Barry Busted! Admits ObamaCare is a Tax

Yes, you might not get hit with a "tax" IF you have health insurance. The only logical conclusion is, Obama believes you will if you end up being hounded by the IRS to pony up for that wonderful insurance you apparently couldn't afford. Barry ... busted!

RICHMOND, Va. – President Obama used the word “tax” to describe the health care mandate under his reforms, a departure from his prior etymological stance that it is a penalty.

“By the way, if you’ve got health insurance, you’re not getting hit by a tax,” the president said during his Friday rally in Roanoke, his third Virginia campaign event of the day. “The only thing that’s happening to you is that you now have more security because insurance companies can’t drop you when you get sick.”

Govs say they'll opt out of Medicaid plan

WASHINGTON - Several Republican U.S. governors say they have decided against expanding Medicaid based on the Supreme Court decision on the Affordable Care Act. The Supreme Court's 5-4 decision, which largely upheld the healthcare act, allows states to opt out of the Medicaid expansion without losing all federal funding they receive for Medicaid, as they would have under the original health-care legislation, CBS News reported.

The Republican governors -- Rick Scott of Florida, Nikki Haley of South Carolina, Scott Walker of Wisconsin and Bobby Jindal of Louisiana -- also said they have decided against setting up a state-based health insurance marketplace. The healthcare law stipulates that if states don't set up such an "exchange" by 2014, the U.S. Department of Health and Human Services will do it for them.

Scott explained the state's decision to opt out of the Medicaid expansion and the exchange in a statement Sunday. The act would open Medicaid in 2014 to anyone with an income under 138 percent of the federal poverty line, if their states have agreed with the expansion.

If The Obamacare Mandate Is A Penalty, Then Where Is Our Due Process?
    Rob Port July 11, 2012 12:26pm

The 5th amendment to the constitution states requires that no person “be deprived of life, liberty, or property, without due process of law.” In the wake of the Supreme Court ruling upholding the Obamacare mandate the Obama administration and other Democrats have argued that the mandate is not a tax, as the court ruled, but rather a penalty.

According to White House spokesman Tim Carney, “it is simply a fallacy to say that this is a broad-based tax…this is clearly a penalty that affects less than 1 percent of the American population.”

But if the mandate is a penalty punishing us by depriving us of some property (money) because we do not have health insurance, then aren’t we to be afforded due process in the courts? That’s a question California Rep. Tom McClintock is asking: http://cnsnews.com/blog/craig-bannis...ence-theyll-be

“If the government fines you $250 for running a red light, or it taxes you $250 for running a red light, the effect is the same. What’s the difference? There are two critical differences.”

“First, as a fine – as a penalty – the burden of proof is on the government to prove that you ran that red light. As a tax, the burden of proof is on you to prove that you did not run it. Anyone who has ever undergone an IRS audit knows exactly what I mean. This decision fundamentally alters the most cherished principle of our justice system: the presumption of innocence.”

“There is a second, even more chilling difference between a penalty and a tax. Under our Constitution, no penalty can be assessed without due process – you cannot be punished until you have had your day in court. But to challenge a tax, you must pay first pay that tax before you can seek redress through the court. You are punished first, and then tried. “

“This is the madness of Lewis Carroll’s Red Queen brought to life: “Sentence first – verdict afterwards.”
Maybe it’s time for Democrats to admit that Obamacare represents a tax on people without health insurance.

Under Obamacare, if you live to 76 you are not eligable for cancer treatment, how will libs defend this?

Not to mention all the other BS we are finding out what was in the bill

At age 76 when you most need it, you are not eligible for cancer treatment What Nancy Pelosi didn't want us to know until after the healthcare bill was passed. Remember she said, "pass it and then read it!!." Here it is!

Obama Care Highlighted by Page Number

THE CARE BILL HB 3200 JUDGE KITHIL IS THE 2ND OFFICIAL WHO HAS OUTLINED THESE PARTS OF THE CARE BILL.

Judge Kithil of Marble Falls, TX - highlighted the most egregious pages of HB3200 Please read this........ especially the reference to pages 58 & 59 JUDGE KITHIL wrote:

** Page 50/section 152: The bill will provide insurance to all non-U.S. residents, even if they are here illegally.

** Page 58 and 59: The government will have real-time access to an individual's bank account and will have the authority to make electronic fund transfers from those accounts.

** Page 65/section 164: The plan will be subsidized (by the government) for all union members, union retirees and for community organizations (such as the Association of Community Organizations for Reform Now - ACORN).

** Page 203/line 14-15: The tax imposed under this section will not be treated as a tax. (How could anybody in their right mind come up with that?)

** Page 241 and 253: Doctors will all be paid the same regardless of specialty, and the government will set all doctors' fees. ** Page 272. section 1145: Cancer hospital will ration care according to the patient's age.

** Page 317 and 321: The government will impose a prohibition on hospital expansion; however, communities may petition for an exception.

** Page 425, line 4-12: The government mandates advance-care planning consultations. Those on Social Security will be required to attend an "end-of-life planning" seminar every five years. (Death counseling..)

** Page 429, line 13-25: The government will specify which doctors can write an end-of-life order. HAD ENOUGH????

Judge Kithil then goes on to identify: "Finally, it is specifically stated that this bill will not apply to members of Congress. Members of Congress are already exempt from the Social Security system, and have a well-funded private plan that covers their retirement needs. If they were on our Social Security plan, I believe they would find a very quick 'fix' to make the plan financially sound for their future." - Honorable David Kithil of Marble Falls, Texas All of the above should give you the ammo you need to support your opposition to Obamacare. On March 23, 2010, President Obama signed into law the Patient Protection and Affordable Care Act, and a week later, signed into law the Health Care and Education Reconciliation Act of 2010, which made some changes to the comprehensive health reform law.

This interactive side-by-side provides detailed summaries of the final new health reform law, as well as more than a dozen other comprehensive proposals put forward during the year-long reform debate in Congress. The online tool allows users to compare the law and other bills, plans and proposals with one another across key characteristics. In addition to the summaries offered here, the Foundation also has prepared an implementation timeline for the new law, as well as detailed descriptions of the Medicare and Medicaid provisions, and a summary of the coverage provisions in the law.

Out: Obamacare mandate is a penalty, fee, tax or compulsatory wellness outlay opportunity
In: Obamacare mandate is a ‘principle’
    By Doug Powers • July 18, 2012 11:03 AM

Last month, Jay Carney referred to the Obamacare mandate as a penalty. http://michellemalkin.com/2012/06/30...e-mandate-tax/

President Obama had previously claimed it was “not a tax” http://www.youtube.com/watch?feature...&v=TdgPauuMmJI
before calling it a tax just last week. http://michellemalkin.com/2012/07/14...obama-mandate/

But now they appear to be settling on an angle. Meet the newest addition to the parade of Obamacare mandate nomenclature: “Principle”: http://www.politico.com/politico44/2...le-129274.html

In the ongoing debate over whether the Affordable Care Act’s mandate is a tax or a penalty, President Obama tried a different approach — calling it a “principle.”

“It’s less a tax or a penalty than it is a principle — which is you can’t be a freeloader on other folks when it comes to your health care, if you can afford it,” Obama said in an interview with Toledo’s WTOL.

The White House has struggled with how to respond to charges that the Affordable Care Act — deemed constitutional by the Supreme Court last month under Congress’ taxation power — raises taxes.

Possible addition to today’s agenda at the White House: Drafting an executive order that will change the name of April 15th to “Principle Day” http://abcnews.go.com/blogs/politics...ow-much-is-it/ (though maybe “principal” would be the more appropriate spelling). http://www.huffingtonpost.com/2012/0...n_1347327.html

So it is fine to be a freeloader if you dont have money. And the left wonders why we say they have no idea what priciples are.

This from the ONE whose economic policies have added millions to the welfare rolls.
    ..

Of course Obama neglects to mention that his so-called principle was already in place before Obama care. You know, if you go to the doctor and you do not have insurance you get a bill. Which you can usually set up to pay over time and if you do not pay your bill the hospital can take legal actions against you.

    ..

My kids are in their 30′s now. Never had health insurance. Had to pay that bill thingy that Truesoldier alluded to whenever they needed a doctor. It was just like the other bills I paid. I worked. Put money in the bank. Wrote checks and mailed them. No government needed except the Post Office.

    ..

... which is you can’t be a freeloader on other folks ...
except on food stamps, welfare, subsidised housing, unlimited unemployment, government gold plated bene’s, and paying retirement to elected politicians. did i leave any out?

    ...

One thing continues to puzzle me about Obumbler and his principle. If you can’t afford insurance, as he claims many people cannot, how will they pay the mandate fee/tax/principle/whatever? Or will they get the free insurance deal through the exchange? Doesn’t that make them freeloaders anyway? Paid for by everyone else’s tax dollars?

    ..

So how are all the illegal aliens going to pay for the healthcare they are getting ‘free’ at taxpayers expense now? Do they get a waiver as many many others have gotten from bho/team?

How will bho/team deal with the Catholic Church and others of faith that have lawsuits against them for their contraception issue? Not on ‘principle’ I would imagine?

Why are certain faiths ( Amish, Muslim ) exempted based on their faith ... but the Catholic and Christian churches are not ?
