disapproved of Obama’s position.
    When asked more generically (“Has President Obama used his Executive Authority appropriately or inappropriately?”), the numbers narrow, but not all that much. Obama still loses by a majority, 43/52, and does slightly worse than that among younger voters (42/56) and independents (40/55). On the specific question, younger voters — on whom Obama depends for support and enthusiasm — give him worse marks than the overall rating, at just 24/60.

    Congress doesn’t do terribly well in this poll either, but still fares better than Obama. A plurality believe that Congress has been obstructive (48/41), with a majority of independents agreeing (51/38), but that’s of small comfort to Obama. That point is now moot. Now that Obama has asserted executive privilege to block access to these documents, the onus has shifted to the White House to explain itself. Clearly, the explanations given have not sufficed, and Obama’s supporters are a small minority on this issue. The more he pushes it, the more damage he will do even within his base.

    Don’t be surprised to see the White House cut a deal on this if more polling corroborates this result. If not, then it’s further confirmation that whatever they’re hiding is more damaging than the political hit they’ll take from pursuing a Nixon strategy four months before the election.

    Let’s remember what this ploy really was- a way to stall any disclosure until after the elections. The only way that Holder will suddenly cut a deal is if it is politically expedient and that is hard to see since damage will be done either way. Holder tried to split the difference and “brief” on the documents being withheld the committee in exchange for a promise that there would be no prosecution as a result. When that didn’t work, EP was invoked to play out the clock. I suspect the administration would rather be accused of Nixonian behavior than have to explain why Valerie Jarrett and Eric Holder were discussing an operation that supposedly was known to nobody but a rogue ATF agent in Phoenix.

    We’ll see if polling holds up on this. I watched the American people take the Clinton line about “he lied about a bj” hook, line, & sinker with no thought whatsoever to the seriousness of perjury, the context of the Paula Jones lawsuit, the rule of law, etc.

    Don’t forget the two “retractions” of Holder’s sworn testimony that would put anybody else in line for perjury charges.

    But here’s the reality. Holder will be held in contempt and the case will go to the US Attorney for DC (an Obama appointee and Holder crony) who will decline to prosecute. This will cause the House to file a lawsuit enforcing the contempt charge and forcing disclosure of the documents. In all this legal process will be months after the election. The only way for quick resolution is release of the documents by President Romney after taking office.

    President Obama on Wednesday asserted executive privilege over Fast and Furious documents just as a House panel prepared to push ahead with a contempt vote against Attorney General Eric Holder.

    Here's what the president's action means:

    -- Executive privilege allows Obama to withhold from Congress documents revealing internal communications and decision-making of the executive branch of government that he believes should remain confidential.

    -- A subpoena by Congress cannot override claims of executive privilege. However, the privilege is considered "qualified" and "not absolute," meaning it can be challenged and overturned in the courts, according to the Congressional Research Service.

    During Wednesday's hearing, Rep. Dennis Kucinich, D-Ohio, suggested to chairman of the House Oversight and Government Reform Committee, Rep. Darrell Issa, R-Calif., that the dispute be resolved by the courts before Congress proceeded with a contempt vote. But Issa said the committee is "concurrently evaluating" the executive privilege claim and trying to get a "log" of executive privilege assertions from the White House. He also said the letter he received claiming executive privilege, which was from Deputy Attorney General James Cole, was not sufficient. "Only the president can do it," Issa said. "A letter saying the president has done it is not sufficient."

    -- Historically, a challenge of executive privilege rarely reaches the courts. The majority of disputes over access to information have been resolved through political negotiations.

    "While reviewing courts have expressed reluctance to balance executive privilege claims against a congressional demand for information, they have acknowledged they will do so if the political branches have tried in good faith but failed to reach an accommodation," according to CRS.

    -- The idea of executive privilege is not explicitly mentioned in the U.S. Constitution, but the Supreme Court ruled it to be part of the "separation of powers" doctrine.

    -- This is the first time President Obama has asserted executive privilege. Presidents Richard Nixon, George W. Bush and Bill Clinton all resorted to using executive privilege during their administrations. The practice has been used 24 times since President Ronald Reagan to protect the confidentiality of information.
